HomeMy Public PortalAbout1987-006Member 51- e-Vt.-ci introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. /- RESOLUTION DENYING A VARIANCE FOR BRUCE NEUMANN WHEREAS, Bruce Neumann (Applicant) has requested a variance to complete an addition to his property at 25 Hamel Road; and WHEREAS, the addition would extend to within 6 feet of the side lot line; and WHEREAS, Section 826.57 of the City's zoning ordinance requires that structures maintain a minimum side yard setback of 30 feet; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request but did not recommend approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance be denied because there has been no showing of a hardship unique to the property as required by the City's ordinance and state statute.
