CITY OF MEDINA
RESOLUTION NO. 577 7
RESOLUTION APPROVING LOT COMBINATION/REDIVISION
FOR CAROLINE BREDE
WHEREAS, Caroline Brede (Applicant) has submitted an application for
combination and redivision of her property, which is currently described in
Exhibit A, attached hereto; and
WHEREAS, the new description of the property shall be Lots 1, 2 and 3,
Block 1, Pieper Addition, Hennepin County, Minnesota; and
WHEREAS, the proposed lot combination/redivision has been reviewed by the
planning commission and City Council for compliance with all City ordinances
and regulations pertaining to the subdivision of land.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the combination and redivision of the above described property
by Caroline Brede is hereby approved, subject to the following:
1. The cottage and outhouse shall be razed within one year of the date of
approval, or upon completion of a new garage, whichever occurs first.
2. City staff shall review the location of the proposed new garage to ensure
adequate room for a new house to be constructed on the property in the
future.
3. The Applicant shall pay to the City a sewer and water connection charge
in the amount of $4,518 at the time of issuance of the building permit.
4. Use of the new garage shall be limited to the owner of the property and
it shall be constructed in compliance with all setback and other codes
and ordinances of the City.
5. The Applicant shall submit title evidence for review by the City Attor-
ney, which shall include matters relating to easements for access to the
small lakefront lots surrounded by the Applicant's property.
6. The Applicant shall not permit the above described property to be used
for access to the small lakefront lots surrounded by the Applicant's
property unless it is demonstrated that her property is encumbered by a
pre-existing easement for such purpose.

Exhibit A
That part of Government Lot 2, Section 18, Township 118
North, Range 23 West of the 5th Principal Meridian,
described as follows:
Commencing at the southeast corner of said Govern-
ment Lot 2; thence west along the south line of
said Government Lot 2, distant 396 feet; thence
north 297 feet; thence North 70 degrees West,
distant 1255 feet to the point of beginning;
thence at an angle left 90 degrees distant 356
feet to the shore line of Lake Independence;
thence northwesterly along said shore line distant
423 feet, more or•less, to the extension of the
North 70 degrees West line; thence southeasterly
along said extension of the North 70 degrees West
line to the point of beginning.
Lots 6 and 7, and the South 50.00 feet of Lot 5,
Block 27, "INDEPENDENCE BEACH, HENNEPIN COUNTY,
MINNESOTA", according to the recorded plat thereof.
That part of the vacated Westerly 10.00 feet of Lake
Shore Avenue adjoining Lots 6 and 7, and the South
50.00 feet of Lot 5, Block 27, "INDEPENDENCE BEACH,
HENNEPIN COUNTY, MINNESOTA", according to the recorded
plat thereof.
The Easterly 20.00 feet of the Southerly 45.00 feet of
that part of the tract of land designated as "BEACH" on
the plat of "INDEPENDENCE BEACH, HENNEPIN COUNTY,
MINNESOTA", according to the recorded plat thereof,
lying between the westerly extensions of the north and
south lines of Lot 5, Block 27 in said plat of
"INDEPENDENCE BEACH, HENNEPIN COUNTY, MINNESOTA".
The Northerly 25.00 feet of the Southerly 35.00 feet of
that part of the tract of land designated as "BEACH" on
the plat of "INDEPENDENCE BEACH, HENNEPIN COUNTY,
MINNESOTA", according to the recorded plat thereof,
lying between the westerly extensions of the north and
south lines of Lot 5, Block 27 in said plat of
"INDEPENDENCE BEACH, HENNEPIN COUNTY, MINNESOTA", and
which lies westerly of the Easterly 20.00 feet of said
"BEACH".
Par. 6. That part of the tract of land designated as "BEACH" on
the plat of "INDEPENDENCE BEACH, HENNEPIN COUNTY,
MINNESOTA", according to the recorded plat thereof,
lying between the westerly extension of the northerly
line of Lot 6, Block 27 in said plat and the westerly
extension of the southerly line of Lot 7, Block 27 in
said plat. EXCEPT the two following described parcels
of land.
EXCEPTION NO. 1
That part of the Southerly 10.00 feet of the
Northerly 20.00 feet of the above described
property, lying westerly of the Easterly 20.00
feet of the above described property.
EXCEPTION NO. 2
All that part of the tract of land designated
"Beach" on the plat of "Independence Beach,
Hennepin County, Minnesota" described as follows:
Beginning at a point on the extension of the North
line (extended Westerly to Lake Shore) of Lot 6,
Block 27, said Addition, 20 feet Westerly from the
Northwest corner of Lot 6, Block 27, said Addi-
tion, measured along said extension; thence South
at right angles thereto 10 feet; thence Westerly
parallel to said extension to the Lake Shore;
thence Northerly along the Lake Shore to said
extension; thence Easterly to point of beginning,
according to the plat thereof on file or of record
in the office of the Register of Deed in and for
Hennepin County.
