RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
GREG EBERT FOR VILLAGE AUTO
WHEREAS, Greg Ebert/Village Auto (Applicant) has requested a conditional
use permit to add a second floor to the existing building located at the
southeast intersection of T.H. 55 and County Road 19, which property is
legally described as the North 276.00 feet of the West 352.00 feet of the West
half of the NE 1/4 of Section 6, Township 118, Range 23, Hennepin County,
Minnesota; and
WHEREAS, construction of the addition requires a conditional use permit
under the provisions of the City's zoning ordinance; and
WHEREAS, this matter has been reviewed by the planning commission on
January 13, 1987, and by the city council on February 3, 1987; and
WHEREAS, it has been determined that the construction of the proposed
addition will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicant for the
stated purpose, subject to the following terms and conditions:
1. The exterior building materials to be used on the east side of the
structure shall be the same as those currently used on the north
side;
2. The Applicant shall install the landscaping required by the approved
plan to the satisfaction of the zoning administrator;
3. The hours of operation of the video store and superette may be 24
hours per day, 7 days per week but the liquor store's hours shall
conform to state law;
4. The Applicant shall screen the south side of the building by
planting six evergreens, each o which must be a minimum of six feet
in height, by no later than `Ju A, / � / 9 � % • An additional six
evergreens of the same height and species shall be planted on the
south side of the building upon completion of Leonard's Lane;
5. Outlot A, Schlosser Addition, Hennepin County, Minnesota, shall be
combined with the property upon which the existing building is
located;
6. The Applicant shall install a new pressurized mound septic system at
the site prior to July 1, 1987;
7. The steel roof of the building shall not exceed a 2/12 pitch;
8. The Applicant shall screen the dumpster to the satisfaction of the
zoning administrator;
9. The Applicant shall install parking as shown on the approved plan;
10. The Applicant acknowledges that the south side of the building is
metal and agrees that after construction of Leonard's Lane the south
side of the building will be brought into full compliance with the
city's performance standards;
11. The Applicant shall post a bond or other financial guarantee in the
amount required by the zoning administrator and shall execute a
development contract satisfactory to the city attorney; and
12. The Applicant shall pay to the city a fee in an amount determined by
the staff to represent the actual cost to the city of reviewing this
conditional use permit application.
