O Y— CI RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO RICHARD KIENE WHEREAS, Richard Kiene (Applicant) has applied for a conditional use permit for a second accessory structure at 2125 Cottonwood Trail which, in combination with an existing accessory structure, will exceed the 3000 square feet allowed by the City's zoning ordinance; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on January 13, 1987, and by the City Council on February 3, 1987; and WHEREAS, it has been determined that the existence of two accessory structures totaling 4305 square feet will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The accessory structure shall not exceed 3456 square feet in size and shall not be used for more than eight horses; 2. The Applicant shall ensure that manure is removed according to the standards of the Minnesota pollution control agency and that it is stored in a container to prevent pollution through run off; 3. Excavation and drainage shall be approved by the city engineer; 4. Exterior lighting shall be limited to standard yard lighting; 5. The Applicant acknowledges that the accessory structure shall be only for his private use and that no commercial horse boarding or training shall be allowed on the site; and 6. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
