AN ORDINANCE, making an appropriation of Three Hundred Sixty-Five
Thousand Dollars ($365,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer
construction and private I/I removal in Fishpot Trunk West and Ed Lou Lane I/I Reduction (Smith
Dr and Vlasis Dr) (12173) in the Cities of Ballwin, Ellisville, and Unincorporated St. Louis
County, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of
The Metropolitan St. Louis Sewer District to enter into Contract No. 22078 with Bates Utility
Company, Inc. for sanitary sewer construction and private I/I removal.
WHEREAS, the bid for said sanitary sewer construction and private I/I removal is
Two Hundred Ninety-Eight Thousand Eight Hundred Fifty-Nine Dollars ($298,859.00) and the
allowance for construction change orders and other project expenses is Sixty-Six Thousand One
Hundred Forty-One Dollars ($66,141.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Sixty-Five Thousand Dollars
($365,000.00) is hereby appropriated from the Sanitary Replacement Fund for sanitary sewer
construction and private I/I removal in Fishpot Trunk West and Ed Lou Lane I/I Reduction (Smith
Dr and Vlasis Dr) (12173) in the Cities of Ballwin, Ellisville, and Unincorporated St. Louis
County, Missouri; said contract being comprised of such terms and conditions as have been
approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 22078
with Bates Utility Company, Inc., as the lowest responsible bidder for sanitary sewer construction
and private I/I removal in Fishpot Trunk West and Ed Lou Lane I/I Reduction (Smith Dr and Vlasis
Dr) (12173) in the Cities of Ballwin, Ellisville, and Unincorporated St. Louis County, Missouri,
pursuant to bids received on the 14th day of September, 2021.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted on November 10, 2021.
