AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,VACATING AND DISCONTINUING
AN UNNAMED PUBLIC ALLEYWAY BETWEEN MYRTLE STREET(ALSO KNOWN AS MYRTLE
AVENUE)AND ELIZABETH STREET,AND VACATING AND DISCONTINUING A PORTION OF A
SURFACE WATER DRAINAGE EASEMENT RECORDED IN BOOK 199, PAGE 683, COLE
COUNTY RECORDER'S OFFICE.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri,that the owners of
land adjacent to and abutting upon said public alleyway and surface water drainage
easement in the City have petitioned the City Council to vacate the right of way and
easement; and
WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of
the City to discontinue the alleyway right of way for public use as described in
Section 1 of this Ordinance; and
WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of
the City to discontinue the surface water drainage easement for public use as
described in Section 2 of this Ordinance.
NOW,THEREFORE, BE IT ENACTED BYTHE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue as right of way and forever vacate the following described
Alleyway Right-of-Way in said City: All of an unnamed public 10 foot alleyway as shown and
dedicated by the Morris & Edmonds Subdivision as recorded in Plat Book 2, Page 19, Cole County
Recorder's Office, Jefferson City, Missouri; said alleyway and subdivision being within the City of
Jefferson, County of Cole Missouri, and said alleyway being more particularly described as follows:
All of an unnamed 10 foot public alleyway lying within Block 6 of said Morris & Edmonds
Subdivision, beginning at Myrtle Street lying to the east, to Elizabeth Street lying to the west, and
said alleyway lying between Lots 1 through 14 to the north, and Lots 15 through 28 to the south,
inclusive.
Section 2. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue as right of way and forever vacate the following described
Surface Water Drainage Easement in said City: A portion of a Surface Water Drainage Easement
as described and recorded in Book 199, Page 683, Cole County Recorder's Office, Jefferson City,
Missouri; said portion of easement lying within Block 6 of the Morris & Edmonds Subdivision, a
subdivision of the City of Jefferson, County of Cole, Missouri, and recorded in Plat Book 2, Page 19,
Cole County Recorder's Office; said portion of easement being more particularly described as
follows: The northerly 10 feet of Lots 22 through 28 inclusive, Block 6 of Morris & Edmonds
Subdivision, Jefferson City, Missouri, as per plat of record in Plat Book 2, Page 19 (original
easement INCORRECTLY references Plat Book 2, Page 24), Cole County Recorder's Office.
Section 3. The statutory right of reversion in the owners of the abutting property is hereby
confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the
City are hereby authorized to execute all necessary instruments required to confirm the reversionary
rights of the owners of property abutting on the area vacated, as described in Section 1 of this
ordinance.
Section 4. This Ordinance shall take effect and be in full force from a d after its passage.
