Bassett, Constable of the Tow: of Brewster Greetings: In the name of the Commonwealth of hassaehusetts you are hereby directed to notify and warn the inhabitants of the gown of Brewster qualified to vote in Town affairs to meet at Cur lady of the .Cape VhurchAuditorium on Monday, the sixth day of March next at seven o'clock in the evening, then and there to act on the following articles: ARTICLE 1 . To act on the annual report of the Selectmen and other Town. Officers. ARTICLE 2. To see if the Town mill vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginni 1- 84 ARTICLE 11 . To see if the Town will vote to raise and approp- riate, such sums of money as may be deemed necessary to defray Town charges and expenses for the year 1972. ARTICLE 12. To see if the Town will vote to raise and approp- riate, or transfer- from unappropriated available funds in the treasury, a sum of money for Chapter 81 , highways. ARTICLE 13. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the treasury, a sura of money for Chapter 90, highways. ARTICLE 14. To see if the Town will vote to appropriate from the Road Machinery General Fund, the sum of Thirty Five Hundred Dollars ($3,500.00) to be used for the purchase, maintenance and --- operation of Road Machinery. ARTICLE 15. To see if the :'own will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter 516 and 524, Acts of 1950 for all damages that may be incurred by work to be performed by the Department of Public Arks of Eassachusetts for the improvement, development, main- tenance and protection of tidal and noel-tidal rivers and streams, harbors, tide--waters, foreshores and shores along a public beach outside Boston harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91: of the General Laws, and authorize the Selectmen to execute and deliver a nand of Indemnity therefore to the Commonwealth. ARTICLE 16. To see if the Town will vote to authorize and instruct the Town Treasurer to pay the Dog Tax returns from the assessments of 1971 to the Brewster Ladies Library Association in accordance with Chapter 140, Section 72. ARTICLE 17. To see if the Tow_ will vote to transfer from available funds in the treasury, the sum of Five Hundred Dollars Sot) to the Brewster Ladies Library Association. ARTICLE 18. To see if the Town will vote to instruct the Selectmen to contract for one year for Ambulance Service with the Brewster, Orleans, Eastham. Ambulance Association, Inc. and raise and appropriate the sum of rive Thousand Dollars ($5,000.00) for this purpose. (By Request) ARTICLE 19. To see if the Town will vote to raise and appropriate the sum of Two Hundred Six Dollars and Eighty Cents ($206.80) under the provisions of Chapter 388, Acts of 1954 amended by Chapter 433 of 1955, Control of Greenhead Fly and authorize the Town Treasurer to pay said appr°opriation,i,.;t . ' the State Treasury. ARTICLE 20. To see if the Town will vote to raise and appropriate the sum of Thirty Six Thousand Dollars ($36,000.00) to be used in con- junction with Chapter 90, money previously appropriated for constructiorr: worn on Freeman' s key, work to be done by Town Forces. ARTICLE 21 . To see if the Town w31i vote to amend the Building Code By-Lai: as follows: 1 . ?,jailing Code for Plywood sheathing used on sub-floors, exterior walls roof to be nailed., not over 8" O.G. 2. Flashing Code: Metal flashing of zinc or copper shall be used where masonry steps loin the building and also in basement, where wood partitions are used shall be flashed before con- crete floor is poured. 3. Sec. 9, Par. 21 : Add after "exterior grades "when rafters are spaced 24" C.C., In play wed shall be applied on all hori- zontal joints between rafters, when i" sheathing is used." 4. Sec. 9, Par. 7: Add, "and flue lining shall extend 18" below thimble for smoke pipe with clean-out door at bottom of chimney foundation." ARTICLE 22. To see if the Town nil! vote to raise and approp- riate and add to the street lighting budget the sum of Two hundred Sixty Four 7olO rs ($261+.00) to install and maintain street lights as follows: Pore number (3) on Breakwater Road, pole number (143/13) on Jonathan's Qy and Aunt Dolls Midge Road, pole number (11 ) on Foster Road, pole numbers (16) and (118/1$) and (.118/20) on Freeman's Xiy, pole number (128/19) on Alden ;rive, pole number (9/25) on Robbins Hill Road, pole Furber (36/575) on Lower Road and pole numbers (275/2) and (275/3) at .the Tonn Hall driveway. ARTICLE 23. To see if the Town will vote to amend the Zoning By"Law as follows: Re-zone a part of the RR district to an RZ district, said RR district located adjacent to Sheep Pond and Long Pond, said part of the RE district described as follows: All of the RE area south of Sheep Pond to the Harwich-Brewster Line, all as shown on a map entitled °'Proposed Zoning Map, Brewster, Mass.,Nhtcalf & Eddy, Inc., Dated e,Eanualy 1 , 1972" and now on file with he Town Clark. ARTICLE 24. To see if the Torr_ ,nil! vote to amend the Zoning By-Law as follows: Re-zone all of the 1 industrial area to RR resi- dential, said distrint located north of Freeman's Way and south of the laid Cape Highway, all as shorn on a map entitled "Proposed Zoning Map, Brewster, Mass., 15tcal & Ealy, Inc., dated January 1 , 19721, and now on file W1th the Town Clerk. ARTIGLE 25. To see if the gown will vote to amend the Zoning By Law as f ol.lowz: Re -zone a portion of the CS district to an R7 district; ct, said district located on Route 6A adjacent to the Brewster=Orieans Line, said portion of CS district described as follows: Beginning at the center line of the Cape & Vineyard easement and extending northerly to a line 300 feet from the center line of Route U and parallel to it, 02 as shoran on a map entitled. "Proposed Zonong Yap, 3rew5ter, Mass., Metcalf & Eddy, Inc., dated January 1 , 1972" and now on file wd .h the Town Clerk. ARTICLE 26. To see if she Town uill vote to amend the Zoning EywLaw as follows: Section X11 , Table 2 Area Regulations under ?,R dis- trict, delete the following: 00,000 sq. ft. plus 20,000 for every unit more than 1 " and add "40,000 sq. ft. plus 20,000 for the second dwelling unit of a duplex'; under 1 district delete the folloO ng: "25,000 sq. ft. plus 13,000. for. every unlit more than 1u and add 25,000 sq. ft. plus 15,000 for the second dwelling unit of a duplex"; :tender RM delete thefollowi.ng: "15,000 sq. ft.plus 10,000 for every unit more than I" and add '15,000 sq. ft. pias 10,000 for the second duelling unit of a duplex"; and under CH district delete the following: `Multi-- family dwellings 10,000 sq. ft. per unit" and add "Kitifamily dwellings 10,000 sq. ft. per building unit". To see if the Town will vote to amend the Zoning By"Law as follows: Section v1 , Paragraph 7 delete the following: "it shall be not less than, Tfeet for RR, 40 feet for Q and 20 feet for Rh from any street lot line except on a corner lot if used for garage purposes, then the same distance as the required depth of the front yard for the adjacent lotsPO and also delete the following: "it shall not be less than 10 feet from any lot line" and add words so that the com- plete paragraph reads as follows: "In any R district any permitted acc- essory building shall conform to the following provisions: it shall not occupy more than 40 percent of the required rear yard: it shall be not less than 40 feet for RR and RL and 30 feet for RK from any street lot line: and except for a temporary stand for retail sale of agricult- ural or farm products where the accessory structure may be within 6 feet of the front lot line, it small not be less than 25 fee;, in any RR or RL district or 20 feet in the RM district from any lot line: it shall not exceed 25 feet in height and, if a private swing pool, it shall be completely enclosed by a fence 5 feet in height having a self closing gate with a latch.'' u s ARTICLE 28. To see if the Tow_ will vote to amend the Zoning By-Law as follows: Section V, Table 1 , Use Regulations, Residential, Paragraph 2, delete the following words: "One family dwelling for personnel required for the safe operation of a permitted use to reside on the premises, thereof" and add the following words: "One family dwelling unto for the owner or personnel for the protection of property or safe operation of the permitted use, provided that the dwelling unit is attached to the structure housing the permitted use and that it meets other pertinent requirements of this bar-law" and said use to be permitted in the Cr and CS districts. ARTICLE 29. To see if the Town will vote to raise and approp- riate the sum of Three Hundred Fifty Dollars ($350.00) for appraisal fees in connectio n wi th the enlargement of the present town dump site. .ARTICLE 30. - To see if the Town will vote to raise and approp- riate the num of Seventeen hundred Dollars ($1700.00) for surveying fees in connection with the enlargement of the present town dump site. ARTICLE 31 . To see if the Town will vote to raise and approp- riate the sum of One Hundred Fifty Dollars ($050.00) for an engineering plan of Sea Street, said plat_ to be submitted to the Department of Natural Resources. A321CLE 32. To see if the Tower, will vote to raise and approp- riate the sum of Five Hundr6d Dollars ($500.00) to be used in connect- ion with she Orleans Mead Start Program. (By Request) ARTICLE 33. To see if the Tower; will vote to authorize the transfer of ding's Island and that part of the salt marshes as shown_ on "Plan of Wing's Island and Adjacent PArsh in Brewster, April 1961 , Nickerson and Berger," now held for recreation_, to the authority of the Conservation Commission. Under this transfer, the Conservation Commission shall maintain the present access and the limited recreat- ional facilities, such as hiking; and bathing on 'sling's Island. A ?TICLE 34. To see if the To-�. will vote to instruct the Assessors to act under Chapter 40, Section 4 of the General. Laws, and to enter into a contract for a professional equalization of land and buildings in the Town of Brewster and raise and appropriate the sum _ of Thirteen Thousand Dollars ($13,000.00). ARTICLE 35. To see if the Town will vote to authorize the Selectmen to layout Vesper Pond Drive, Bay View Drive, Mayflower Circle, Cranberry Lane and Deer Path Circle, providing that a!7 requirements of the Town by-law governing acceptance of private roads by the Town are not. (By request) ARTICLE 36 To see if the Town will vote to authorize the Selectmen to layout Beach Plum. Lane, providing that all requirements of the Town by--law governing acceptance of private roads by the Town are met. (3y request) ARTICLE 37. To see if the Town will vote to authorize the Selectmen to layout Governor Bradford Road, providing that all require- ments of the Ton ay-law governing acceptance of private roads by the Town are met. (By request.) ARTICLE 38. To see if the Town will vote to raise and approp- riate or transfer from available funds the sum of Seven Hundred Fifty Dollars ($750.00)to purchase three bins to be placed at the Town Duro for recycling glass. (By request) ARTICLE 39. To seg: if the Town will vote to instruct the Select- men to amend the regulations pertaining to the dumping of brush at the Town Dump to allow only 3/4 ton truck loads and trailers not larger.than 4 x 6 feet to dispose of unshredded brush, trees, and stumps. Violations to be punished by a $50.00 fine for each offense and each load to be considered a separate offense. (By request) ARTICLE 40. To see if the Town will vote to raise and appropriate a sum of money for payment of unpaid bills of prior years. !RTICLt 41 . , To see fj the Town KII vote to raise and approp- riate the sum of Twenty Thousand Four Hundred Dolla rs ($20,400.00) to cover the exterior of the Tow_; Hall with vinyl siding, to install aluminum storm windows downstairs and the replacement of gutters and downspouts. ARTICLE 42. To see if the Towyn will vote to authorize the Select- men to petition the LegislatM to permit the Towyn of Brewster to hold -- Town Meetings in the auditorium Or the gymnasium of the Nauset regional Muddle School located in the Town of Orleans. A=RTICLE 43. To see if the Town will vote to adopt the following by-lawn: No powered vehicle may be operated on or over salt marshes and salt water beaches in the Town of Brewster. This regulation stall not apply to official vehicles in any emergency situation. (By request) ARTICLE 44. To see if the Town will vote to adopt the following by-lav: No gasoline powered outboard motors over three (3) horsepower shall be permitted on Great Ponds over 20 acres. Only hand, sail or electric powered boats shall be permitted on Great Fonds under 20 acres, and Lesser Ponds. Any emergency rescue boat shall be exempted from these limitations. These regulations will not apply to ponds in Nickerson Park and ponds which are partly in Harwich. (By request) ARTICLE 45. To see if the Town will vote to establish a Committee td be :mown as "The L .Salette Study Committee," to be appointed, and. serve Nithortrewunera foncy the Moderator, and to consist of five (5) members, including one each from the Board of Selectmen, Planning Board, and Conservation Conrdssion; said committee to be authorized to study the feasibility and desirability of the Town's acquisition, either by out- right purchase, or negotiated lease, of the real estate and buildings thereon, more commonly referred to as the "LaSalette Property" off Route 6A in the Town; for possible use by the Toon as either a park or a conservation area. Said committee to Ubmit a report of its findings to the Board of Selectmen on or within four (4) months from the date of the Committee's organization, with definite recommendations as to advis- ability of such an acquisition, including projected costs and anticipated uses. (By request) ARTICLE 46. To see if the Town will vote to raise and approp- riate a sum of money to purchase and equip a new Police Cruiser and to instruct and authorize the Selectmen to trade in one of the present Cruisers towards the purchase. ARTICLE 47. To see if the Town will vote to authorize the Select- men to sell to the highest bidder under the provisions of Chapter 40, Section 15, a parcel of lard as shown on a plan entitled "Plan of Land in. Bsrewster, Mass. , made for Toun of Brewster February 1970, Nickerson & Berger, Inc.," said parcel of land having been declared by the Board of Selectmen to be no longer required for a municipal dumping area, and with the requirement that a bid acceptable to the Selectmen must be not ander a minimum amount of One Hundred Fifty Thousand Dollars ($150,000.00). ARTICLE 48. To see if the Town will vote to raise and appropriate the sum of One Thousand Dollars ($1 ,000.00) for advertising the advant- ages of the Town in accordance with the provisions of Chapter 475, Acts of 1969. ARTICLE. 49. To see if the Town will vote to raise and appropriate the sum of Four Hundred Fifty One Dollars ($451 .00) to be paid to the Cape Cod Metal 'stealth Association under the direction of the School Committee for services rendered, or to be rendered, to Citizens of the Tosm of Brewster at the Mental Health Center, under the provisions of MAssachusetts General Laws, Chapter 40, Section 5 ( ARTICLE 50 . To see if the Town will vote to raise and approp- riate the sum of One Thousand Dollars ( $ 1 , 000 . 00 ) to be used for the propagation of shellfish , said money to be spent under the direction of the Shellfish Constable and the Board of Selectmen . ARTICLE 51 . To see if the Town Vil..1 vote to raise and approp— riate , by borrowing , or otherwise , a sum of money for the purpose of laying a water ria.in or making a water extension , not less than 6 inches but less than 16 inches in diameter located on A . Percie Newcomb Road between Stoney Brook Road and Setucket Road , a distance of approximately 2500 feet , and to provide that betterments shall be assessed in connection with such extension . ARTICLE 52 . To see if the Town will vote to trarsfer a sum of money from the Water Construction Revenue Account to the Water Construction E>T ense Account . ARTICLE 53 . To see if the Town will vote to raise and approp— riate the sum of Eighty Eight Hundred Dol-ars ( $81500 . 00 ) to install a 10 inch water main with 2 fire hydrants from Main Street to the Brewster Elementary School , a distance of approximately 500 feet . ARTICLE 51+ . To see if the Town will vote to raise and approp— riate the sum of Eight Thousand Two Hundred Fifty Dollars ( $$ , 250 . 00 ) for architects plans and specifications as presently shown on a plan entitled " Preliminary Studies of . Proposed Fire and Police Station for Town of Brewster , Burnette V . Tickers , Architect " . ARTICLE` 55 . To see if the Town will vote to raise and approp— riate or transfer from available funds in the treasury , a sum of money to purchase a front # end loader , and authorize the Selectmen to trade in the present front end loader . ARTIL= 56 . To see if the Town will vete to authorize the Selectmen to contract for engineering plans and specifications of Great Fields Road , and raise and appropriate the sum of Fifty Five Hundred Dollars ( $5500 . 00 ) . ARTICLE 57 . To see what action the Town will take with regards to its Herring or Alewives Fisheries . ARTICLE 55 . To see if the Town will raise and appropriate the sum of Eleven Hundred Dollars ( $1100 . 00 ) for replacement of the water pipes and plumbing fixtures in the Town Hall. . ARTICLE 59 . To see if the Town will vote to raise and appropriate the sum of `twenty Thousand Dollars ( $20 , 000 . 00 ) to replace the boiler and for other repairs at the Brewster Elementary School , and to be expended under the direction of the School Committee . ARTICLE 60 . To see if the Town will vote to appropriate a sum of money from Free Cash in the treasury for the reduction of taxes . ARTICLE 61 . To see if the Town will vote to raise and appropriate Four Hundred Five Dollars ( $405 . 00 ) ts - the Cape Cod Mental Health Asso c . for services rendered or to be rendered to citizens of the Town by the Mental Health Center at Pocasset under the direction of the Board of Health in accordance with the provisions of Chapter 40 , Section 5 ( .40c ) of the General Laws .
