Bassett, Constable of the Town of Brewster Greetings: In the name of the Connorwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Brewster qualified tc vote in Town affairs to woet At Nauset Regional Ydddle School Gymnasium at 7:00 P. M. on Monday, March 5, 1973 then and there to act on the following articles: ARTICLE 1 . To act on the annual report of the Selectmen and other Town Officers. .ARTICLE 2. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow in antici- pation of the revenue for the eighteen month period beginning January 13 1973 in accordance with General Laws, Chapter 44, Section 4, and acts in amendment thereof, and including in addition therete, Chapter 819 of the Acts of 1969, as amended, and to renew any note or notes as may be given for a period of less than one year in accordance with General Laws, Chapter Cit;., Section 17. ARTICLE 3. To see if the Town will appropriate a sum of money to the Reserve Fund. ARTICLE 4. To hear the report of arYSpeciai Committee. ARTICLE 5. To see if the Town will vote to fix the salary and compensation of all elective officers of the Town as orcvided by Section 105, Chapter Cyt , General haws as amended, for the eighteen month period beginning January 1 , 1973, to be effective January 1 , 1973. ARTICLE 6. To see if the Town will vote to raise and appropriate such sums of money as may be deemed necessary to defray Town Charges and Expenses for the eighteen month period beginning January 1 , 1973, ARTICLE 7. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 81 , highways. -�LRTICLE 8. To see if the Town will vote to rais3e and anNropriate or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 90, highways. ARTICLE 9. To see if the Town. will vote to appropriate from the Road Ma.chiney General Fund, the sum of Thirty Five Hundred ($3500.00) Dollars to be used for the purchase, maintenance and operation of Road Machinery. AHTICLE 10. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter 516 and 52-4, Acts of 1950 for all damages that may be incurred by work to be performed by the Department of Public Works of 1"lassachusetts for the improvement, deve,,_opment, maintenance and protection of tidal and non- tidal rivers and streams, harbors, tide—craters, foreshores and shores along a public beach outside Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a Bond of indemnity therefor to the Commonwealth. ARTI(:�LE 11 . To see if the Town will vote to authorize and instruct the Town Treasurer to pay the Dog Tax returns from the assessments of 1972 to the Brewster Ladies' Library Association in accordance with Chapter 140, Section 72. ARTICLE 12. To see if the Town will vote to transfer from available funds in the treasury, funds received from the Common- wealth, the sum of One Thousand ($1000.00) Dollars to the Brewster Ladies' Library Association. ARTICLE 13. To see if the Town will vote to instruct the Selectmen to contract for one year for Ambulance Service with the Brewster, Orleans, Eastham Ambulance ,association, Inc., and raise and appropriate the sum of Eight Thousand Two Hundred Fifty ($8250.00) Dollars for this purpose. (By Request) ARTICLE 14. To see if the Totm will vote to rase and appropriate a sum of money under the provisions of Chapter 388, Acts. of 1954 amended by Chapter 433 of 1955, for Control of Greenhead Fly and authorize the Town Treasurer to pay said appropriation into the State Treasury. ARTTCi�E 15. To see if the Town VUl vote to raise and approp- riate the sum of One Thousand ($1000.00) Dollars for advertising the advantages of the Town in accordance with the provisions of Chapter 475, Acts of 1969. ARTICLE 16. To see if the Town will vote to raise and approp- riate a sum of money for the pay-ment of unpaid bills of prior years. ARTICLE 17. To see if the Town will vote to .raise and approp- riate a sum of money to purchase and equip two (2) new Police Cruisers and to instruct and authorize the Selectmen to trade to the present Cruisers towards the purchase. ARTICLE 18. To see if the Town will rescind the previous vote on Ar-`Licle 5 of the Special Town Meeting held on July 10, 1972 and authorize the Selectmen to acquire by purchase, eminent domain or otherwise, for sanitary landfill purposes, certain parcels of land adjacent to and east of the present Town Disposal Area all as shown on a survey plan entitled "Plan Showing Extension of Town Dump in Brewster, Mass made for Town of Brewster December 1972 Nickerson & Berger, Inc", a copy of which is on file with the Toiri-n Clerk and comprising about 65 acres, and to raise and appropriate the sum of Two hundred Five Thousand Seven Hundred Fifty ($205,750.00) Dollars for this purpose, and to determine whether any such appropriation shall be raised by taxation, by transfer from available funds, by borrowing or otherwise. ARTIC—Ir 19. To see if the To-,.m will vote a sum of money for engineering fees to establish a sanitary landfill area in the new disposal district. ARTICLE 20. To see if the Town will vote to raise and approp- riate the sum of Seven Hundred Thirty Dollars and Fifty Cents ($730.50) to be paid to the Cape Cod Mental Health Association under the direction of the School Committee for services rendered, or to be rendered, to students of the Town. of Brewster at the d=ental Health Center at Focasset ander the provisions of Massachusetts General. Laws, Chapter 40, Section 5 (40c). (By Request) ARTICLE 21 . To see if the Town will vote to raise and approp- riate the sum of Nine Hundred Forty Nine Dollars and Ninety Five Cents ($949.95) to the Cape Cod Mental Health Association for services rendered, or to be rendered, to citizens of the Town by the Mental Health Center at Pocasset, under the direction of the Board of Health, in accordance with the provisions of Massachusetts -General laws, Chapter 40, Section 5 (40c). (By request) ARTICLE 22. To see if the Town will vote to raise and aburou- riate a sum of money for the purpose of purchasing a dump truck for Y the highway department and trade in present one towards purchase price. E3 ARTICLE 23. To see if the Town will vote to adopt Chapter 41 , Section 111 , H relative to police pay at elections. ARTICLE 24. To see if the Town will vote to raise and approp- riate a sum of money for the purpose of installing street lights at the intersection of Route 39 and Freeman's eay. ARTICLE 25. To see if the Town will vote to raise and approp- riate and add to the street lighting budget a sum of money to install and maintain street lights as follows: - pole number 39, pole number 19/41 , pole numoer 44 and pole number 19/48 on Great Fields Road. (By Request) ARTICLE 26. To see if the Town will vote to transfer Seventy Five Hundred ($7500.00) Dollars from the Repair of the Exterior of the Town Hall Expense Account to construct two offices upstairs, within the Town Hall. ARTICLE 27. To see if the Tone will vote to raise and approp- riate a sum of honey to purchase office equipment for the Town Hall. ARTICLE 28. To see if the Town will vote to raise and approp- riate a sum of money to purchase carpeting for the offices in the Town Hall. ARTICLE 29. To see if the Town will vote to request the Board of Registrars, with the approval of the Board of Selectmen, to have the assistance of the Police Department in visiting buildings and resi- dences, and perform the duties of Assistant Registrars in securing information required under Section 4 through 14 inclusive of Chanter 51 of the General Laws. ARTICLE 30. To see if the Town will authorize the Board of Selectmen to establish a committee to look into the question of beach stickers for Town Beaches and Town landings, and report to the next Special Town Meeting or to the Board of Selectmen by October 1 , 1973. (By Request) ARTICLE 31 . To see if the Town will raise and appropriate or take from available funds a sum of money not to exceed the sum of Five Hundred ($500.00) Dollars for the Head Start Program. (By Request) ARTICLE 32. To see if the Town will vote to amend Section VI, Table 2 of the Zoning By-Law of February 11-12, 1972 (amended March 1972) as follows: District R-L, delete 1125,000" and substitute "-40,000" so that it will read 1140,000 plus 15,000 for the second dwelling unit of a duplex". (By Request) AiUICLEE 33. To see if the Town will vote to amend Section VI, Table 2 of the Zoning By-Law of February 11-12, 1972 (amended ?March 1972) as follows: District R-K, delete "15,000" and substitute T125,000" so that it will read 1125,00011 plus 10,000 for the second dwelling unit of a duplexa. (By Request) ARTICLE 34. To see if the Town will vote to raise and appropriate, or take from available funds, the sum of $1500.00 as provided in Massa- chusetts General Laws, Chapter 40, Section 5, Clause 39, to help defray expenses in providing facilities for training, rehabilitation and employment of mentally retarded and handicapped residents of the Town of Brewster employed at Nauset Workshop Inc., Orleans, Mass, or to do anything in relation thereto. (By Request) ARTICLE 35. Shall the Town request the Planning Board to prepare a By-Law that -wd.1 permit and encourage 11Open Space Village" subdivisions? (By Request) ARTICLE 36. Shall the Selectmen of the Town be x equested to notify the Barnstable County Commissioners that they approve the county taking the required action to establish a "Water Quality and quantity Management Program," providing that the County Commissioners may appropriate not more than $" 00,0('0.00 for this purpose? (Ry Request) ARTICLE 37. Shall the Selectmen of the Town be requested to notify the County Commissioners that they approve the establishment of a Cape Cod Jobs Development Financing Authority, providing that the County Commissioners may appropriate not more than $150,000.00 annually for these purposes? (By Request) ARTICLE 38. To see if the Town will authorize the Selectmen to sell two old copying machines, ARTICLE 39. To see if the Town will vote to transfer from available funds a sum of money to pay the salary of the Chief of Police in accordance with Chapter 1082 of the Acts of 1971 of the General Caurt, which requires an increase from May 2, 1972, and thereafter at a rate one and one-half times the annual rate of compen- sation of the highest paid permanent full-time patrolman, or take any other action relative thereto. ARTICLE 40. To see if the Town will vote to appoint a committee of seven, composed of four members to be appointed by the Moderator, and three members selected by the School Coir ttee, to obtain pre- liminary plans and specifications and to select a site, if necessary, to provide sufficient sn_ace for the Bretster Elementary School, and raise and appropriate a sum of money for the expenses of this committee, or take any action relative thereto. (by Request) ARTICLE 41 . To see of the Town will vote to raise and approp- riate the sum of Five Hundred ($500.00) Dollars to be used for the propagation of shellfish, said money to be spent under the direction of the Shellfish Constable and the Board of Selectmen. ARTICLE 42. To see what action the Town will t ake with regards - to its Herring or Alewives Fisheries. ARTICLE 43. To see if the Town will vote to raise and approp- riate as payment due, a sum of money for the year 1972, under the provisions of Chapter 32, Section 59A of the General Laws and authorize the Town Treasurer to pay said appropriation to the Town of Arlington, Mass, said chapter referring to the non-contributory pension, payments made to Veterans. ARTICLE. 44. To see if the Town will vote to raise and approp- riate as payment due, a sum of money for the year 1972, under the provisions of Chapter 32, Section_ 59A of the General Laws and authorize the Town Treasurer to pay said appropriation to the Ce=onwealth of Kassachusetts, said chapter referring to the non- contributory pension payments made to Veterans. ARTICLE 45. To see if the Town will vote to abandon, that portion of Sea Street, West Brewster, which runs from Route 6A North to the Dennis-Brewster line at Quivet Creek. This action shall become effective upon passage of a similar article by the Dennis Town Meeting. (By Request.) ARTICLF 46. To see if the Town will vote to raise and approp- riate the sum of Thirteen Hundred ($1300.00) Dollars to remove not more than 150 feet of Sea Street from the Dennis--Brewster line towards Route 6A, and to erect a substantial barrier at the point where the pavement would end. This money is only to be made available if the abandonment of Sea Street is voted by both the Town of Brewster and Dennis. (By Request) ARTICLL 47. To see if the Town will vote to raise and appropriate the sum of Seven Hundred 0700.00; Dollars for engineering services to prepare plans acceptable to the Land w Court shoing the division of the two land- courted parcels included in the West Brewster marshes taken by Town vote in December 1969. (By Request) ARTICLE 48. To see if the Town will vote to raise and appropriate the sum of Four Hundred ($400.00) Dollars to be added to the present Conservation Fund. ARTICLE 49. To see if the Town will vote to raise and appropriate the sum of One Hundred ($100.00) Dollars for expenses to investigate the possible acquisition of all or part of the Penn Central Railroad right of way in Brewster. (By Request) ARTICLE 50. To see if the Town will vote to raise and appropriate the sum of Eleven Thousand ($11 ,000.00) Dollars to be used in conjunction with a grant of $5,000.00 from the Nickerson Trust Fund to construct a pair of public tennis courts complete with fencing and lines. (By Request) ARTICLE 51 . To see if the Tovm will vote to raise and appropriate a sum of money for stone masonry work to be constructed at the herring run at the Brewster Mill. kRTICLE 52. To see if the To',an will vote to raise and appropriate a sum of money to repair drainage on Millstone Road. ARTICLE 53. To see if the Tozer will vote to raise and appropriate a sum of money to purchase and equip a new fire engine. kRTICi.E 54. To see if the Town will vote to accept the provisions of Chapter 40, Sections 420, 42H, 421 which allow the levy of special assessments to meet in whole or part the cost of extending water mains. ARTICLE 55. To see if the Town will vote to accept the following by-law: To implement the year round dog restraining order, all dogs found at large shall be picked up by the dog officer and brought to the dog pound. None shall be released to owners unless a fine of Five ($5.00) Dollars is paid to the Town of Brewster and unlicensed dogs shall be licensed before release from the dog pound. ARTICLE. 56. To see if the Town will vote to raise and approp- riate the sum of Tvn Thousand ($2,000.00) Dollars to be used as Brewster's share for a survey on the need for a medical facility on the Lower Cape. Said money to be expended under the direction of a committee representing the Lover Cape Towns. (By Request) ARTICLE 57. To see if the Town will vote to raise and approp- riate by borrowing or otherwise a sum of money for extending water rains not less than six inches but less than sixteen inches in diameter for 6600 feet more or Ness on Matheson Road, Marion Lane, Woodward Road, Sheep Pond Circle and Woodland Road. (By Petition) ARTICLE 58. To see if the Town will vote to raise and approp- riate by borrowing or otherwise a sum of money for extending water mains not less than six inches but less than sixteen inches in diameter for 300 feet more or less on a private road off Ellis Landing Rcad. (By Petition) ARTICLE 59. To see if the Town will vote to raise and appropriate by borrowing or otherwise a sum of money for extending water mains not less than six inches but less than sixteen inches in diameter for 570 feet more or less on Flying Mdst Lane. (Fly Petition) ARTICLE 60. To see if the Town will vote to raise and approp- riate by borrowing or otherwise a sum of money for extending water mains not less than six inches but less than sixteen inches in diameter for 5700 feet more or less on Lond Pond Road, Old gong Pond Road, HcGuerty Road and Nutley Road. (By Petition) ARTICLE 61 . To see if the Town will vote to raise and approp- riate the sum of rifty Eight Thousand (458,000), Dollars to be used in conjunction with Chapter 90, money previously appropriated for construction work on ioute 39, work to be done partly by Town forces and partly by contract. i ARTICLE 62. To act on any other business that may legally come before this meeting. And you are directed to serve this Warrant with your doings thereon to the Town Clerk at the time and place of said meeting as aforesaid.
