The meeting was called to order by the �:oderator, Grant 'u1. Koch with tellers, Paul C. Sylver, Gladys Curtis, Dorothy Grenier and registrars, Dorothea Dugan and jean Cage. invocation was offered by Father George Morin and Pledge of Allegiance was led by Melody Sears, Girl Scout. There was a quorum declared present. A Preamble and Resolution in memory of Donald P. Consodine was read by tin. ..alter Babbitt and has been wade a part of these minutes. The warrant was read by the Town Clerk, Ruth N. eddy, with the exception of the Articles which were read as they were being con- sidered. ARTIC I I 1 . To act on the annual report of the Selectmen and other Toi Officers. + Voted unanimously that the annual report of the Selectmen and other To-vyn Officers be accepted. ARTICLE 2. To see if the Town will' vote to authorize the Treasurer, w;th the approval of the Selectmen, to borrow in antici- pation of the revenue for the eighteen month period beginning January 1 , 1973 in accordance with Genera,_ Laws, Chapter 44, Section 4, and acts in amendment thereof, and including in addition thereto, Chapter 849 of the acts of 1969, as amended, and to renew any note or notes as may be given, for a period of less than one year in accordance with General Laws, Chapter 44, Section 17. Voted by voice that the Town authorize the Treasurer, with the approval of the Selectmen, to borrow in anticipation of the revenue for the eighteen month period beginning January 1 , 1973 in accordance with General laws, Chapter 44, Section 4, and acts in amendment thereof, and including in addition thereto, Chapter 849 of the Acts of 1969, as amended, and to renew any note or notes as may be given for a period of -- less than one year in accordance w-ith General Laws, Chapter 44, Section 17. To see if the Town will vote to fix the salary and compensation of all elective officers of the Town as provided by Section 108, Chapter 41 , General Laws as amended, for the eighteen month period beginning January 1 , 1973, to be effective January 1 , 1973. To see if the Town will vote to raise and approp- riate or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 81 , highways. Voted unanimously that the Town raise and appropriate the sum of Five Thousand One Hundred Ninety Nine Dollars ($5,199.CC) and transfer from free cash in the treasury the sum of Ten Thousand Three Hundred Ninety Eight Dollars ($10,398.00) to meet the cost of the State's share of Chapter 81 , highway work. ARTICLE 8. To see if the Tower: will vote to raise and approp- riate or transfer from unappropriated available funds in the treasury, a sum of *.coney for Chapter 90, highways. Voted unanimously by voice that the Town raise and appropriate the sum of Six Thousand Dollars ($6,000.00) and transfer from free cash in the treasury the sum of Eighteen Thousand Dollars ($18,000.00; to meet the cost of the Staters and County's share of Chapter 90, highway construction. ARTICLE 9. To see if the Town will vote to appropriate from. the Road Machinery General Fund, the sum of Thirty Five Hundred ($3,500.00) Dollars to be used for the purchase, maintenance and operation of Road Ya.chinery. Voted unanimously thst the Towyn transfer from the Road bachinery General Fund, the sum of Thirty Five Hundred Dollars ($3,500.00) to be used for the purchase, maintenance and operation of road rachinery. ARTICLE 10. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General saws, as amended by Chapter 516 and 524, Acts of 1950. f or all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and pro- Lection of tidal and non-tidal rivers and streams, harbors, tide-waters, foreshores and shores along a public beach outside Boston Harbor, including the herrimack and Connecticut. Rivers, in accordance with Section 11 of Chapter 91 of the General Taws, and authorize the Selectmen to execute and deliver a Blond of Indemnity therefor to the Commonwealth. Voted unanimously that the Town assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter 516 and 524, pacts of 1950 for all daEages that may be in- curred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and pro- tection of tidal and non-tidal rivers and streams, harbors, tide-waters, foreshores and shores along a public beach outside Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a Bond of indemnity therefor to the Commonwealth. ARTICLE. 11 .To see if the Tower, wiII vote to authorize and instruct the Town Treasurer to pay the Dog Tax returns from the assessments of 1972 to the Brewster Ladies' Library Association_ in accordance with Chapter 110, Section 72. Voted u_waimously that the Town authorize and instruct the Town Treasurer to pay the Dog Tax returns from the assessments of 1972, the sum of One Thousand Two Hundred Two Dollars and Forty Six Cents (1 ,202.46) to the Brewster Ladies' Library Association in accordance with Chapter 140, Section 72. ARTICLE 12. To see if the Town will vote to transfer from available funds in the treasury, funds received from the Common- wealth, the sum of One Thousand ($1 ,000.00) Dollars to the Brewster Ladies' Library Association. Voted unanimously that the Town transfer from available funds in the treasury, funds received from the Commonwealth, the sum of One Thousand 01 ,000.00) Dollars to the Brewster Ladies' Library Association. To see if the Tot^ext, will rescind the previous vote on Article 5 of the Special Town Meeting held on July 10, 1972 and - authorize the Selectmen to acquire by purchase, eminent domain or ctherv-i se, for sanitary lan1fill purposes, certain parcels of land adjacent to and east of the present Toon Disposal Airea all as shown on a survey plan entitled "Plan Showing :extension of Town Dump in Brewster, Hass. made for Town of Brewster Eecember 1972 Dickerson & Berger, Inc", a copy of which is on file with the Town Clerk ant conprising about 65 acres, and to raise and approp- riate the sum of Two Hundred Five Thousand Seven Hundred Fifty (4205,750.00) Dollars for this purpose, and to determine whether any such appropriation shall be raised bT7 taxation, by transfer from available funds, by borrowing or otherwise. This article was defeated by a ballot vote of 172 - Yes - 128 No. 2/3 vote required. AETIOLL 19. To see if the Town will vote a sum of money for engineering fees to establish a sanitary la.ndiill area in the new disposal district. Voted unanimously that this article be indefinitely postponed. ARTICLE 20. To see if the Town will vote to raise and approp- riate the sum of Seven Hundred Thirty Dollars and Fifty Cents ($730.50) to be paid to the Cape Cod Mental Health Association under the direction of the School Committee for services rendered., or to be rendered, to students of the Town of Brewster at the Mental Health Center at Pocasset under the provisions of Massachusetts - - General Laws, Chapter 40, Section 5 (40c). Noted unanimously that the Town raise and appropriate the sum of Seven Thousand Four Hundred Thirty right Dollars ($7438.00)' for the purpose of purchasing a dump truck for the highway department and trade in the present one towards the purchase price. 155 ARTICLI. 23. To see if the Town will vote to adopt Chapter 41 , Section 311 , H relative to police pay at elections. Voted unanimously that the Town adopt Chapter 41 , Section 111 , H Helative to police pay at elections. ARTICLE 24. To see if the Town will vote to raise and approp- riate a sum of money, for the purpose of installing street lints at the intersection of Route 39 and Freeman's 'viay. Voted by voice that the Town install a street light at the intersection of Route 39 and Freeman's Way. ARTICLE 25. To see if the Town will vote to raise and approp- riate and add to the street lighting budget a sum of money to install and maintain street lights as follows: - pole number 39, pore number 19/11 , pole number 44 and pole number 19/48 on Great Fields Road. (By Request) Voted by 'rand - Yes 201 - 65 - No that the Town install and maintain street lights as follows: pole number 39, pole number 19/41 , pole number 44 and pole number 19/18 on Great Fields Road. ARTICLE 26. To see if the Town will vote to transfer Seventy Five Hundred ($7500.00) Dollars from the Repair of the Exterior of the Town Mall Expense Account to construct two offices upstairs, within the Town Hall. ARTICLE 27. To see if the Town will vote to raise and approp- riate a sum of money to purchase office equipment for the Town Bali.. Voted :unanimously that the Town raise and aprropriate the sum of One Thousand Three Hundred Fifty One Dollars and Twenty Four Cents 01 ,351 .24) to purchase office equipment for the Town Hall. ARTICLE. 28. To see if the Town will vote to raise and approp- riate a sum of money to purchase carpeting for the offices in the Town Hall. Voted by voice that the Town raise and appropriate the sum of One Thousand Two Hundred Sixty Four Dollars and Twenty vents ($1264.20) to purchase carpeting for the offices in the Town Hall. kRTI.CLE 29. To see if the Tour. will vote to request the Board of Registrars, with the approval of the Board of Selectmen, to have the assistance of the Police Department in visiting buildings and resi- dences, and perform the duties of Assistant .Registrars in securing infcrraation required under Section k through, 14 inclusive of Chapter 51 of the General Laws. To see if the Tows will authorize the Board. of Selectmen to establish a committee to look into the question_ of beach stickers for Town Beaches and own Landings, and report to the next Special Town Meeting or to the Board of Selectmen by October 11 190. (By Petition) Voted by voice as amended that the Town authorize the Board of Selectmen to establish a committee to look into the question of beach stickers for Town Beaches and Town Landings and Refuse Disposal Areas and report to the next Special Town Meeting or to the Board of Selectmen by October 1 , 1973. AaTICLF 31 . To see if the Town will raise and appropriate or take from available funds a sura of money not to exceed the sum of rive Hundred ($500.00) Dollars for the head Start Program. (By Petition) Voted by voice that the Toi4n raise and appropriate the sum of Five Hundred Dollars {$500.00) for the Head Start Program. ARTICLE 32. To see if the Town will vote to amend Section VI, Table 2 of the Zoning By-Law of February 11--12, 1972 (amended parch 1972) as follows: Eli.strict R-L delete "25,0OO" and substitute "40,000" so that it will read "40,000 plus 15,000 for the second dwelling unit of a duplex". (By Request) Voted by hand Yes - 199 - 68 No that the town amens) Section VI, Table 2 of the Zoning By-Laws of February 11-12, 1972 (amended March 1972) as follows: District R-L, delete "25,000" and substitute "40,000" so that it will read QL,000 plus 15,000 for the second dwelling unmet of a duplex". kATIOLO 33.To see if the Town mill vote to amend Section SII, Table 2 of the Zoning By law of February 11-12, 19972 (amended parch 1972) as follows: Voted 223 - Yes - 42 - No that the Town amend Section V1, Table 2 of the Zoning By-Law of February 11-12, 1972 (amended March 1972) as follows: District R"M, delete ' 15,0001 and substitute ' 25,000" so that it will read "25,000 plus 10,000 for the second, dwelling unit of a duplex". At this time it was requested that Article 18 be reconsidered. This article again as defeated by a vote of Yes -- 91 - No - 132. It was voted at this time to take up article 53. AR ICLF 53. To see if the Town will vote to raise any approp- riate a sum of money to purchase and equip a new fire engine.m Voted by voice at the Town raise and appropriate the sum of Forty Nine Thousand 049,000.00) Dollars to purchase and equip a new fire engine; said money to be expended under the supervision of the Fire Chief and the board of Selectmen. To see if the Toren will vote to raise and approp- riate, or take from available funds, the sum of $1500.00 as provided in Na.ssachusetts General Laws, Chapter 4, Section 5, Clause 39, to help defray expenses in providing facilities for training, rehabilitation and employment of mentally retarded and handicapped residents of the Town of .Brewster employed at Nauset :-:orkshop, .Inc., Orleans, Mass, or to do anything in relation_ thereto. (By neque s t) Voted unanimously that the Town raise and appropriate the sum of Fifteen Hundred Dollars f$1500.00) as provided in Massachusetts General Lams, Chapter 40, Section 5, Clause 39, to help defray expenses in providing facilities for training, rehabilitation and employment of mentally retarded and handicapped residents of the Town of Brewster employed at Nauset horkshop, Inc, Orleans, Mass. AATICLF 35. Shall the Token request the Planning Board to prepare a By-Law that will permit and encourage "Open Space Village" sub- _ divisions? (Vy Request) This article was unanimously defeated. ARTICLE 36.
