AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING AN AMENDED
FINAL PUD PLAN FOR PROPERTY LOCATED AT 925 SOUTH COUNTRY CLUB DRIVE;
DESCRIBED AS PART OF THE SOUTHEAST QUARTER OF SECTION 8, TOWNSHIP 44
NORTH, RANGE 12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, Ed and JoAnne Storey, owners of the real estate hereinafter described, having
submitted to the City Council an Amended Final PUD Plan of said real estate, being
part of the Southeast quarter of Section 8, Township 44 North, Range 12 West,
Jefferson City, Cole County, Missouri, more particularly described as follows:
Beginning at the southwest corner of the Southeast quarter of said Section 8;
thence North 5 degrees 30 minutes west, along the quarter Section line and the
easterly line of Fairland Village Estates Subdivision Section 1, per plat of record in
Plat Book 8, page 63, Cole County Recorder's Office, 431.05 feet to a point which is
30 feet southerly from the centerline of South Country Club Drive; thence along said
road, North 56 degrees 46 minutes east, 190.37 feet; thence leaving said road,
South 14 degrees 55 minutes east, 101.26 feet; thence South 83 degrees 05
minutes east, 244 feet to the westerly right-of-way line of the old Missouri Pacific
Bagnell Branch Railroad; thence along said Railroad right-of-way, south 20 degrees
27 minutes west, 414.27 feet to the Section line; thence along the Section Line,
South 85 degrees 44 minutes west, 242 feet to the beginning point of this
description, except that portion conveyed to City of Jefferson by Book 431, page 56
and Book 298, page 820. Containing 2.76 acres, more or less.

WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with, as said property owner submitted to the Planning
and Zoning Commission and City Council an Amended Final PUD Plan for the
above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Amended Final PUD Plan submitted by Ed and JoAnne Storey, on file as
Case No. P11015 in the Jefferson City Planning Division is hereby approved for the land
referenced above with the following conditions:
a. Permitted uses of the property shall be limited to the following:
i. Museum, art gallery, library
ii. Day care for adults or children
iii. Medical and dental clinics
iv. Church
v. Schools; public, private or parochial
vi. Dance, art, music schools
vii. Professional and business offices, real estate, finance, insurance, travel
consultants, interior design studios
viii. Parking lots
ix. Personal services
x. Incidental retail sales, only when associated with a permitted use.
b. Signage shall be in accordance with requirements of the C-O Office Commercial
district. for properties zoned C-O.
SECTION 2. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P11015 — 925 South Country Club Drive; Amended Final PUD Plan. Application
filed by Ed and JoAnne Storey, property owners, for an amendment to the Final PUD Plan to
modify the permitted uses for the property to allow for uses including offices, daycares, and
personal services. The property is located on the southwest corner of the intersection of South
Country Club Drive and Fairgrounds Road and is described as part of the Southeast Quarter of
Section 8, Township 44 North, Range 12 West, Jefferson City, Missouri.
Mr. Barron described the proposal and explained that the applicant is requesting approval of an
amended Final PUD Plan in order to expand the list of permitted uses allowed for the property. He
stated that no modifications to the development layout are being proposed. Mr. Barron explained
that permitted uses, as approved in the previous PUD Plan for the property, are currently limited to
offices and a daycare. He stated that the proposed modifications to the list of permitted uses would
allow for a wider variety of commercial and service oriented businesses with little impact on
surrounding properties.
Mr. Mihalevich expressed concerns with Item F pertaining to vocational-technical schools. He
stated that could mean solvents and large industrial machines being worked on which may not be
welcome in a residential area. Mr. Mihalevich suggested limiting the use to vocational-technical
schools without labs or classroom instruction only.
Mr. Ed Storey, 2916 Foxdale Drive, spoke regarding this request and explained that subject to
approval of this request he will have a better scope of tenants to choose from in order to lease this
property.

Mr. Dutoi asked Mr. Storey to address Mr. Mihalevich's concerns regarding vocational-technical
schools. He inquired whether Mr. Storey would be amenable to removing Item F or amending item F
to say Vocational-technical schools with classroom instruction only. In response, Mir. Storey agreed
to remove Item F from the list of permitted uses.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report.
Mr. Dutoi explained that he was more interested in amending Item F to limited classroom
instruction only. In response, Mr. Barron commented that item E, relating to schools, should
accommodate a classroom use.
Mr. Mihalevich moved and Mr. Stacey seconded to recommend approval of the Amended Final
PUD Plan to the City Council subject to the following conditions:
1. Permitted uses of the property shall be limited to the following:

d. Church
e. Schools; public, private or parochial

November 18, 1999—request for an off premise sign was approved for a limited time period.
May 12, 2005— Revised PUD Plan to modify the site layout was approved.

Staff Analysis
Parlcinu• The parking requirement for office uses is the same as the requirement for stand alone service
oriented businesses. The existing parking lot is sufficient to accommodate the proposed change in permitted
uses.
Permitted Uses: The proposed permitted uses for the property are service oriented and are similar to uses
lound in small oil-ice oriented developments located elsewhere in the City.
Building Design: No exterior building modifications are proposed.
Signs: Signage is proposed to conform with the current sign code for properties zoned C-O.
Staff Recommendation
Staff recommend approval of the proposed amendment to the Final PUD Plan. The proposed modifications to
the list of permitted uses would allow for a wider variety of commercial and service oriented businesses with
little impact on surrounding properties.
