HomeMy Public PortalAbout1987-029Member JG �� introduced the following resolution and moved its adoption: CITY OF MEDINAQ RESOLUTION NO. U1- 0Z RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO HAMEL AMERICAN LEGION POST #394 WHEREAS, Hamel American Legion Post #394 (Applicant) has requested a conditional use permit to construct a 12' X 40' addition to the existing building located at 75 Hamel Road, which property is legally described in Exhibit A attached hereto; and WHEREAS, construction of the addition requires a conditional use permit under the provisions of the City's zoning ordinance; and WHEREAS, this matter has been reviewed by the planning commission on March 10, 1987, and by the city council on April 7, 1987; and WHEREAS, it has been determined that the construction of the proposed addition will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The exterior trash container shall be enclosed; 2. The hours of operation shall be from 6 a.m. to 1 a.m.; 3. Signage and exterior lighting on the site shall be constructed only after approval thereof by the city staff; 4. Tenants shall be permitted to lease space in the Applicant's building upon issuance of an administrative conditional use permit by the zoning administrator. Prior to issuance thereof, the zoning administrator shall review the application for compliance with the city's zoning ordinance, including the adequacy of parking and the compatibility of uses; and member 5. The Applicant shall pay to the city a fee in an amount determined by the staff to represent the actual cost to the city of reviewing this condi- tional use permit application. BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that a sideyard setback variance be granted from the Medina zoning ordinance to allow reduction of the setback to 26.3 on the grounds that the proposed addition would be aligned with the existing building.
