U 7-.3 f RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO MINNESOTA EXTERIORS, INC. WHEREAS, Martin Bennis, d/b/a Minnesota Exteriors, Inc. (Applicant) has applied for a conditional use permit to construct an 80' X 150' addition to the existing building located at 295 T.H. 55; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on January 13, 1987, and by the City Council on March 17 and April 7, 1987; and WHEREAS, it has been determined that the constriction of the proposed addition will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The landscaping plan shall be satisfactory to the zoning administrator; 2. The hours of operation shall be 7 a.m. to 7 p.m., 6 days per week; 3. Parking shall be installed in accordance with the City's performance standards; 4. Exterior lighting shall be reviewed and approved by the zoning admini- strator; 5. Site drainage plans shall be reviewed and approved by the city staff; 6. The Applicant shall obtain approval from the Elm Creek Watershed District for the project; 7. There shall be no exterior storage on the site; 8. The trash container shall be stored indoors; 9. There shall be no rooftop mechanical equipment; 10. The gas barrels and fuel tanks shall be treated as required by ordinance and city staff; 11. Any signs constructed on the site shall be as shown on the approved plans; 12. The Applicant shall be responsible for any additional sewer availability charges determined to be due by staff; and 13. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this condi- tional use permit application. BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that a variance be granted to reduce the rear yard setback of the proposed addition to 22 feet on the grounds that such a setback would allow alignment of the addition with the existing building.
