CITY OF MEDINA
RESOLUTION NO. J -
RESOLUTION GRANTING A
VARIANCE TO JACK AND JOAN KAIN
at 2969 LAKE SHORE AVENUE
WHEREAS, Jack and Joan Kain (Applicants) have requested a variance to
reduce the setback for a 10' X 14' addition to their house from Lake Indepen-
dence to 45 feet at their property located at 2969 Lakeshore Avenue; and
WHEREAS, the zoning ordinance of the City requires that such structures
be located no closer to the shore than 75 feet; and
WHEREAS, Section 825.45 of the zoning ordinance and Minn. Stat., Section
462.357 require that variances from the strict interpretation of the zoning
ordinance be granted only when there is a demonstrated hardship due to circum-
stances unique to the property; and
WHEREAS, the planning commission reviewed the Applicants' request on
April 14, 1987, and recommended approval thereof.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina
that the Applicants' request for a variance is approved on the grounds that
the setback is a result of the location of the existing house, will encroach
only 2 feet closer to the shore than the existing house and is consistent with
neighborhood standards, subject to the following:
1. The addition shall be no larger than 10' X 14' and shall be constructed
in the location shown on the attached survey;
2. The addition shall be sided with material compatible with that currently
used for the house;
3. The entrance shall be no larger than 4' X 4'; and
4. No steps, sidewalks or additional enclosures shall be constructed.
