RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
THE METROPOLITAN WASTE CONTROL COMMISSION
WHEREAS, The Metropolitan Waste Control Commission (Applicant) has
requested a conditional use permit to construct a 12' X 20' structure to house
a generator at its Hamel lift station; and
WHEREAS, construction of the generator building requires a conditional
use permit under the provisions of the City's zoning ordinance; and
WHEREAS, this matter has been reviewed by the planning commission on
April 14, 1987, and by the city council on May 5, 1987; and
WHEREAS, it has been determined that the construction of the proposed
generator building will not impede the orderly development of adjacent proper-
ties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicant for the
stated purpose, subject to the following terms and conditions:
1. Non emergency use of the generator shall be limited to no more than
5 hours per week and such use shall take place between the hours of
8:00 a.m, and 5:00 p.m., Monday through Friday;
2. There shall be no additional exterior lighting;
3. There shall be no exterior storage;
4. The Applicant shall seed the property to the north and west of the
generator building;
5. The Applicant shall install landscaping to the satisfaction of the
zoning administrator;
6. The Applicant shall maintain the culvert on the property to ensure
adequate storm water flow to Elm Creek;
7. The generator building shall be constructed of materials in compli-
ance with the City's performance standards;
8. The Applicant shall maintain the security fence on the property;
9. The operation of the generator shall be in compliance with the noise
standards of the Minnesota pollution control agency;
10. There shall be no storage of Applicant's vehicles on the site; and
11. The Applicant shall pay to the city a fee in an amount determined by
the staff to represent the actual cost to the City of reviewing this
conditional use permit application.
