HomeMy Public PortalAbout1987-043Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. $ 7- RESOLUTION GRANTING A VARIANCE FOR JAMES AND TRACY OTIS WHEREAS, James and Tracy Otis (Applicants) have requested a variance to construct a 12' X 12' deck 18 feet from the rear lot line at their house at 500 Ridge View Circle, which property is legally described as Lot 4, Block 2, Lutz Elm Creek, Hennepin County, Minnesota; and WHEREAS, the Applicants' lot is located on a corner and the rear yard is determined to be the one opposite the front of the house; and WHEREAS, Section 826.35 of the City's zoning ordinance requires that structures in the urban residential district maintain a minimum rear yard setback of 30 feet; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request and recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance to reduce the required rear yard setback from 30 feet to 18 feet to construct a deck is granted because a hardship is created due to the fact that the lot is double -fronted. The variance hereby granted is subject to the following conditions: 1. The only structure which may be constructed pursuant to this variance is a 12' X 12' deck similar to the one presented to the planning commission and City Council; and 2. The variance shall be valid for a period of one year from the date of the adoption of this resolution. Failure to construct the deck or to seek an extension of time for the variance within said period will render the variance hereby granted null and void.
