WHEREAS, the Miami-Dade County of Board of County Commissioners ("County") approved resolution number R-224-09, Agenda Item No 11(A)(3),sponsored by Commissioner Barbara Jordan, authorizing conveyance of one (1) parcel of vacant land to the City of Opa-locka for the expansion of a Park and Recreational area in the Magnolia Northside Neighborhood "(Magnolia); and WHEREAS, the said vacant land is located at 1801 Ali-Baba Avenue, Opa-locka, Florida ("Property"), and is also described as Folio Number 08-2122- 003-1690, also known as MAGNOLIA SUB PB 40-80- LOTS 23 & 24, BLK 10, adjacent to the park known as James Street Tot Lot; and WHEREAS,the County executed a deed for said property for the purpose of a park and recreational facility; and WHEREAS, the City Commission of the City of Opa-locka authorizes the City Manager to accept conveyance of the above-described parcel from the County and payment of conveyance fees of Ten Dollars ($10.00) and Clerk of Court recording fees in the amount of Forty-Two Dollars ($42.00). NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. The City Commission of the City of Opa-locka, Florida, hereby authorizes the City Manager to accept conveyance of one (1) parcel of land from the County for Magnolia Northside Neighborhood, property located at 1801 Ali-Baba Avenue, Folio Number 08-2122-003-1690, also known as MAGNOLIA SUB PB 40-80- LOTS 23 & 24, BLK 10, and payment of conveyance fees of Ten Dollars ($10.00) and Clerk of the Court recording fees in the amount of Forty-Two Dollars ($42.00). Financial Impact: Miami-Dade County Board of Commissioners Conveyance Fees, $10.00 and Clerk of Courts recording fees, $42.00. Finance Impact fees paid from account #19-519493 totaling $52.00. As a result of this parcel conveyance the City will receive land assessment valued at approximately$23,635.00. Implementation Time Line: Immediate Legislative History: None Recommendation(s): Staff Recommends Approval 1 Analysis: Accepting this parcel of land adjacent to the James Tot Lot will extend property for a safe playground for utilization by children in the immediate and surrounding area; and youth in the County. In addition to upgrading the park, this restoration will enhance the surrounding area. The party of the second part agrees that it will make every good faith effort to develop, operate and maintain the Park in a manner that provides appropriate active and passive recreational opportunities to park users consistent with normal and customary park and recreation policies. Upon failure of the party of the second part to abide by any of the restrictions listed in(a) through(c)above,the County shall provide the party of the second part with written notice of the alleged violations including the statement, "The County will exercise its reversionary interest in the property if the violation is not cured." Within 45 days of receipt of the notice, the party of the second part shall cure the violation. If the violation is of a type that cannot be cured within this time period, the party of the second part shall notify the County in writing specifying the reason and the additional time required to cure the violation. However,in no event shall the time to cure exceed 90 days, unless such time period is extended by action of the County Commission. Failure of the party of the second part to comply with all of the terms of the paragraph, after thirty days written notice, shall cause the title to automatically revert to Miami- Dade County.
