O 7-4-1 RESOLUTION DENYING A VARIANCE FOR DOUGLAS AND MARY KNUDSON WHEREAS, Douglas and Mary Knudson (Applicants) have requested a variance to exceed the maximum allowable height of a single family residential structure located at 1450 Willow Drive; and WHEREAS, Section 826.25 of the City's zoning ordinance requires that single family residential structures be no higher than 30 feet; and WHEREAS, Applicants were aware of the height limitation of the zoning ordinance prior to construction of the house but the house has been constructed to exceed said requirement; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request but did not recommend approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance be denied because there has been no showing of a hardship unique to the property as required by the City's ordinance and state statute.
