AN ORDINANCE, appropriating Three Hundred Thousand Dollars ($300,000.00)
from the Emergency Fund to be used for emergency repair in Emergency Repair #068 (O'Fallon
Outfall Sewer Repair) (13706) in the City of St. Louis, Missouri; and authorizing the Executive
Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter
into an emergency construction contract under Contract No. 22148 with Fred M. Luth & Sons,
Inc., for the aforesaid emergency repair services.
WHEREAS, the Executive Director declared this project an emergency on
December 22, 2021; and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Thousand Dollars ($300,000.00) is
hereby appropriated from the Emergency Fund to be used for emergency repair in Emergency
Repair #068 (O'Fallon Outfall Sewer Repair) (13706) in the City of St. Louis, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an emergency
construction contract under Contract No. 22148 with Fred M. Luth & Sons, Inc. for emergency
repair in Emergency Repair #068 (O'Fallon Outfall Sewer Repair) (13706) in the City of St. Louis,
Missouri, and shall be comprised of such other terms and conditions as are approved by the Office
of the General Counsel of the District.
Section Three. Emergency Clause. This ordinance needs to be enacted without
delay, thus creating an emergency within the meaning of the Charter, due to the immediate need
to repair the sanitary sewer collapse and overflows from the sanitary system. Accordingly, this
ordinance shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted on February 10, 2022.
