RESOLUTION NO. 7 1247 RESOLUTION GRANTING A VARIANCE FOR REX HASEK WHEREAS, Rex Hasek (Applicant) has requested a variance to reduce the front yard setback on the west side from 30' to 22.6' and the front yard setback on the north side from 30' to 22' in order to construct a house at 4645 Brook Street, which property is legally described as Lot 1, Block 28, Independence Beach, Hennepin County, Minnesota; and WHEREAS, the Applicant's lot is located on a corner and therefore is subject to two front yard setback requirements; and WHEREAS, Section 826.35 of the City's zoning ordinance requires that structures in the urban residential district maintain a minimum front yard setback of 30 feet; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request but did not recommend approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that variances be granted to reduce the front yard setback from Lake Shore Avenue from 30' to 25' and to reduce the front yard setback from the north from 30' to 27.5' due to the fact that a drainage area located on the eastern portion of the lot and the irregular size and shape of the lot create hardships. The variances granted hereby are subject to the following: 1. The building to be constructed shall be substantially similar to the one shown to the planning commission and City Council. 2. The variance from the north property line shall be for a corner of the proposed structure. 3. The variance granted hereby shall be valid for a period of one year from the date of adoption of this ordinance. Failure to construct the proposed house or to request an extension of time for the variance within said period shall render the variance null and void.
