HomeMy Public PortalAbout1987-050" Member its adoption: ��rae4l introduced the following resolution and moved CITY OF MEDINAq r�� A RESOLUTION NO. 0 SV RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO ALPANA ALUMINUM PRODUCTS, INC. WHEREAS, Alpana Aluminum Products, Inc. (Applicant) was granted a condi- tional use permit for a manufacturing plant and office at its property at Co. Rd. 116 and T.H. 55 on December 22, 1983; and WHEREAS, the Applicant has applied for permission to expand its facility at said location; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on May 12, 1987, and by the City Council on June 2, 1987; and WHEREAS, it has been determined that the proposed expansion of the Applicant's facility will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that an amended conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The project shall be constructed in accordance with the plans submitted and in accordance with plans as submitted in the future and approved by the city staff or the planning commission or the City Council, as further detailed herein; 2. Except as otherwise detailed herein, or approved in the future by the City Council, the project shall conform in all respects to the ordinances and regulations of the city of Medina, the statutes of the state of Minnesota and the applicable regulations of the Elm Creek Watershed District; a J. 3. The project shall be constructed in accordance with landscaping plans submitted and approved by the city staff with a provision for adequate screening of all properties either zoned or developed for residential purposes. The plans shall include 27 additional scotch pines or such alternative landscaping as may be approved by city staff to be planted on the newly created lot line at such time as a determination is made with regard to the use of the remainder of the Applicant's property; 4. The project shall be constructed in accordance with drainage plans and topographical plans submitted and approved by the city staff, including provision for the protection of all surrounding properties from adverse effects of storm water runoff; 5. The project shall be constructed in accordance with lighting plans submitted and approved by the city staff which are consistent with city ordinances and regulations, including the prevention of light spillage onto any adjoining properties; 6. The Applicant shall submit a new parking plan to be reviewed by city staff. The plan shall provide for parking of no more than five semi trailers on the property at any one time. The trailers shall be parked as close to the north side of the building as possible and the parking area for the trailers shall be paved to a nine ton capacity. 7. The project may be operated without limitation on the hours of operation; 8. A setback shall be provided, as defined in the Medina zoning ordinance, of 75 feet from all property lines which abut property which is either zoned or used for residential purposes; 9. Outdoor storage of products or materials related to the manufacturing process shall be permitted in an area not exceeding 80 feet by 225 feet, the storage of said product not to exceed six feet in height. Questions relating to the screening of the exterior storage which arise after all technical plans have been submitted shall be submitted to and approved by the City Council; 10. The extension of the private street on the property shall be constructed to meet all current city specifications; 11. There shall be no outside loudspeakers or telephone ringing devices on the property; 12. A11 plans shall be reviewed and approved by the fire department; 13. A11 performance standards shall be met, including those relating to exterior building materials and the screening of rooftop mechanical equipment; 14. In the event that any dispute arises between the city staff and the applicant regarding the interpretation, application, suitability, or the conformance of the proposed plans with any of the conditions set forth herein, such dispute shall be brought before the City Council for resolu- tion; 2 " 15. The applicant shall reimburse the City for all engineering, legal, planning and other administrative expenses incurred by the City in connection with the processing of the application and the construction of the project.
