A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF
FRASER, COLORADO, RECOMMENDING THE REPEAL OF CHAPTERS 15,
16 AND 17, AND ARTICLE 4 OF CHAPTER 18, AND THE ADOPTION OF
CHAPTER 19 OF THE FRASER MUNICIPAL CODE, CONCERNING LAND
USE, AND RECOMMENDING APPROVAL OF A REVISED FRASER ZONING
MAP
WHEREAS, the Town of Fraser, Colorado (the "Town"), is a municipal corporation and
political subdivision of the State of Colorado for which the Planning Commission is authorized
to act; and
WHEREAS, pursuant to law, the Board of Trustees has appointed the members of the
Fraser Planning Commission; and
WHEREAS, Section 31-23-214 of the Colorado Revised Statutes authorizes and requires
the Planning Commission to adopt regulations governing the subdivision of land; and
WHEREAS, Section 31-23-301 et semc. of the Colorado Revised Statutes authorizes the
Board of Trustees to adopt regulations governing the use and development of land; and
WHEREAS, the Town has caused to be prepared a new Chapter 19 of the Fraser
Municipal Code (designed to replace in their entirety present Chapters 15, 16 and 17, and Article
4 of Chapter 18 concerning the use and development of land within the corporate boundaries of
the Town, including regulations for the subdivision of land; and
WHEREAS, in connection with preparation of the new Chapter 19, the Town has caused
to also be prepared a revised Zoning Map for the Town, depicting certain changes in zone district
boundaries, the renaming of certain zone districts, and the creation of two new overlay zone
districts—the Victoria Village and Riverwalk Mixed Use Overlay districts; and
WHEREAS, on February 28, 2018 the Planning Commission conducted a properly
noticed public hearing on the proposed Code revision and the accompanying revision of the
Fraser Zoning Map; and
WHEREAS, it is the opinion and finding of the Planning Commission that the revision of
Chapter 19 of the Municipal Code attached hereto as Exhibit A, as revised by the additonal
amendments titled "Summary of Modifications" and attached hereto as Exhibit B, together with
such additional technical revisions and corrections, including corrections for format, numbering,
and internal consistency as the Town Manager and Town Attorney deem necessary, and the
revision of the Official Zoning District Map of the Town of Fraser, attached hereto as Exhibit C,
are in the best interests of the public health, safety and welfare of the Town, and should be
certified to the Board of Trustees with a recommendation of approval.
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION
OF THE TOWN OF FRASER, COLORADO:
Section 1. The Planning Commission hereby adopts and recommends to the Board of
Trustees for approval with favorable recommendation the repeal of Chapters 15, 16 and 17 and
Article 4 of Chapter 18 of the Fraser Municipal Code, and their replacement by the adoption of a
new Chapter 19 of the Fraser Municipal Code, in the form attched hereto as Exhibit A, as
revised by the additonal amendments titled "Summary of Modifications" and attached hereto as
Exhibit B,together with such additional technical revisions and corrections, including
corrections for format, numbering, and internal consistency, as the Town Manager and Town
Attorney deem necessary.
Section 2. The Planning Commission hereby adopts and recommends to the Board of
Trustees for approval with favorable recommendation the revised "Official Zoning District Map
of the Town of Fraser", in the form attached hereto as Exhibit C.
Section 3. This Resolution shall be effective upon adoption.
