HomeMy Public PortalAboutORD14873 SUBSTITUTE 3 BILL NO. 2011-89 SPONSORED BY COUNCILMAN: Griffith CO-SPONSORS: Carroll, Weber ORDINANCE NO.: 14 V AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE SALES TAX FOR ECONOMIC DEVELOPMENT AT A RATE OF ONE-HALF OF ONE PERCENT AND PROVIDING FOR THE COLLECTION AND USE THEREOF, PROVIDING FOR THE SUBMISSION OF THIS ORDINANCE TO THE QUALIFIED VOTERS OF SAID CITY, FOR THEIR APPROVAL AT THE ELECTION TO BE HELD ON FEBRUARY 7, 2012, AND AMENDING THE CODE OF THE CITY OF JEFFERSON TO CREATE THE ECONOMIC DEVELOPMENT TAX BOARD. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. There is hereby imposed a tax of one-half of one percent on all retail sales made in the City which are subject to tax under Chapter 144 RSMo, provided however, that such tax shall not become effective until the same is approved by the voters of the City. The ballot of submission for the tax authorized in this section shall be in substantially the following form: Shall the City of Jefferson impose a sales tax at a rate of one-half of one percent for economic development purposes by its imposition for the period of June 1, 2012, to May 31, 2022? [ ] YES [ ] NO Section 2. Chapter 17 (Licenses, Taxation and Miscellaneous Business Regulations) of the City Code is hereby amended by adding a New Article XVI (Jefferson City Transformation Economic Development Tax Board) as follows: ARTICLE XVI JEFFERSON CITY TRANSFORMATION ECONOMIC DEVELOPMENT TAX BOARD Sec. 17-451. Board Established. A. There is herebv established a commission to be called the Jefferson Citv Transformation Economic Development Tax Board. B. The Board shall consist of five voting members who shall serve without pay, except for reimbursement of reasonable expenses,and shall be appointed as follows: 1. One member appointed by the Jefferson Citv School District. 2. Three members appointed by the MaVor with the advice and consent of the City Council. 3. One member appointed bV the Cole Countv Commission. (Source: 5 67.1305(12)RSMo.) C. Non-voting members. In addition to the voting members, a designee of the Home Builders Association of Central Missouri, a designee of the Jefferson CitV Area Chamber of Commerce, a designee of Downtown Jefferson City, Inc., a designee of the Old Town Revitalization Companv, a designee of the Jefferson CitV Area Chamber of Commerce Young Professionals(HYPE). a designee of the Jefferson City Area Board of Realtors.Inc. a designee of the Convention and Visitors Bureau, and such other members as the Council may designate shall be ex officio non-voting members. D. Qualifications of Board Members. 1. All voting members shall be registered voters of the Citv of Jefferson. 2. No voting member shall hold any elected office of the City of Jefferson. Cote County,or the Jefferson Citv School District. 3. Term of Office. Of the members initially appointed,the three appointed by the Citv shall be designated to serve for terms of two years, and the remaining members shall be designated to serve for a term of four years from the date of such initial appointments. Thereafter, the appointed members shall serve for a term of four years except that all vacancies shall be filled for unexpired terms in the same manner as were the original appointments. (S 67.1305(12)RSMo.) E. Duties of the Board. The board subject to approval of the Council.shall consider economic development plans economic development projects or designations of an economic development area and shall hold public hearings and provide notice of any such hearings. The board shall vote on all proposed economic development plans, economic development projects, or designations of an economic development area,and amendments thereto, within Bill 2011-89 Substitute,43 2 Drafter's Note: Deleted text is shown t#us. Inserted text is shown thus. thirty days following completion of the hearing on any such plan, proiect, or designation, and shall matte recommendations to the governing body within ninety days of the hearing concerning the adoption of or amendment to economic development plans, economic development proiects, or designations of an economic development area. The Council shall have the final determination on use and expenditure of any funds received from the tax imposed under this section. (Source: § 67.1305(13)RSMo.) F. Additional Duties of the Board. In addition to the duties set forth herein and the duties provided by &67.1305 RSMo.,the Board shall: 1. Make recommendations to the City and County for amendments to their laws so as to encourage economic development and quality of place. 2. Coordinate economic development incentives offered by the political subdivisions and special purpose districts operating within Cole County. 3. Fulfill such other duties as are assigned by the Mayor and City Council. Sec. 17-452. Use of Economic Development Sales Tax Funds. A. All funds collected from any economic development sales tax (hereafter"tax")shall be held in a separate interest bearing fund. B. The Board may consider and recommend the use of such funds only as set forth herein: 1. No revenue generated by the tax authorized in this section shall be used for anv retail development project, except for the redevelopment of downtown areas and historic districts. 2. Not more than three percent of the revenue generated shall be used annually for administrative purposes, including staff and facility costs. 3. At least seventy-five percent of the revenue generated by the tax shall be used solely for proiects directly related to long-term economic development Preparation, including, but not limited to,the following: a. Acquisition of land: b. Installation of infrastructure for industrial or business parks: C. Improvement of water and wastewater treatment capacity: d. Extension of streets: e. Public facilities directiv related to economic development and job creation: f. Providing matching dollars for state or federal grants relating to such long- term projects;and g. Proiects identified on"Transformation Projects Appendix"which are qualified under Section 67.1305.RSMo. 4. The remaining revenue generated by the tax authorized in this section may be used for,but shall not be limited to,the following: Bill 2011-89 Substitute#3 j Drafter's Note: Deleted text is shown 9ws. Inserted text is shown thus. a. Marketing; b. Providing grants and loans to companies for job training,equipment acquisition,site development,and infrastructures; C. Training programs to prepare workers for advanced technologies and high skill lobs; d. Legal and accounting expenses directiv associated with the economic development planning and preparation process.These expenses shall not, however, include any expenses for City staff: e. Developing value-added and export opportunities for Missouri agricultural products; and f. Projects identified on the"Transformation Projects Appendix"which are not included in Section 17-452 B 3 of this Ordinance,and are qualified under Section 67.1305,RSMo. (§67.1305(10)RSMo.) Sec. 17-453. Severabilitv. If anv section subsection, sentence, clause, phrase or portion or provision of this Article is held invalid or unconstitutional or unenforceable by any court of competent jurisdiction, that holding shall not affect impair or invalidate any other section sentence clause phrase word portion or provision of this Article and shall be given effect, without the invalid portion. In adopting this Article, the City Council affirmatively declares that it would have approved and adopted the Article even without any portion that may be held invalid or unenforceable. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
