HomeMy Public PortalAbout2023-16 Establishing that a public park and public utility use be permitted on Village property located at 571 and 599 Harbor DriveRE SOLUTION NO. 2023-16 A RE SOLUTION OF THE VILLAGE COUN CIL OF THE VILLAGE OF KE Y BISCAYN E, FLORIDA, ESTABLISID NG THAT A PUBLIC PARK AND PUBLIC UTILITY USE BE PERM ITTED ON VILLAGE PROPERTY LOCATED AT 571 AND 599 HARB OR DRIVE; AUTHORIZING THE VILLAGE MANAGER TO PRE PARE A SITE PLAN; AN D PROVIDING FOR AN EFFECTIVE AN DATE. WHERE AS, on O ctober 15, 2019, the V illage of K ey B iscayne (the "Village") acquired the pro perty located at 57 1 and 599 H ar bor D rive (the "Pro perty ") fo r public purp oses; an d WH ERE AS, pur suan t to Section 30-102 of the V ill age C ode of Ordinances (the "Vill age C ode"), V ill age staff indicated on the O fficial Zoni ng M ap that the zoning district designation fo r the Pro perty is G U , G overn m ent U se; an d W HERE AS, Section 30-102 of the V illage C ode fu rther pro vides that the Vill age C oun cil shall hold a public hearing prior to establishi ng any new use of lands designated GU ; and WHERE AS, after review and considera tion, the V ill age C ouncil desires to establish that the Pro perty is to be prim arily used as a public park w ith public utility uses also perm itted on the Pro perty ; and WHERE AS, public notice w as pro vided in accordan ce w ith law ; and WHERE AS, the V illage C ouncil finds that this R esolution is necessary to pro m ote and pro tect the public health, safe ty and w elfa re of the citizens an d residents of the Village. NOW, THERE FORE , IT IS HERE BY RE SOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KE Y BISCAYN E, FLORIDA, AS FOLLOWS: Section 1. and confirm ed. Recitals Adopted. That each of the recitals stated above is hereby adopted Section 2. Establishment of Use. That the Village Council hereby establishes that the Property is to be primarily used as a public park with public utility uses also permitted on the Property. Section 3. Village Manager Authorized. That the Village Manager is hereby authorized to take any and all steps necessary to prepare a site plan for the Property consistent with the uses approved by this Resolution. Section 4. adoption hereof. Effective Date. That this Resolution shall be effective immediately upon PASSED and ADOPTED this 14th day of March, 2023.
