Beatty, Krez, Printup, and Miss Gray Absent: Mr. Taplin Also present were Fred Maley, Village Manager, and Mary T. Wetterer, Village Clerk. Mr. Maley explained that this was the second of the two Public Hear- ings required on future land use under the Comprehensive Master Plan. He said that the Plan was being upgraded as to graphics, a cover being pre- pared, and printed. As there were no comments received in person or by letter on motion of Mr. Beatty, seconded by Miss Gray and voted, the Land use Element in the Master Plan was adopted. On motion of Mr. Krez, seconded by Miss Gray the meeting was adjourned at 5:25 P.M. Attest: � Ze7; Vi lage Clerk COUNCIL MINUTES September 25, 1979 The Council of Bal Harbour Village met Tuesday, September 25, 1979 at 9:30 A. M. in the Village Hall. Present: Messrs. Beatty, Krez, Printup and Miss Gray Absent: Mr. Taplin Also present were Fred Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Krez, seconded by Mr. Beatty, and voted the minutes of August 28, 1979 and the Public Hearing of September 10, 1979 were approved as submitted. Mr. Frasuer Knight, architect, and Mr. Kennedy, the low bidder on the village hall addition, explained that there was an error in his bid price due to an incorrect figure being used from his electrical sub- contractor. Mr. Kennedy requested an adjustment in his bid to reflect the correct electrical cost. Mr. Gold requested Mr. Kennedy to submit an affidavit stating all the facts leading to the incorrect bid figure and Mr_ Knight to send a letter regarding his estimate of the electrical portion of the job. Mr. Gold said that he would give the council a written opinion concerning the matter and it would be considered again in conjunction with the October 2, 1979 Public Hearing. The Village Clerk read in full Ordinance No. 213 raising the fees for overtime parking tickets to $3.00. On motion of Mr. Beatty, seconded by Mr. Krez and voted the ordinance was adopted on second reading. Ordinance No. 214 was read in full for second reading. On motion of Mr. Krez, seconded by Miss Gray and voted the ordinance revising fees for water service tapping charges was adopted. Resolution No. 267 transferring funds between divisions in the General Fund 1978-79 budget was adopted on motion of Mr. Beatty, seconded by Miss Gray and voted. Mr. Ralph Gimel of the Resort Tax Advisory Committee told the council that they wished to recommend the renewal of the Advertising and Public Relations contracts with Sam McColloch and Associates, and Bill Kofoed, Inc. On motion of 'Mr, Krez, seconded by Mr. Beatty and voted Mr. McColloch's contract was renewed. On motion of Miss Gray, seconded by Mr. Krez and voted Mr. Kofoed's contract was renewed. Mr. Maley read a letter from Mr. Whitman, Chairman of the South Florida Highway Users Association, in which he requested the Florida Department of Transportation to erect proper signing on I-95 to direct travelers to Bal Harbour, Bay Harbor and Surfside. It was moved by Miss Gray, seconded by Mr. Beatty, and voted that the Mayor should pursue this subject with the Department of Transportation. Mr. William Logan, attorney for the owner of Lot 24 Block 6, Resi- dential Section, requested a variance for an addition to the house to extend 3" into the side setback line. He explained that a survey revealed that the present attached garage is 3" over the line and the owner re- quests that the new addition be built to line up with the garage. On motion of Mr. Beatty, seconded by Mr. Krez and voted the variance was granted. Mr. Logan said that the neighbor to the north, who is presently ill, would send a letter to the Village stating that he had no objection to the variance. Mr. Maley reported that he had a premium quotation for a $500,000 Umbrella Policy to our General Liability Policy for $10,800 and Police Liability for false arrest, etc. for $8,700. After discussion it was September 25, 1979 decided that Mr. Maley and Mr. Gold should check liability under present policies, also if the State of Florida has the liability for the beach for discussion at the October meeting. Capital Projects for the Tourism Department were discussed. On motion of Mr. Beatty, seconded by Miss Gray and voted, Mr. Maley was given permission to get cost figures on projects suggested by the Resort Tax Advisory Committee at recent meeting, so that a multi -year plan could be worked out. Mr. Maley reported that results of the recent auditor's review of three hotel properties in regard to the Resort Tax showed that they were using accepted accounting procedures. On motion of Mr. Krez, seconded by Miss Gray and voted the meet- ing was adjourned at 11:00 A.M. Present: Miss Gray and Messrs. Beatty and Printup Absent: Messrs. Krez and Taplin Also present were Fred W. Maley, Village Manager and Mary T. Wetterer, Village Clerk. Mr. Maley explained that this is the first of two duly advertized meetings regarding the proposed 5.65 millage levy, which is 6.87% over the Certified Millage, submitted by the Dade County Assessor. As there were no comments or anyone present at the Hearing the Mayor announced that the next Hearing would be at 5:15 P.M. on October 2, 1979.
