HomeMy Public PortalAbout1987-059Member its adoption: introduced the following resolution and moved CITY OF MEDINA9 G RESOLUTION NO. 4 7-5 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO RICARDO AND GRACIELA GONZALEZ WHEREAS, Ricardo and Graciela Gonzalez (Applicants) have applied for a conditional use permit to construct a 36' X 72' accessory building on their property located at 3072 Willow Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, there currently exists on the property two accessory structures totaling 2304 square feet; and WHEREAS, this matter has been reviewed by the planning commission on June 9, 1987, and by the City Council on July 7, 1987; and WHEREAS, it have been determined that the existence of an additional accessory structure totaling 2,592 square feet will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. The three accessory structures on site shall not exceed an aggregate of 5,000 square feet in size; 2. Manure shall be removed from the site in compliance with MPCA regulations; 3. Excavation and drainage on the site shall be approved by the city engineer; 4. The Applicants shall install exterior lighting essentially similar to that proposed; 5. The Applicants warrant that the accessory structure which they will be permitted to construct as a result of this conditional use permit is for their private use and that no commercial horse boarding or training shall occur; 6. The Applicants shall file with Hennepin County a request to combine their two parcels in order to meet minimum setback and acreage requirements; 7. There shall be no more than 30 horses permitted on the site at any one time; 8. The City acknowledges that one of the accessory structures does not conform to all ordinance requirements but its use as an animal structure is permitted; 9. There shall be no toilet facility in the new accessory structure; 10. The Applicants shall have no more than three non-resident employees; 11. The Applicants shall convey to the City an easement for the Willow Drive right-of-way or demonstrate that the City currently has such an easement; 12. A11 signs on the property shall conform to City ordinances; 13. There shall be no limitation with regard to the hours of operation; 14. There shall be no exterior loud speaker on the property; 15. The Applicants shall erect and maintain adequate fencing surrounding the horses; and 16. The Applicants shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
