RESOLUTION NO.
RESOLUTION GRANTING A
VARIANCE TO WILLIAM NELSON
WHEREAS, William Nelson (Applicant) have requested a variance to reduce
the setback from Lake Independence to 65' for construction of a house located
at .;,, % ✓ J �<,e°, {(/n r,
Exhibit A attached hereto; and
WHEREAS, the zoning ordinance of the City requires that such structures
be located no closer to the shore than 75 feet; and
WHEREAS, Section 825.45 of the zoning ordinance and Minn. Stat., Section
462.357 require that variances from the strict interpretation of the zoning
ordinance be granted only when there is a demonstrated hardship due to circum-
stances unique to the property; and
WHEREAS, the planning commission reviewed the Applicant's request on June
30, 1987, and recommended approval thereof.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina
that the Applicant's request for a variance is approved due to the hardship
imposed by the irregular shape of the lot and in recognition of the fact that
three small lots in this area were previously combined and redivided into two
lots, subject to the following:

1. The house constructed on the site shall be substantially similar to the
one shown on the plans submitted to the City;
2. The house shall require no additional variances; and
3. The variance hereby granted shall lapse one year from the date of the
adoption of this resolution unless, prior to such date, a building permit
has been issued and substantial work accomplished on the house or the
applicant has received an extension of time from the city council.
