VIRTUAL SECOND BUDGET HEARING
KEY BISCAYNE, FLORIDA
TUESDAY, SEPTEMBER 22, 2O2O
1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order
by the Mayor at 6:02 p.m. Present were Councilmembers Luis Lauredo, Edward London,
Allison McCormick (arrived at 6:03 p.m.), Kathleen Petros, Ignacio Segurola, Vice Mayor Brett
G. Moss and Mayor Michael W. Davey. Also present were Village Manager Andrea Agha,
Village Clerk Jocelyn B. Koch and Village Attomey Chad Friedman.
2. PLEDGE OF ALLEGIANCE: Mayor Davey led the Pledge of Allegiance.
3. BRIEF COMMENTS BY COUNCIL: Councilmember Petros addressed the public on
the millage and budget process; discussing zero-based budgeting and community groups, noting
58% of the budget are collective bargaining contracts, and there is almost aTYo drop in expenses
this year, I.3o/o drop in property values which the average increase is 6.70/o each year over the last
20 years and notifying the public that the full budget information is available on the website for
their review; also Council has been working on the budget since June with the Manager and
Department Heads. Councilmember London addressed the Council stating that this budget is not
zero-based budgeting.
4. PUBLIC COMMENTS: The following resident addressed the Council: Pat Woodson,
1725 Tigertail Ave., Coconut Grove.
5. MILLAGE RESOLUTION: The Clerk read the following resolution by title
A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE, FLORIDA ADOPTING THE
FINAL MILLAGE RATE OF THE VILLAGE OF KEY BISCAYNE FOR THE FISCAL
YEAR COMMENCING OCTOBER I, 2O2O THROUGH SEPTEMBER 30, 2O2I
PURSUANT TO FLORIDA STATUTE 200.06s (TRIM BILL); AND PROVIDING FOR AN
EFFECTIVE DATE.

Mayor Davey made a motion to approve the resolution. The motion was seconded by Vice Mayor
Moss.
Vice Mayor Moss made a motion to table the resolution. The motion was seconded by Mayor
Davey and approved by a 7-0 voice vote. The vote was as follows: Councilmembers Lauredo,
London, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor Davey voting Yes.
At this time, the Mayor opened the floor for additional Public Comments. There were no callers
present. The Mayor closed the public comments.
6. ORDINANCES: The Clerk read the following ordinance on second reading, by title:
AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; ADOPTING
THE BUDGETS FOR THE FISCAL YEAR COMMENCING OCTOBER I, 2O2O
THROUGH SEPTEMBER 30, 2021 PURSUANT TO FLORTDA STATUE 200.065 (TRrM
BILL); PROVIDING FOR AN EFFECTIVE DATE.
Mayor Davey made a motion to adopt the budget ordinance on second reading. The motion was
seconded by Councilmember McCormick.
The Mayor opened the public hearing. There were no callers present. The Mayor closed
the public hearing.
The Manager addressed the Council giving a presentation on theFY2}2I proposed budget and the
changes from the September 8, 2020 First Budget Hearing; the Manager confirmed that the
proposed millage rate is 3.195, the same millage rate as in the prior year. Staff was able to
renegotiate the property and liability insurance rates for a reduction of approximately $90,000 and
looked at travel and per diem due to Covid 19 for an additional reduction of $30,000. The land
trust transfer, per ordinance is a Io/o allocation of ad valorem revenues which made a $1,500
difference. Also, KB Composting reduced their request by about $5,500. Community Groups were
funded atFY2020 amounts and KB Community Foundation and the KB Chamber of Commerce
were moved into the Manager's Budget.
The Mayor opened the public hearing. There were no callers present. The Mayor closed
the public hearing.
There was discussion by Council regarding debt service and true cuts to the budget.
The Manager addressed the Council reporting that advisory boards have been reduced by
$I22,000,personnel costs related to collective bargaining agreements have increased by $230,000,
cost of benefits for personnel have increased by $404,000, staffing outside of collective bargaining
agreements has been reduced by $480,000, the debt service has been reduced by $800,000. Repairs
were deferred by $230,000 and the spin bike maintenance was reduced by $90,000, revenue
sharing in athletics due to Covid 19 had a reduction of $585,000, a reduction of red light camera
fees both on the revenue and expense side was by $175,000, less reliance on contracted services

saw a reduction of $260,000, the reduction in property and liability service and also a reduction in
the Attomey's fees.
There was discussion by Council regarding budget cuts.
Fire Chief Eric Lang addressed the Council regarding the need for a part time fire inspector and
describing the fire inspector certification as part of the personnel's professional development.
It was the consensus of Council that for institutional historical purposes, to list all of the
community groups even if they have zero dollar amounts in the final budget.
The following residents addressed the Council: Melissa White, 370 Heather Lane with the
KB Community Foundation; Frances Reaves, 25I Crandon Boulevard and Mary Tague,
610 North Mashta Drive representing KB Car Week; Don Elisburg,lTT Ocean Lane Drive
and Frank Caplan, 370 Palmwood Road representing the KB Historical Society.
There was discussion by Council on community groups and their funding and grants and
contributions.
Councilmember McCormick made a motion to put the community groups back in the budget at
FY2020 numbers and anything that is not spent goes into an emergency fund. The motion was
seconded by Mayor Davey.
There was discussion by Council regarding the above motion.
Councilmember London made a friendly amendment that the recipients of these various funds
would state they are not charities nor grants so that a unanimous vote is not required. The motion
died for lack of a second.
Councilmember Segurola made an altemative friendly amendment to keep the community groups
in the Covid 19 emergency fund and list them group by group with each dollar amount. The motion
died for lack of a second.
The Mayor opened the public hearing. Melissa White, 370 Heather Lane representing the
KB Community Foundation addressed the Council. The Mayor closed the public hearing.
The McCormick motion was approved by a 6-l voice vote. The vote was as follows:
Councilmembers Lauredo, London, McCormick, Petros, Vice Mayor Moss and Mayor Davey
voting Yes. Councilmember Segurola voting No.
Councilmember Petros made a motion that a Councilmember work with the KB Community
Foundation to discuss how to categorize and present each one of these community groups and
classify them as either grants or charitable contributions and to recommend a process that the
Council could vote on to help reduce the confusion and to avoid this discussion from happening
again in the budget next year. The motion was seconded by Mayor Davey.

Councilmember Segurola made a motion that the community funds are not to be dispersed until
Council has an opportunity to analyze this on a case by case basis which would happen in the very
near future. The motion died for lack of a second.
The Petros motion was approved by a 7-0 voice vote. The vote was as follows: Councilmembers
Lauredo, London, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor Davey voting Yes.
It was the consensus of Council that Councilmember Segurola work with the KB Community
Foundation regarding the above Petros motion.
Councilmember Lauredo addressed the Council the following policy decisions for community
groups funding were agreed to last year; the Council work on the basis this is seed money, these
groups should, over a period of time, need to develop an exit strategy and some groups have
historical weight and should not have to have the first two prior conditions apply, for example: the
July 4th Parade.
Councilmember McCormick addressed the Council regarding the above matter stating not only is
historical weight a factor for funding but also where applicable.
Councilmember Lauredo made a motion to approVe that the Community Groups be kept at the
FY2020 including the KB Historical Society at $15,000. This motion was seconded by
Councilmember Petros and approved by a 7-0 voice vote. The vote was as follows:
Councilmembers Lauredo, London, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor
Davey voting Yes.
Mayor Davey requested clarification from the Manager on the funding of the KB Winterfest.
The Manager addressed the Council that the funding was reallocated for enhancing electrical visual
displays for the holidays.
Councilmember London addressed the Manager in regards to the budget and the CBA's, a clause
in the firefighter's agreement,#I3.7, which gave the fire fighters the right, onatrialbasis only for
FY20I9, to convert sick leave, up to three weeks, to vacation and then clause #15.8 allows fire
fighters to sell their vacation back to the Village. This totaled about $280,000 and was only for
FY20I9 on a trial basis, but only if it did not have an adverse effect to the Village, a tag along
clause for the general employees which could total $500,000.
The Manager addressed the Council regarding the above matter
The Attomey addressed the Council stating that he would need to speak with Labor Attorney Brett
Schneider regarding the above matter.
At this time, Councilmember London left the meeting.
Councilmember Lauredo made a motion to move the Education Advisory Board to the FY2020
funding level. The motion was seconded by Councilmember McCormick and approved by a 6-0

voice vote. The vote was as follows: Councilmembers Lauredo, McCormick, Petros, Segurola,
Vice Mayor Moss and Mayor Davey voting Yes.
Vice Mayor Moss made a motion to remove $2,000 from the Clerk's travel per diem budget and
$5,000 from the KB Composting to use for professional services for training. The motion was
seconded by Councilmember Lauredo.
Councilmember Petros made a friendly amendment to use only $3,000 from KB Composting and
$2,000 from travel per diem for a total of $5,000. Vice Mayor Moss accepted the friendly
amendment.
The motion, as amended, was approved by a 6-0 voice vote. The vote was as follows:
Councilmembers Lauredo, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor Davey
voting Yes.
Councilmember Petros made a motion that KB Composting reduced their ask from $13,805 to
$8,230 for a reduction of $5,000 for KB Composting. The motion was seconded by Mayor Davey
and approved by a 6-0 voice vote. The vote was as follows: Councilmembers Lauredo,
McCormick, Petros, Segurola, Vice Mayor Moss and Mayor Davey voting Yes.
At this time, Councilmember London rejoined the meeting
Councilmember London addressed the Council on the CBA's modified conversion program
clause.
Fire Chief Lang addressed the Council regarding the above matter reporting that there is a savings
of $50,000 to have this program as best practice.
There was discussion by Council and Fire Chief Lang regarding the above matter.
The Manager and the Attorney addressed the Council regarding additional analysis can be made
and would be ready by the October 27rh,2020 Regular Council Meeting and suggesting a budget
amendment can be made at alater date.
Councilmember McCormick requested from the Manager that the analysis be sent in advance of
the meeting, prior to Agenda deadlines, for Council to have plenty of time to review it.
Councilmember Lauredo made a motion to approve the Police Budget as presented and give the
33 Village police officers "boots on the ground" a $1,000 bonus. The motion was seconded by
Mayor Davey.
Councilmember Lauredo made a friendly amendment to his motion to add the 35 Village Fire &
Rescue personnel for a total of $68,000. The motion was seconded by Mayor Davey.
There was discussion by Council regarding the above motion.

The Attorney also addressed the Council regarding the above motion
The motion, as amended, was approved by a 7-0 voice vote. The vote was as follows:
Councilmembers Lauredo, London, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor
Davey voting Yes.
Councilmember Lauredo addressed the Manager regarding upgrading Village Maintenance.
The Manager addressed the Council regarding the Landscape Contractor and that there is an
inspection program in place.
Mayor Davey requested clarification of the Maintenance and Roads expenditures and the
confirmation of its funding in the budget.
The Manager addressed the Council regarding the above matter including $25,000 for
beautification projects, increased tree trimming allocation and tree replacements. Also, reporting
roadway improvements of $30,000 and $25,000 for traffic circles and additional funds for sidewalk
repairs; and stating the Horticulturist, maintenance worker and the code enforcement position are
also strategies which improve the standard of Village beautification.
Councilmember McCormick addressed the Manager regarding the onboarding for the Landscape
Contractor, needed power washing and roadway repair.
BZP Director Jake Ozyman addressed the Council that roadway repair and potholes are budgeted
for emergency repairs only and because of undergrounding or stormwater projects it would be a
waste of money if you are going to do major repairs over the next few years.
The Manager addressed the Council regarding the solid waste project contract by RFP and the
response period ends in early October 2020 and when the contract expires it would continue on a
month to month basis.
There was discussion by Council regarding holiday lights and decorations and the monthly
calendar.
KB Community Center Director Todd Hofferberth addressed the Council regarding looking at
scaling back the holiday decorating and costs and recategorrzing the monthly calendar.
There was discussion by Council regarding the 2 million part of the budget being $800,000 in debt
service and for the public to be aware that the revenues decreased directly as a result of Covid 19
and the state revenue shares.
Vice Mayor Moss made a motion to table the budget ordinance, as amended. The motion was
seconded by Mayor Davey and approved by a 7-0 voice vote. The vote was as follows:
Councilmembers Lauredo, London, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor
Davey voting Yes.

At this time, there was a five-minute recess
Mayor Davey made a motion to remove the millage resolution from the table. The motion was
seconded by Vice Mayor Moss and approved by a 7-0 voice vote. The vote was as follows:
Councilmembers Lauredo, London, McCormick, Petros, Segurola, Vice Mayor Moss and Mayor
Davey voting Yes.
The Attomey read into the record that the final millage rate for the Village of Key Biscayne for
the fiscal year commencing October I,2020 through September 30,2021, be and is hereby fixed
at the rate of 3 .2039 mills which is $3.20 dollars per $ 1,000.00 of assessed property value within
the Village of Key Biscayne. That the rolled-back rate is 3.2187 mills and the final millage rate is
3.2039 mills which is .460/o under the rolled-back rate.
Councilmember McCormick addressed the Manager regarding reducing the Education Advisory
Board line item from $57,000 to $43,800.
As a result of Councilmember McCormick's adjustment to the Education Advisory Board the
Attorney read into the record the revised final millage rate.
The Attorney read into the record that the final millage rate for the Village of Key Biscayne for
the fiscal year commencing October I,2020 through September 30,2021, be and is hereby fixed
at the rate of 3 .2022 mills which is $3.20 dollars per $ 1 ,000.00 of assessed property value within
the Village of Key Biscayne. That the rolled-back rate is 3.2187 mills and the final millage rate is
3.2022 mills which is .51% under the rolled-back rate.
Mayor Davey made a motion to approve the millage resolution, as amended. The motion was
seconded by Vice Mayor Moss.
Councilmember McCormick made a motion to amend and use unspent carryover funds as a result
of Covid 19 for the bonuses proposed by Councilmember Lauredo's motion and pass without a
millage increase, the Council could then bring a budget amendment in November 2020 in order to
pay out those funds. The motion was seconded by Mayor Davey.
There was discussion by Council regarding the McCormick motion.
The Attomey and the Manager addressed the Council in regard to the process and the carryover
numbers from November.
Councilmember McCormick withdrew her motion.
The motion to approve the millage resolution, as amended, was approved by a 6-1 roll call vote.
The vote was as follows: Councilmembers Lauredo, McCormick, Petros, Segurola, Vice Mayor
Moss and Mayor Davey voting Yes. Councilmember London voting No.
Mayor Davey made a motion to remove the amended budget ordinance from the table. The motion
was seconded by Vice Mayor Moss and approved by a7-0 voice vote. The vote was as follows:

Davey voting Yes.
Mayor Davey made a motion to approve the budget ordinance, as amended, on second reading.
The motion was seconded by Councilmember McCormick and approved by a 6-1 roll call vote.
The vote was as follows: Councilmembers Lauredo, McCormick, Petros, Segurola, Vice Mayor
Moss and Mayor Davey voting Yes. Councilmember London voting No.
7. SCHEDULE OF FUTURE MEETINGS/EVENTS: A schedule of future meetings and
events was presented to the Council.
8. ADJOURNMENT: The meeting was adjourned at 9:10 p.m.
