HomeMy Public PortalAbout10-8018 FIU Sponsored by: City Manager Resolution No. 10- 8 018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA ACCEPTING THE PROPOSAL OF THE METROPOLITAN CENTER OF FLORIDA INTERNATIONAL UNIVERSITY(HEREINAFTER "FIU/MC") FOR THE PREPARATION OF THE CITY OF OPA-LOCKA'S COMPREHENSIVE PLAN AMENDMENTS AS REQUIRED BY SECTION 163.3193,F.S.(2005);FURTHER AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH FIU/MC FOR SAID SERVICES,IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND DOLLARS ($25,000), PAYABLE FROM ACCOUNT NO. 37- 515312;PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Opa-locka desires to update its comprehensive plan through the amendment process; and WHEREAS, the City of Opa-locka has utilized the services of FIU/MC to prepare its Evaluation and Appraisal Report and now requires these services for its plan amendment process; and WHEREAS, the processing of these Comprehensive Plan amendments is required by Florida Statutes; and WHEREAS, the City Commission of the City of Opa-locka desires to accept the Metropolitan Center of Florida International University (FIU/MC) proposal (attached hereto) to update its comprehensive plan through the amendment(Section 163.3193,F.S.(2005))process;and Resolution No. 10- 8 01 8 WHEREAS, the City Commision of the City of Opa-locka desires to authorize the City Manager to enter into and execute the attached Professional Services Agreement with FIU/MC for said services, in an amount not to exceed Twenty-Five Thousand Dollars ($25,000); and NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission authorizes the City Manager to execute the attached services agreement in an amount not to exceed twenty-five thousand dollars($25,000),to be payable from account No. 37-515312 Section 3. Description: Comprehensive planning is a process that determines community goals and aspirations in terms of community development. The outcome of comprehensive planning is the Comprehensive Plan which dictates public policy in terms of transportation, utilities, land use, recreation, and housing. Comprehensive plans require a first step process which includes the preparation of an Evaluation and Appraisal Report (EAR) and the Comprehensive Plan amendments. In 2007, the City of Opa-locka ("City") hired Florida International University ("FIU") to prepare its Evaluation and Appraisal Report (EAR) and to assist with the Comprehensive Plan Amendments. The Local Planning Agency (South Florida Regional Planning Council) has reviewed the Evaluation and Appraisal Report. The City Commission, after considering the review agency's comments approved and adopted the revised 2007 EAR and authorized the transmittal of the EAR to the South Florida Regional Planning Council for sufficiency review in accordance with Section 163.3191 and Rule 9J-11.009. Financial Impact: The cost associated with this request is $25,000. Implementation Time Line: Immediately, upon adoption of this resolution and execution of the contract. Legislative History: Resolution No. 06-6869 Recommendation(s): Staff is recommending the acceptance of the FIU/MC proposal to process the Comprehensive Plan Amendments as required by Florida State Statutes. Analysis: In 2007, the City of Opa-locka ("City") hired Florida International University ("FIU") to prepare its Evaluation and Appraisal Report, and the Local Planning Agency has reviewed the Evaluation and Appraisal Report, held an advertised public hearing, provided for participation in the process, and rendered its recommendations to the City Commission of the City of Opa- locka ("City Commission"). On December 12, 2007, the City Commission adopted Resolution No. 07-7193, authorizing the City Manager to transmit the Evaluation and Appraisal Report to the South Florida Regional Planning Council for preliminary review and comments. On December 10, 2008 the City held an advertised public hearing to receive public comments on the proposed Evaluation and Appraisal Report, thereby providing for public participation in the comprehensive plan process. On December 10, 2008 the City Commission adopted the revised 2007 Evaluation and Appraisal Report and transmitted it to the South Florida Regional Planning Council for sufficiency review in accordance with Section 163.3191, Florida Statutes, with copies sent to the adjacent local governments and all agencies listed under Rule 9J-11.009 (6) F.A.C. In its years of existence, the FIU/MC has produced an important body of work that has served as the foundation for major policy changes, large-scale development plans, and the initiation of new programs in Miami-Dade. The Center's approach to conducting Evaluation and Appraisal Reports(EAR)is to consider the unique needs of individual communities while adhering to recognized methodologies for research design, data analysis, and reporting. We work closely with each of our clients to create a process that engages stakeholders and fosters public support. Our goal is to guide municipalities through the EAR process and provide a foundation that will yield amendments that are comprehensive and ready for implementation. Other Relevant Project Experience 2004 City of Miami: Martin Luther King and NW 54th Street Commercial Corridors Market Study The study analyzed the retail potential of the two corridors and reviewed land use issues in the area. It provided an assessment of the retail,office and hospitality markets and an evaluation of land use and zoning regulations that could affect future development. 2002 City of Miami: FEC Corridor Strategic Redevelopment Plan This comprehensive corridor strategic redevelopment plan extended from the City of Miami's downtown to the City's northern boundary. The plan included an economic assessment of the FEC Corridor and provided recommendations for transportation, housing and zoning issues. 2001 79th Street Corridor Neighborhood Initiative The 79th Street Corridor Survey and Economic Market study served as the foundation the neighborhood master plan. City of Opa-Locka 2 Evaluation and Appraisal Report-Based Amendments Scope of Services I Purpose The Florida International University Metropolitan Center(FIU/MC)on behalf of the City of Opa- Locka will provide professional services to complete the Evaluation and Appraisal Report(EAR)- Based Amendments as required by Chapter 163, Part II, Florida Statutes in accordance with Florida's Growth Management legislation. This scope of services for the EAR-based text and map amendments shall include the following planning tasks: II Tasks Project tasks, deliverables and cost are subject to the City of Opa Locka's submission and subsequent approval by reviewing agencies of the City's Evaluation and Appraisal Report, as adopted September 9, 2009. A. Develop Amendment Package 1. The FIU/MC shall provide professional services related to, and in preparation of, the EAR-based amendments. This task includes the technical assistance in and actual preparation of the draft EAR-based amendments as well as required data and analysis. All current and statutory rule requirements shall be addressed for completion by the FIU/MC excluding professional engineering services. 2. The FIU/MC shall prepare and finalize Comprehensive Plan element updates for the EAR-based amendment cycle pursuant to F.S.163 Part II. Consultant shall use ESRI geographic information system software (GIS) to prepare required map updates in conjunction with the EAR-based amendments. 3. The FIU/MC shall provide the draft EAR-based amendment document(s) to the City for review and comment in advance of scheduling public hearings. EAR-based amendments shall highlight revisions in strike-through and underscore format. FIU/MC shall revise the draft amendments in response to City staff comments. 4. Following receipt of the reviewing agency's Objections, Recommendations, and Comments (ORC) report, the FIU/MC shall revise the draft EAR-based amendments package in accordance with objections and at the direction of the City staff. 5. FIU/MC shall advise City staff concerning transmittal of the complete package and provide modifications as required by the reviewing agency until final determination of compliance is achieved. B. Assist in Public Presentations The F1U/MC shall attend the City Commission transmittal and adoption hearing(s) for the EAR-based amendments to address and respond to the City Commission's questions. City of Opa-Locka 3 Evaluation and Appraisal Report-Based Amendments III City Responsibilities The FIU/MC will rely on the City of Opa-Locka to: 1. Issue public notices regarding public hearings and meetings, as required under the EAR- based amendment process. 2. Provide the FIU Metropolitan Center copies of all relevant plans,budgets, studies, and reports. 3. Review and approve all legal documents as may be required in accordance with submissions and transmittals to the reviewing agency including, but not limited to, memorandums of understanding(MOUs) with governmental agencies. It is recommended that the City attorney review all documents to be transmitted. 4. Transmit the EAR-based amendments to the reviewing agency and other agencies, as required under State regulations. IV Deliverables Complete written EAR-based amendments document and supporting documentation, including required data and analysis in electronic format. V Timeline The FIU Metropolitan Center shall have an initial meeting with City staff to develop a schedule of necessary milestones relative to specific work progress deadlines. The schedule shall include status meetings for each task for the development and completion of the EAR-based amendments and required data and analysis. This work will prepare the City staff for public hearings with the Local Planning Agency(LPA)and the City Commission. VI Project Cost The FIU/MC will complete all tasks and deliverables for the sum of$25,000.
