A RESOLUTION OF THE LYNWOOD CITY COUNCIL ADOPTING A RIGHT-OF-WAY
USE AGREEMENT BETWEEN NEXTG NETWORKS AND THE CITY OF LYNWOOD
WHEREAS, NextG Networks ("NextG") seeks to install its network in eight
locations throughout the City of Lynwood to provide wireless telecommunications
services to wireless carriers; and
WHEREAS, NextG seeks to enter into the attached Right-Of-Way Use
Agreement ("Agreement") to govern NextG's use of the City's right-of-way (ROW),
including installation and maintenance of its wireless telecommunications facilities; and
WHEREAS, the City Council seeks to enter the Agreement which provides in
part that NextG will pay the City the greater of $500 per node or 5% of its annual gross
revenues as a ROW fee.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. The Lynwood City Council hereby approves the Right-Of-Way Use
Agreement provided concurrently with this Resolution.
Section 2. This Resolution shall go into effect immediately upon its adoption.
Section 3. The City Clerk shall certify as to the adoption of this Resolution.
PASSED, APPROVED and ADOPTED this 20th day of April, 2010.
