MINUTES
SEPTEMBER 18, 1979
INITIATION:
1, CALL TO ORDER:
I Mayor Dennis called the regular meeting of the City Council to
order at 7:35 p.m. on Tuesday, September 18, 1979, in the Council
Chamber of the City Hall.
2. INVOCATION:
The invocation was given by Rabbi Alan Lachtman, Temple Beth David,
9677 Longden Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Dennis.

At this time Mayor Dennis introduced Sigmund Caswell, newly appointed
member of the Parks and Recreation Commission, and the City Clerk ad-
ministered the Oath of Office.
IMayor Dennis introduced Mr, Manuel De la Rosa, representative for Assembly-
woman Sally Tanner, who was in the audience,
Councilman Tyrell, on behalf of the City Council, introduced Inspector
Harry Hansen, formerly Captain at Temple Station, and presented- -him a
plaque and expressed the Council's appreciation for the fine working
relationship with the Sheriff's Department during his five years as
commander at Temple Station. Inspector Hansen thanked the Council for the
support given to himself and his deputies.
Councilman Tyrell then introduced Captain John Butler, new commander of
Temple Station, welcoming him back to Temple City.

5. CONSENT CALENDAR:
Mayor Dennis requested Item F -1 be removed from the Consent Calendar.
On motion by Councilman Tyrell, seconded by Councilman Atkins, Items
A through E and F -2 through K were approved as recommended.

B. RENEWAL OF AGREEMENTS: STUDENT AND THE LAW - TEMPLE CITY UNIFIED

Approve the agreements for the 1979 -80 school year and authorized
Mayor and City Clerk to sign.
C. ADOPTION OF 1979 LOS ANGELES COUNTY ELECTRICAL CODE
Introduced Ordinance No. 79 -481 AN ORDINANCE OF THE CITY COUNCIL OF

D. COMPREHENSIVE EMPLOYMENT AND TRAINING ACT (CETA)
Authorized Mayor to inform the Department of Community Development
Temple City does not feel the CETA program is viable under current
guidelines and the City will not participate in CETA funding after
September 30, 1979.
E. LOS ANGELES COUNTY SOLID WASTE MANAGEMENT PLAN - AMENDMENT NO. 2
Adopted Resolution No. 79 -1839 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY CONCURRING WITH AMENDMENT NO. 2 TO THE LOS
ANGELES COUNTY SOLID WASTE MANAGEMENT PLAN.
F. RECOMMENDATIONS -FROM TRAFFIC COMMISSION - Meeting of September 5
(2) "ALL RED" CLEARANCE INTERVAL - TRAFFIC SIGNALS AT SPECIFIED
LOCATIONS
Approved installation of "all red" clearance interval at Temple City
Boulevard and La Rosa Drive; Lower Azusa Road and Arden Drive; Santa
Anita Avenue and Freer Street; Las Tunas Drive at Encinita, Oak, and
Cloverly Avenues; and approved continuing at eight signalized inter -
sections where. an "all red" clearance interval was in operation for
a one -year period.
G. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of September 11
(1) REVISED HOUSING ELEMENT OF THE GENERAL PLAN
Adopted Resolution No. 79 -1841 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY REQUESTING TIME EXTENSION FOR THE REVISED

UNFINISHED BUSINESS:
6 CONTINUED HEARING: APPLICATIONS FOR RELIEF FROM MORATORIUM ON CONDO-
MINIUM DEVELOPMENT PURSUANT TO SECTION 6 OF ORDINANCE NO, 79 -478
(1) TENTATIVE TRACT NO, 35584, 6351 TEMPLE CITY BOULEVARD
(2) TENTATIVE TRACT NO, 37582, 4503 -15 ELLIS LANE
City Manager Koski presented background information stating the
City Council., at their regular meeting held August 21, 1979,
considered several applications for relief from the moratorium
claiming hardship° Two of the applications were continued to
September 18 on the basis an inadequate presentation for hardship
was made. Both of the subject tracts were scheduled for public
hearing before the Planning Commission on August 14, continued
to August 28, at which time the Planning Commission denied both
cases, without prejudice, on the advice of the City Attorney. If
City Council finds a hardship exists in both or either of these
applications, the developer may resubmit his tentative tract
without fee for processing:
Luie Arias, representing J. Ho Hedrick & Co., submitted a break-
down of the costs incurred throughout the processing of the
tentative tracts.
Steve Bo s, J. Ho Hedrick . &.Coo, stated the company has worked over
a long period of time trying to come up with a project which would
be as close to a single family development as possible, and in the
process have incurred many expenses. The property could be developed
with apartments but the company felt condominiums would be more in
keeping with what the neighbors want,
Councilman Gillanders stated the tentative tracts could be processed
through the Planning Commission and City Council without undue delay
by the moratorium, and the expenses incurred would be equaled by the
normal inflation raising the value of the property.
There being no more testimony, Councilman Gillanders moved to close
the hearing, seconded by Mayor Dennis and carried,
Councilman Atkins stated the applicant has not made a strong case
for exclusion from the moratorium, and also that the guidelines for
condominium development are nearing completion and he would not
favor granting relief.
Councilmen Gillanders, Merritt and Tyrell stated agreement with
Councilman Atkins.
City Attorney Martin advised the Planning Commission has made recom-
mendations relating to guidelines for condominium development and
City Council has set public hearing to consider those guidelines
October 20 If Council approves the recommendations, the process for
enactment of the appropriate ordinance will begin that night.
Councilman Atkins moved to deny application for relief from the
moratorium, seconded by Councilman Gillanders and carried.
The audience was advised a Study Session will be held October 1 on
the recommendations from the Planning Commission and anyone interested
in a copy of the proposed guidelines could obtain them at the City Halle

Councilman Tyrell moved to close public hearing in view of the fact a
new public hearing has been set October 2 for standards for condo -
minium conversion and new construction, seconded by Councilman Merritt
and carried.

80 :PUBLIC HEARING: TENTATIVE TRACT 36735, NORTH OF LOWER AZUSA ROAD,
BETWEEN HALIFAX AND ARDEN DRIVE
City Manager Koski presented background information stating the
Planning Commission, at their regular meeting held August 14, 1979,
adopted a resolution approving Tentative Tract No°. 36735 for a
50 -unit subdivision and certification of the Environmental Impact
Report=, A public hearing was held before the Planning Commission
in June when a zone variance for a 55 -lot subdivision was denied.
Alternative plans and a revised Draft Environmental Impact Report
were submitted to the Planning Commission and their approval was
for Exhibit "B" which provides access off Arden Drive and Halifax
via Key West Street, and Hallowell will dead end south of the subject
site. The average lot size is 7,702 sta ft, City Council, at their
regular meeting held August 21, 1979, set public hearing September 18.
Mayor Dennis declared the public hearing open. There was no further
staff report°
Mr. Geode Weigand, 8656 Huntington Drive, San Gabriel, in response
to Councilman Amens, stated he had read all the conditions of the
Planning Commission resolution and they are acceptable to him,
Councilman Tyrell moved to incorporate the Planning Commission minutes
and staff reports as a part of the record, seconded by Councilman
Gillanders and carried,
Mr,. dim Kamp, 5122 Halifax, stated he is happy to see the property
being developed, but is concerned with the increase in traffic
particularly in the proximity of Gidley School, and inquired what
provisions will be made for traffic control,
Mr, Kamp was advised that Exhibit "B" provides for a variety of
directions for traffic and that some traffic control will be provided,
depending on the distribution of traffic and the Traffic Engineer's
recommendation,
There being no one else come forward to speak, Councilman Merritt
moved to close the public hearing, seconded by Councilman Tyrell
and carried°
Councilman Tyrell moved that the revised Draft Environmental Impact
Report be amended to include the comments of those testifying at the
public hearing and responses thereto by incorporating a copy of the
minutes into the report; that the City Council certify the Environ-
mental Impact Report has been completed in conformance with the
California Environmental Quality Act and the State guidelines and
that the City Council has reviewed and considered the information
contained in the report; that the final E.I.R. is adequate and pro-
vides reasonable information on the project and all feasible alter -
natives thereto; and that each and every adverse environmental impact
contained in the amended report is overruled and counterbalanced by
economic and social needs, objectives, and concerns in providing
private or public improvements of municipal import, seconded by
Councilman Atkins and carried°
Councilman Tyrell moved to adopt Resolution No. 79 -1840 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE
TRACT NO, 36735, which resolution concurs with Planning Commission
resolution approving Exhibit "B" and setting forth conditions,
seconded by Councilman Tyrell and carried°
9. REQUEST FOR UNICEF DRIVE OCTOBER 31, 1979 - TEMPLE CITY MINISTERIAL
ASSOCIATION AND CHURCH WOMEN UNITED
City Manager Koski presented request from the Church Women United for
a permit to solicit funds for UNICEF October 31, 1979, together with
Council Minutes, September 18, 19.79 - Page 5
a letter from Dr, Marshall Ketchum, Ministerial Association
supporting their request, City also received a letter from Dr,
Ketchum today advising Father Craig Cox will be present and speak
on behalf of the Ministerial Association,
Father Cox advised that the Church Women United came to the Ministerial
Association and requested they co- sponsor the UNICEF solicitation.
Because of the history of the difficulties with this request, they
have tried to reply to some of the concerns and objections raised in
the past and to set forth reasons why this project is worthy of
consideration, The project does meet all of the conditions of the
City ordinance,
Councilman Merritt stated he has been against this particular project
primarily because he believes it is directly connected with the United
Nations, and their letter indicates Unicef is a separate entity. The
United States government has an extensive give -away program to other
governments and he, personally, feels there are a lot of people in
our own country who need helps
Father Cox indicated that he does not feel a dislike for a certain
organization is proper grounds for denying an application, parti-
cularly when they meet all the requirements of the code. Unicef
is for all children throughout the world, and the money raised is
not the entire benefit, in that he feels the children who solicit
are benefitted by their experience,
Councilman Tyrell stated that in past years he has had documents
illustrating funds were diverted to.governments rather than to
help children and no one has provided the Council with information
that the funds are, in fact, being received by the people they are
intended for In any event, he would not want to see a permit granted
for more than one year.
Father Cox responded that Unicef provides for directing gifts to a
particular project and provide personnel who see the proper use is
made of the money,
Councilman Atkins stated he agrees with Councilmen Merritt and Tyrell.
His concern is that when the money gets into the hands of Unicef local
control is lost, and he does not trust the United Nations,
Councilman Gillanders stated he agrees with the other Councilmen,
however, City Council is not being asked to give any money and he
feels the citizens of Temple City are capable of making their own
decisions, He would not approve a solicitation permit for longer
than one year,
Mayor Dennis stated Father Cox' presentation was excellent and he
feels any local group who wish to solicit funds for any purpose
should have the right to do so; that individuals will make their
own decision whether to donate or not and it is not up to the
City Council to make that decision for them.
Hazel Holthouse, 8835 E. Elm, President of Church Women United,
state that countries receiving funds from Unicef must match the
funds,
Councilman Tyrell moved to approve solicitation permit for UNICEF
for one year, the date being October 31, 1979, seconded by Council-
man Gillanders and carried,
Lucille Provine, 6238 Primrose, stated she is the current President

the Board for Church Women United and thanked the Council for their
approval of request to solicit funds for UNICEF,
Councilman Tyrell stated that prior to next fall he will personally
obtain as much information as possible as to whether the money to
Unicef is going where it is purported to be going.

10. APPEAL FROM PLANNING COMMISSION DECISION: ZONE VARIANCE CASE 79 -564

Councilman Tyrell moved to set public hearing October 2, 1979, to
consider appeal from Planning Commission denial of Zone Variance
Case 79 -564, seconded by Councilman Merritt and carried.
11. TENTATIVE PARCEL MAP N0L 574 - 6131 GOLDEN WEST AVENUE
City Manager Koski advised the Planning Commission, at their regular
meeting held August 28, adopted a resolution approving Tentative
Parcel Map No. 574 for a four unit condominium project. Because
of the opposition voiced at the public hearing, City Attorney Martin
advised the Commission recommend to the City Council approval of
subject map.
Councilman Tyrell moved to set public hearing,October 2, 1979,
seconded by Councilman Merritt and carried.
12, COMMUNICATIONS:
A, Claim for Damages - Luciene C. Edwards
City Manager Koski presented claim on behalf of Luciene C. Edwards
for injuries and damages alleged to have occurred August 1, 1979.
Councilman Tyrell moved to deny and and refer to JPIA, seconded by
Councilman Atkins and carried.
B, Oak Tree Racing Association - Request for Directional Signs
City Manager Koski presented a request from Oak Tree Racing
Association for directional signs at six locations throughout the
City from October 5, 1979 to be removed following the Santa Anita
Meeting April 7, 1980. Councilman Atkins moved to approve request,
seconded by Councilman Gillanders and carried.
Councilman Tyrell requested the Traffic Engineer investigate and
make a recommendation for additional signing at the intersection of
Holly and Live Oak Avenue for Council review October 2, 1979,
C. White Cane Days, October 5 & 6 - Camellia Lions Club
Temple City Host Lions Club
City Manager Koski presented a request from Camellia Lions Club and
Host Lions Club to place a banner across Las Tunas Drive and Temple
City Boulevard October 5 and 6, 1979, Councilman Merritt moved to
approve subject to the required Certificate of Insurance, seconded
by Councilman Atkins and carried,
13., TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Ni, Lois Yount, requested an explanation of the relief based on
hardship rom the moratorium on condominium construction, stating
the relief granted her did not give any relief.
Mayor Dennis explained that if relief was granted under the moratorium
the applicant could continue to process the application for the
development in its normal manner without being held up by the mora-
torium. The plans could be submitted to the County Subdivision Com-
mittee, the Building Department for checking, and to the Planning
Commission for review with either approval or denial. The granting
of a relief did not guarantee the project would be approved,

City Council recessed at 9:04 p.m. to meet as the Community Redevelopment
Agency, all members being present; approved the minutes of the regular

meeting held August 21, 1979 and adopted resolution approving warrants and
demands. The minutes are set forth in full in the records of the Agency,

III5. MATTERS FROM CITY OFFICIALS:

A. Annual ICMA Conference, Phoenix, Arizona - October 21 -25, 1979
Councilman Merritt moved to approve City Manager's attendance to
the ICMA Conference to be held in Phoenix, Arizona, October 21 -25
and authorize necessary expenses, appropriate additional funds in
the amount 'of $1,075,00 and amend the adopted budget accordingly,
seconded by Mayor Dennis and carried.
Bo Staff Pool Vehicle
Councilman Gillanders moved to approve specifications for staff
pool vehicle and authorize advertising for bids, seconded by Mayor
Dennis and carried.
C.- Mayor Dennis advised he has signed a Proclamation declaring
- October 4, 1979 "Pop Gunst Day" in Temple City.
D. Rosemead Boulevard and Emperor Avenue - Crossing Guard Study
Councilman Atkins moved to accept the recommendation of the Traffic
Engineer based upon warrants to discontinue the use of an adult
crossing guard at the signalized intersection at Rosemead Boulevard
and Emperor Avenue.
E, Councilman Tyrell moved to introduce Ordinance.Noo 79 -480 AN
ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTIONS 4253 AND
4254 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO NEWS RACKS by
title only, seconded by Councilman. Atkins and carried.
F. Councilman Tyrell directed Council's attention to the letter
received from Linda Blackmore thanking Council for making Temple City
such a nice place to live,
Councilman Tyrell directed Council's attention to the minutes of
the Chamber of Commerce legislative conuuittee and requested Council
support their position on AB 759, Unemployment Insurance, and
AB 66, Litter Tax and Inventory Tax Bill.
G, Mayor Dennis advised he had been interviewed on Tom Frandsen's
Show which will air at 6 a.m. Wednesday, September 26th and 6.30 a.m.
Thursday, September 27th.

On motion by Councilman Merritt, seconded by Councilman Atkins,
meeting adjourned at 9:20 p.m. Next regular meeting of the City
Council will be held Tuesday, October 2, 1979, 7:30 p.m. in the
Council Chamber of the City Hallo
