RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
JOHN B. LUNSETH II
WHEREAS, John B. Lunseth II (Applicant) has applied for a conditional use
permit for a dog kennel on his property at 2192 Medina Road, which is legally
described as Lot 1, Block 2, Hollybush Hills, Hennepin County, Minnesota; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission on July
14, 1987, and by the City Council on August 4, 1987; and
WHEREAS, it has been determined that the existence of the dog kennel will
not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicant for the
stated purpose, subject to the following terms and conditions:
1. It is acknowledged that the kennel is for the Applicant's personal
use for his English Pointers, English Setters and German Wirehaired
Pointers and that no commercial use shall be made of the structure;
2. The maximum number of dogs of breedable age to be kept on the
property shall be six. Any number of dogs under the age of six
months may be kept on the property provided they are the offspring
of dogs legally on the property;
3. There shall be six runs, which shall not exceed 400 square feet and
shall conform to the plans submitted by the Applicant. The kennel
shall be no closer to any property line than 150 feet and shall be
designed to minimize the noise of barking dogs;
4. The Applicant shall maintain accurate records regarding the date,
number, sire and dam of each litter whelped or maintained on the
property and make such records available for inspection by city
statt at reasonable times;
5. Hours of operation shall be 24 hours per day, 7 days per week;
6. All waste material shall be disposed of in accordance with the
ordinances of the City and the regulations of the Minnesota pollu-
tion control agency;
7. The Applicant shall take irni ediate and appropriate action to abate
any nuisance caused by barking dogs on the property. For this
purpose, a nuisance shall include, but not be limited to, 10 minutes
of continuous barking;
8. No dogs shall be sold or used for experimental purposes;
9. The Applicant shall submit an accurate site plan acceptable to the
zoning administrator which shows all structures, fences and dog runs
on the property;
10. The Applicant shall maintain all dogs in accordance with the
standards of the Minnesota purebred dog breeders association;
11. The propane tank and windmill currently located on the property
shall be removed;
12. The Applicant shall bring the gas tank on the property into
compliance with all applicable codes and regulations following
inspection of same by city officials;
13. The 10' x 24' accessory structure and the 16' x 40' accessory
structure currently located on the property shall be removed;
14. The 10' x 30' accessory structure located on the west side of the
garage shall be removed or brought into compliance with all
applicable codes and regulations;
15. The Applicant agrees to take whatever steps may be necessary to
reduce outside visual stimuli for the dogs in the kennel if
excessive barking becomes a problem;
16. The City shall conduct an annual review of the property to ensure
continued compliance with the terms and conditions of this permit;
and
17. The Applicant shall pay to the City a tee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
