HomeMy Public PortalAbout1987-074Member its adoption: 5c.1e-r�f introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. lY 7 % RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO FORTUNA FARM WHEREAS, Karen and Max von Bluecher, d/b/a Fortuna Farm (Applicant) has applied for a conditional use permit for a horse boarding, breeding and training stable at 1425 Tamarack Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on July 14, 1987, and by the City Council on August 4, 1987; and WHEREAS, it has been determined that the existence of the described facility will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. It is acknowledged that the proposed accessory structure, which is 24' x 40', brings the total square footage of accessory buildings on site, including the existing railroad boxcars, to 25,700 and does not add to the total square footage due to the removal of another building from the property; 2. It is acknowledged that all accessory structures on site are at least 150 feet from all property lines; 3. The Applicant shall dedicate to the City the right-of-way along Tamarack Drive and Deerhill Road required by the city engineer; 4. The Applicant shall remove the building being replaced by the new 24' x 40' accessory structure within three years of the date of this resolution; 5. The maximum number of horses which may be kept on site is 60; 6. No new toilet facilities shall be added in the accessory buildings and portable sanitary facilities shall be used during horse events held on site; 7. There shall be a maximum of six employees on site; 8. Employee parking shall be located at the existing arena area; 9. Any permanent signs on site shall comply with the requirements of the City's zoning ordinance for residential districts; 10. The public address system may be used during a maximum of eight events per year; 11. There shall be no outside storage of equipment except licensed vehicles and customary farm implements; 12. The hours of operation shall be limited to 6:00 a.m. to 10:00 p.m., 7 days per week; 13. It is acknowledged that the existing exterior lighting may be used provided it is acceptable for residential use; 14. The Applicant shall hold no more than eight events per year on the site and shall give the City prior notice of each event; 15. The Applicant shall maintain all fencing on site in good condition; 16. There shall be no living quarters in any of the accessory struc- tures; 17. Parking for events shall be provided on the property whenever possible. If weather conditions make on site parking impossible, parking may be allowed on the street if previously authorized by the City; 18. There shall be no food service on the property except for special catered events; and 19. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
