CITY OF MEDINA
RESOLUTION NO. Y 7- 73-
RESOLUTION GRANTING PRELIMINARY
APPROVAL OF A SUBDIVISION
FOR MIDWEST COMMUNICATIONS, INC.
WHEREAS, Midwest Communications, Inc. (Applicant) has requested approval
of a plan to subdivide a parcel into two lots according to the survey attached
hereto as Exhibit A, which property is legally described in Exhibit B; and
WHEREAS, the planning commission and city council have reviewed the
preliminary plat submitted by the Applicant.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that preliminary approval is granted to the Applicant for his
subdivision, subject to the following conditions:
1. The city staff shall review the need for a drainage easement and the
Applicant shall dedicate such easement as may be required;
2. It is acknowledged that no park dedication fee is required because
the new parcel is in excess of 10 acres in size;
3. Any animal structure to be built on the new parcel shall be located
at least 150 feet from all property lines;
4. The Applicant shall execute an easement 80 feet in width for roadway
and utility purposes in the area shown on Exhibit C attached hereto
prior to final subdivision approval;
5. The Applicant shall dedicate to the City the right-of-way for Medina
Road if said right-of-way has not been dedicated previously;
6. It is acknowledged that the new parcel meets the soils requirement
for one residential building site;
7. The Applicant shall pay to the City for administrative expenses the
amount determined by the city staff to represent the actual cost to
the City of reviewing the subdivision;
8. The Applicant shall submit a current abstract of title or registered
property abstract covering all land within the subdivision for
review by the city attorney; and
9. The Applicant shall submit the final plat to the City for approval
within 180 days of the date of the adoption of this resolution,
which final plat shall in all material respects conform to the
preliminary plat, except that it shall incorporate all changes and
modifications required by this resolution.
