HomeMy Public PortalAbout15867 Newport Landing Pump Station (P-480) Elimination (12357)ORDINANCE NO. 15867 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Newport Landing Pump Station (P-480) Elimination (12357) in Unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Unincorporated St. Louis County, Missouri within the Lower Meramec Watershed wherein numerous people live and work; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Newport Landing Pump Station (P- 480) Elimination (12357) hereinafter set forth, said easements being more particularly described below: Parcel #1 A 10-foot-wide permanent sewer easement across part of the Adjusted Common Ground of the Boundary Adjustment Plat of Lot 177 of The Estates at Williams Creek Plat One, a subdivision according to the plat thereof recorded in Plat Book 362, Pages 70 and 71 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10-FOOT-WIDE PERMANENT SEWER EASEMENT COMMENCING at the Northeast corner of Lot 189 of The Estates at Williams Creek Plat One, a Subdivision according to the plat thereof recorded in Plat Book 354 on Pages 1011-1014 of the St. Louis County, Missouri Recorder’s Office; THENCE along the Northeastern line of said Lot 189, North 63 degrees 22 minutes 50 seconds West a distance of 48.42 feet to a point; THENCE departing the Northeastern line of said Lot 189, North 26 degrees 37 minutes 10 seconds East, a distance of 27.63 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 foot wide permanent sewer easement; THENCE along said centerline the following courses and distances: North 41 degrees 26 minutes 34 seconds East, a distance of 111.29 feet to a point, South 56 degrees 50 minutes 22 seconds East, a distance of 46.01 feet to a point, North 66 degrees 32 minutes 53 seconds East, a distance of 157.20 feet to a point and North 80 degrees 45 minutes 48 seconds East, a distance of 98.83 feet to the POINT OF ENDING of the centerline of said 10 foot wide permanent sewer easement, said point being on the South line of Common Ground and Easement “B” of Summer Chase Second Addition Phase One, a Subdivision according to the plat thereof recorded in Plat Book 324 on Pages 87 and 88 of the St. Louis County Recorder’s Office, said point also being distant along said South line, South 89 degrees 32 minutes 18 seconds East a distance of 16.23 feet from the Southwest corner of said Common Ground and Easement “B”. Excepting therefrom the existing 10-foot-wide easement as shown on said Plat of The Estates at Williams Creek Plat One. Also, two temporary construction easements for the use during the construction, in the above- described permanent sewer easement, said temporary construction easements being more particularly as follows: TEMPORARY CONSTRUCTION EASEMENT NO. 1 COMMENCING at the Northeast corner of the aforementioned Lot 189; THENCE along the Northeastern line of said Lot 189, North 63 degrees 22 minutes 50 seconds West a distance of 48.42 feet to a point: THENCE departing the Northeastern line of said Lot 189, North 26 degrees 37 minutes 10 seconds East, a distance of 27.63 feet to a point; THENCE North 58 degrees 20 minutes 16 seconds West, a distance of 5.07 feet to the ACTUAL POINT OF BEGINNING of the herein described Temporary Construction Easement No. 1; THENCE North 58 Degrees 20 minutes 16 seconds West, a distance of 20.29 feet to a point; THENCE North 41 degrees 26 minutes 34 seconds East, a distance of 137.22 feet to a point; THENCE South 56 degrees 50 minutes 22 seconds East, a distance of 54.17 feet to a point; THENCE North 66 degrees 32 minutes 53 seconds East, a distance of 128.43 feet to the South line of Common Ground and Easement of Summer Chase Second Addition Phase Three, a Subdivision according to the plat thereof recorded in Plat Book 337 on Pages 28 and 29 of the St. Louis County Recorder’s Office; THENCE along said South line, South 89 degrees 32 minutes 18 seconds East, a distance of 91.86 feet to a point; THENCE departing said South line, South 80 degrees 45 minutes 48 seconds West, a distance of 70.19 feet to a point; THENCE South 66 degrees 32 minutes 53 seconds West, a distance of 155.13 feet to a point; THENCE North 56 degrees 50 minutes 22 seconds West, a distance of 47.64 feet to a point; THENCE South 41 degrees 26 minutes 34 seconds West, a distance of 116.48 feet to the POINT OF BEGINNING. Excepting therefrom the existing 10-foot-wide easement as shown on said Plat of The Estates at Williams Creek Plat One. TEMPORARY CONSTRUCTION EASEMENT NO. 2 COMMENCING at the Northeast corner of the aforementioned Lot 189; THENCE along the Northeastern line of said Lot 189, North 63 degrees 22 minutes 50 seconds West a distance of 48.42 feet to a point; THENCE departing the Northeastern line of said Lot 189, North 26 degrees 37 minutes 10 seconds East, a distance of 27.63 feet to a point; THENCE South 58 degrees 20 minutes 16 seconds East, a distance of 5.07 feet to the ACTUAL POINT OF BEGINNING of the herein described Temporary Construction Easement No. 2, THENCE North 41 degrees 26 minutes 34 seconds East, a distance of 106.10 feet to a point; THENCE South 56 degrees 50 minutes 22 seconds East, a distance of 44.38 feet to a point; THENCE North 66 degrees 32 minutes 53 seconds East, a distance of 159.27 feet to a point; THENCE North 80 degrees 45 minutes 48 seconds, East, a distance of 125.16 feet to a point; THENCE North 01 degrees 02 minutes 26 seconds West, a distance of 0.39 feet to the South line of Common Ground and Easement “B” of Summer Chase Second Addition Phase One, a Subdivision according to the plat thereof recorded in Plat Book 324 on Pages 87 and 88 of the St. Louis County Recorder’s Office; THENCE along said South line, South 89 degrees 32 minutes 18 seconds East a distance of 20.01 feet to a point; THENCE departing the South line of said Common Ground and Easement “B”, South 01 degrees 02 minutes 26 seconds East, a distance of 17.19 feet to a point; THENCE South 80 degrees 45 minutes 48 seconds West, a distance of 139.99 feet to a point; THENCE South 66 degrees 32 minutes 53 seconds West, a distance of 167.55 feet to a point; THENCE North 56 degrees 50 minutes 22 seconds West, a distance of 37.85 feet to a point; THENCE South 41 degrees 26 minutes 34 seconds West, a distance of 85.36 feet to a point; THENCE North 58 degrees 20 minutes 16 seconds West a distance of 20.29 feet to the POINT OF BEGINNING. Excepting therefrom the existing 10-foot-wide easement as shown on said Plat of The Estates at Williams Creek Plat One. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on March 10, 2022.
