HomeMy Public PortalAbout1979-10-02 Public HearingPUBLIC HEARING October 2, 1979 The Public Hearing was called to order at 5:15 P.M. Tuesday, October 2, 1979 in the Village Hall. Present: Miss Gray and Messrs. Beatty, Krez and Printup Absent Mr. Taplin Also present were Fred W. Maley, Village Manager, Mary T. Wetterer, Village Clerk, and Alan S. Gold, Village Attorney. Mr. Maley explained that this is the second hearing to establish a millage 6.87% over the certified millage. As there were no comments from thos present Resolution No. 268 setting the millage at 5.65 mills was read by the Village Clerk. On motion of Mr. Beatty, seconded by Miss Gray and voted the Resolution was adopted. At 5:25 P.M. the Public Hearing was adjourned and the council con- vened a Special Meeting with the same members present for the purpose of discussing the bid for the village hall addition with the low bidder, and other urgent matters. Mr. Frasure Knight, architect, reviewed the three bids that had been submitted and said that Mr. Kennedy had submitted the Affidavit regarding a requested change in his bid as requested at the previous council meeting. Mr. Maley read the contents of the Affidavit to the council. Mr. Gold said he had previously thought that the Affidavit would take care of the matter, but he regrets to report that the law is quite clear in that it advises that a bidder on a public project may not change a bid except to clear minor irregularities. He said the village has no choice, but must readvertize for new bids. After discussion in which Mr. Maley said he had hired an electrical estimator who confirmed that the new electrical bid, which is the basis for Mr. Kennedy's request for a bid change, was correct, it was moved by Mr. Krez, seconded by Mr. Beatty and voted that all bids received on September 21, 1979 be rejected and that new bids will be accepted at 9:30 A. M. on October 30, 1979. Mr. Kennedy said he would rebid the job with the additional amount included for the electrical work. Mr. Maley said that the City of Miami Beach is withdrawing con- sideration of the Water Agreement from tomorrow's agenda and will place it on the agenda for October 17th so that Bal Harbour and Bay Harbor Islands can discuss the matter at greater length. He explained that there is an error in the figures Mr. Silverman submitted regarding the water used from October 1, 1978 to September 30, 1979. Also details must be considered concerning surcharge fees and other costs. It was agreed that as soon as final details can be worked out that Bal Harbour and Bay Harbor Islands hold another joint meeting so that a preagreed upon Agreement will be presented to Miami Beach. October 2, 1979 Mr. Maley explained that during a recent power failure Florida Power and Light Company replaced the cable from the vault across Bal Bay Drive to the Village Hall. He said the Power Company is willing to charge only for labor if the Village will grant them an easement from the Village Hall to the vault. It was moved by Mr. Kres, seconded by Miss Gray and voted that Florida Power and Light Company be granted the requested easement. On motion of Miss Gray, seconded by Mr. Beatty and voted the meeting was adjourned at 6:10 P.M. Attest: Village Clerk Mayor October 2, 1979 COUNCIL MINUTES October 15, 1979 A Special Meeting of the Council was held in conjunction with Bay Harbor Islands in the Bay Harbor Islands Council Chambers at 7:30 P.M., Monday October 15, 1979, to finalize the Contract between Towns, Dade County Water & Sewer Authority, and the City of Miami Beach. Present: Messrs. Beatty, KREZ, Printup and Miss Gray Absent: Mr. Taplin Also present were Fred Maley, Village Manager, Mary Wetterer, Village Clerk, and Alan Gold, Village Attorney. Present from Bay Harbor Islands were: Messrs, Gardner, Goldsmith, Nelson, Rauch and Shapiro Mr. Horwotz and Mr. Gold explained the terms of the settlement outlined in the Contract which provides that the Water and Sewer Authority will build a 24" main from the 75th Street pump house to Bal Harbour to serve the towns until a 30" main is built across the Broad Causeway, which is to be in service by June 24, 1987; until the 24" line is in operation the Towns will pay 140% of the rate per thousand gallons charged Miami Beach by the Authority; and Bal Harbour and Bay Harbor Islands will pay Miami Beach $355,209.00 from existing escrow funds for water used since October 1, 1972. Mr. Warren Silverman, CPA, advised that the rate structure was fair and the contract guarantees rates, supply and finally when the line is built we will be serviced by the Authority.
