HomeMy Public PortalAbout1987-095Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. J77.. RESOLUTION GRANTING A VARIANCE FOR CONCO, INC. WHEREAS, Conco, Inc. (Applicant) has requested a variance to build a single family house at 890 Co. Rd. 24 on a lot which is one-half acre in size; and WHEREAS, Section 825.13 of the City's zoning ordinance allows the use of a lot as small as one acre in area if certain conditions are met; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request and has recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding the request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance be granted because the property has been in continuous separate ownership since the adoption of the one acre minimum requirement and there exists no undeveloped adjacent property which may be combined with this lot, subject to the following conditions: 1. It is the intent of the City not to grant any setback variances for construction of a house on the lot; r Dated: ATTEST: 2. The house constructed on the lot may contain no more than two bedrooms and use a mount septic system which may be located within five feet of the lot line; 3. The Applicant shall dedicate to the City the right-of-way for Co. Rd. 24 if city staff determines a need for same; and 4.
