HomeMy Public PortalAboutOrdinance NO. 453 Adopting a Revised Official Zoning Distric Map of the Town of Fraser TOWN OF FRASER, COLORADO ORDINANCE NO. 453 SERIES 2018 AN ORDINANCE ADOPTING A REVISED OFFICIAL ZONING DISTRICT MAP OF THE TOWN OF FRASER WHEREAS, the Town of Fraser is a Colorado municipal corporation governed by its Mayor and Board of Trustees; and WHEREAS, the Board of Trustees is authorized by C.R.S. § 31-23-101 et seq. to adopt and enforce regulations for the preservation of the public health, safety and welfare, including regulations governing the zoning, subdivision and development of land; and WHEREAS, the Board is also authorized to adopt this ordinance pursuant to state law, including but not limited to C.R.S. § 24-67-101 et seq. and 31-16-101 et seq.; and WHEREAS, the Board of Trustees has adopted a new Chapter 19 of the Fraser Municipal Code, designed to replace in their entirety present Chapters 15, 16 and 17, and Article 4 of Chapter 18 concerning the use and development of land within the corporate boundaries of the Town, including regulations for the subdivision of land; and WHEREAS, in connection with adoption of the new Chapter 19, the Town has caused to also be prepared a revised Zoning Map for the Town, depicting certain changes in zone district boundaries, the renaming of certain zone districts, and the creation of the Open Space District and two new overlay zone districts — the Victoria Village and Riverwalk Mixed Use Overlay districts; and WHEREAS, the Fraser Planning Commission, after notice and hearing, has recommended the Board of Trustees adopt the revised zone district map; and WHEREAS, on February 28, 2018 and March 21, 2018, the Board of Trustees conducted a properly noticed public hearing on the revision of the Fraser Zoning Map; and WHEREAS, it is the opinion and finding of the Board of Trustees that the revision of the Official Zoning District Map of the Town of Fraser, attached hereto as Exhibit A, is in the best interests of the public health, safety and welfare of the Town and should be adopted. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO: Section 1. The Board of Trustees hereby adopts the revised "Official Zoning District Map of the Town of Fraser," in the form attached hereto as Exhibit A, with such additional technical corrections as approved by the Town Adminsitrator and Town Planner for boundary clarity, format, numbering, and internal consistency. Section 2. Severability. If any section, paragraph, sentence, clause, or phrase of this Ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board of Trustees hereby declares that it would have adopted this Ordinance and each part or parts hereof irrespective if any one part or parts hereof be unconstitutional or invalid. Section 3. Repeal of inconsistent ordinances. All other ordinances or portions thereof inconsistent or conflicting with this Ordinance or any portion hereof, are hereby repealed to the extent of such inconsistency or conflict. Section 4. Effective Date. This Ordinance shall take effect thirty (30) days after passage, adoption and publication by title only, as provided by law.
