It is understood that if this permit is granted the builder will at all times comply with the zoning,subdivision,flood control,building,fire,
soil and sedimentation,wetlands,marshlands protection and shore protection ordinances and codes whether local,state or federal,including
all environmental laws and regulations when applicable,subsequent owners should be informed that any alterations to the property must be
approved by the issuance of another building permit. Permit holder agrees to hold the City of Tybee Island harmless on any construction
covered by this permit.
This permit must be posted in a conspicuous location in the front of building and protected from the weather. If this permit is not posted
work will be stopped. The building contractor will replace curb paving and gutter broken during construction. This permit will be voided

Dear Mr. Crum:
Please accept this letter in reference to the permit that your company obtained for the dune crossover for the Tybee
Straits Homeowners Association.This was permit#10-0028.After taking a tour of the completed site on August 11, 2010
and consulting with the Building Official, I have several concerns that need to be addressed and since the permit was
issued to Brannen Construction,then the responsibility is to your company.
The first concern with this project is that there are no handrails along the crossover, which is a safety issue that needs to
be addressed immediately. It is my understanding that this is a private crossover but that does not exempt it from
building regulations of the City of Tybee Island.
In addition,the constructed grade on this crossover appears to be abnormally steep and at such an angle that would
endanger the safety of those who use the crossover.There are two options that could abate this concern: reconstruct
this crossover in such a way as to significantly reduce the slope or submit a letter from the Tybee Straits Homeowner's
Association that releases the City of Tybee Island from any liability with this project if it is the will of the association to
maintain the crossover in its current condition.

The DNR LOP includes the following sentence: 'This Letter of Permission is not meant to exempt the above
referenced activity from future environmental laws. This project must comply with all other Federal, State,
and local statutes, ordinances and regulations."
The applicant must go through your office and meet your requirements. I discussed the ramp and
steepness. I told them they could get a better slope if the lengthened the ramp down the existing
sidewalk, but they did not want to. I told him our law does not speak to ADA compliance but the City of
Tybee may have requirements. I told him that many times local laws are more strict than state. If you
require the removal or redesign of the ramp I will need to work with him to get a new authorization from
the state.

Attached is the letter of permission for the crosswalk at Tybee Straits. The work has been completed. From
the City's view, the ramp on the landward side is extremely steep and the handrails do not meet code
because they are too wide for someone to grip.The LOP says the crosswalk could be used by motorized
wheelchairs for handicapped persons but coming down that incline would be very dangerous.The
reason for my email is to ask if DNR-approved projects are exempt from building codes? We are in a
tough position because the City permits the work but it is not built to code so it can't pass inspection. Is
there a disclaimer that the DNR could provide to the City that would exempt DNR-approved projects from
the building codes that the City of Tybee Island has adopted and enforces?

Asbestos/Environmental Notification to Georgia EPD for
Projects Involving Demolition,Wrecking, or Renovation
The undersigned hereby acknowledges that the issuance of this permit does not in any way grant
permission to the owner, owner's representative, or permit holder to proceed with demolition,
wrecking, or renovation of a structure prior to the filing of any required ten (10) day "Project
Notification for Asbestos Renovation Encapsulation or Demolition" form in accordance with
the Georgia Asbestos Rules. The Georgia Environmental Protection Division administers the
rules. In most cases, the rules require both the owner and the involved contractors to assure the
portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos
Inspector for materials that contain asbestos; and the removal of the asbestos before renovation,
wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed
demolition notification from be submitted 10 workings days in advance even if no asbestos is
present in the building. Further guidance for regulatory compliance and contact telephone
numbers are provided by the brochures entitled Asbestos & Renovation and Asbestos and
Demolition. Other environmental issues such as asbestos removal techniques, lead abatement,
ground contamination, or unusual site conditions may have EPD regulations that could affect the
project.

In addition to specific requirements for the above permits and approvals, applicants must
demonstrate that they are in compliance with the City of Tybee Island Storm Water Management
requirements as outlined in Chapter 5-4, Code of Ordinances.
Section 5-4-9 Prohibition provides, in part, as follows:
(4.) It is unlawful for any person to cause or permit any storm water to flow from their
property onto the property of another person, unless such storm water naturally
flowed thereon prior to any development activity.
(5.) It is unlawful for any person to interrupt the flow of any stoini water runoff from
adjacent property onto their property by any development activity.
As part of the City's approval process applicants must illustrate how these storm water
management prohibitions will be met, including a showing of how storm water naturally flowed
on the affected property (prior to any development activity), and what changes in stoiiu water
flow have occurred or are expected to occur, as attachments to this form. The City's approval or
permit does not guarantee that the applicant's plans will result in meeting requirements. The final
product must actually meet the City Ordinance requirements.

RE: Letter of Permission (LOP), Shore Protection Act Permit#162,Extension of existing
Community Crosswalk, Tybee Straits, 11th Place, Tybee Island, Chatham County,
Georgia
Dear Mr. Crum:
This Letter of Permission (LOP) is in response to your recent request to extend the crosswalk at
11th Place, Tybee Island, Chatham County, Georgia. Shore Protection Committee Permit#162
authorized the construction and maintenance of the crosswalk currently existing at Tybee Straits.
The proposed work includes the extension of the crosswalk with some alteration needed at the
seaward landing of the crosswalk to extend the crosswalk beyond the dune field and onto the dry
sand beach just seaward of the toe of the most seaward dune. The plan includes a very slight
angling northward of the seaward landing to avoid a larger vegetated dune. The City's trash can
and pole currently in the dunes will be relocated to the seaward toe of the dune. The crosswalk
will be elevated at a minimum of three feet above the existing sand dunes. The proposed work
will be done from the crosswalk using hand tools only and no stock piling of materials is
proposed in the dunes. No motorized vehicles are proposed on the crosswalk structure, except for
motorized wheelchairs for handicapped persons.
Staff has conducted an onsite inspection of the crosswalk. The dunes have increased in height
over time and the crosswalk, although serviceable, is no longer elevated above the dunes or dune
vegetation. The crosswalk will provide access for the residents of Tybee Straits to enjoy the
public trust resources of the state while protecting the dynamic dune field.
The Department authorizes the proposed maintenance and extension of the crosswalk located at
Tybee Straits as depicted by the attached drawings and description. The Department authorizes
the elevation and extension and considers this construction necessary for normal maintenance in
full compliance with Shore Protection Committee Permit#162.

No vegetation is to be disturbed beyond the limits of the project during construction. Any
incidental impacts to the dunes or vegetation must be restored to pre-project vegetated and
topographic conditions, any backfilling must be beach quality and obtained from an upland
source and not from the beach. The elevation of the crosswalk must be three feet above the dune
vegetation to allow for sand movement. The crosswalk must be extended beyond the most
seaward dune and end landward of the ordinary high water mark. All construction must comply
with Department of Natural Resources Sea Turtle Guidelines. Please contact staff to meet you
on site and determine the exact landing of the crosswalk on the seaward side of the dune
immediately prior to construction.
This Letter of Permission is not meant to exempt the above referenced activity from future
environmental laws. This project must comply with all other Federal, State, and local statutes,
ordinances and regulations.

Dear Mr. Burgess,
I represent Tybee Straits Homeowners Association in asking for this permit to
modify an already existing sand dune cross over that is need of repair. There are 20
homes in the Tybee Straits community.
Tybee Straits is located in Chatham County, 11th Place, Tybee Island, Georgia.
Tybee Straits has a private community walk-over to the beach. A portion of the existing
walk-over is in need in repair and/or is covered in sand. Two years ago the largest
portion of the walk-over was resurfaced and this will be the final leg of the project.
The current project will include building a new walk way over the existing one.
The new walk way will be above the dune and extend to the outer most sand dune
towards the beach. The original foot print of the walk way will not change.
The walk way will be approximately five foot wide with a railing on each side.
On the west side, the construction will be attached to the existing walk way. On the
eastern side the walk way will ramp down to the dune where numerous posts are located
that City of Tybee Island has garbage cans attached to. This is considerably above the
high tide mark and would be commensurate with other walk ways nearby.
Enclosed you will find a drawing showing a section of new walk way that is
approximately 106 feet long,that as stated will be above an existing walk way that is
nearly totally covered with sand. The existing walk way will not be removed and the
dunes will not be disturbed. As depicted in the drawing, an additional 45 feet of ramp
will then lead down to the edge of the beach.
