RESOLUTION GRANTING A
VARIANCE FOR FRANK NIESEN
WHEREAS, Frank Niesen (Applicant) has requested variances to build on a
lot which contains 7,600 square feet and to reduce the rear yard setback for a
house on the lot to 25'; and
WHEREAS, Section 826.35 of the City's zoning ordinance requires that lots
such as the Applicant's contain a minimum of 9,000 square feet; and
WHEREAS, Section 826.57 of the City's zoning ordinance requires that
structures maintain a minimum rear yard setback of 30 feet; and
WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat.
Section 462.357 require that variances from the strict interpretation of the
zoning ordinance be granted only when there is a demonstrated hardship because
of circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicant's request and
has recommend approval thereof; and
WHEREAS, the City Council has had an opportunity to review the matter and
to hear from the Applicant regarding his request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the Applicant's request for the following variances is granted:
1. Reduce minimum lot size from 9,000 square feet to 7,600 square feet; and
2. Reduce minimum rear yard setback from 30' to 25'
due to the hardships that there is no additional land to be added to the
Applicant's lot, the Applicant has already paid a sewer assessment for the
property and that the allowed rear yard setback reduction will be consistent
with the development of neighboring lots. The variances are granted subject
to the condition that the Applicant maintains a minimum side yard setback for
the house of 15' in order to offset the decrease in openness on the property
resulting from the variances hereby granted.
