This permit must be posted in a conspicuous location in the front of building and protected from the weather. If this permit is not posted
work will be stopped. The building contractor will replace curb paving and gutter broken during construction. This permit will be voided
unless work has begun within six months of the date of issuance.

RE: Letter of Permission (LOP), Chatham Tybee Investors,LLC, Dune Path, Lot 3,
Twelfth Terrace, Tybee Island, Chatham County, Georgia.
Dear Mr. Mock:
This Letter of Permission(LOP) acknowledges your request to maintain a 3' wide path through
the state's jurisdiction under the Shore Protection Act. O.C.G.A. 12-5-230 et. Seq. The purpose
is to provide pedestrian access through the walking easement on Lot 4 extending into the
vegetated dune area and ending at the dry sand beach. After several onsite meetings, staff has
discussed the location and maintenance of the path. Staff has identified this area to be a fragile
and important habitat for many birds and other wildlife. A path instead of a crossover is
recommended by the Department through this area due to the thick vegetative growth and
presence of wildlife in the area. The path will meander through the vegetation avoiding
significant trees and habitat and allowing for the growth of a canopy over the path.
The Department authorizes the maintenance of a 3' wide pedestrian path 7' in height through the
existing vegetation at the location shown on the attached drawings. The Department requires
that the path be maintained using hand tools only. No heavy equipment may be used. No
vehicular access is authorized. The Department requires that staff be on site to flag the footprint
of the path before maintenance begins.
This Letter authorizes the maintenance of the path in the exact footprint. No alterations of the
location or dimensions of the path may be done without prior approval from the state. You must
use all appropriate best management practices to protect the habitat and dune system. All debris
must be removed from jurisdictional areas. Any incidental impacts associated with this project
must be rectified by fully restoring areas to their pre-construction topographic and vegetative
states. If sand is needed to restore the project site, it must be of beach quality obtained from an
upland source rather than from the beach or dune system. You may be required to demonstrate
proof of upland sand acquisition.
The Letter of Permission (LOP) is not meant to exempt the above referenced activity from future
environmental laws. This LOP may be revoked or deemed void should legal and/or
environmental conditions change in the future. This project must comply with all other Federal,
State, and local statutes, ordinances and regulations. Please notify the Department within 30

Dear Ms. Thran
Thank you very much for meeting with me to discuss our easement and getting access to
the beach.
Attached is our copy of the deed and the plat for you to review. The existing easement
we already have is marked for you in yellow.
We are requesting from the DNR permission to hand cut and trim the existing foliage a
path 36 inches wide and 7 feet tall maximum that will lead to another existing path so we
can have access to the beach. We will haul off the debris that will be hand carried to our
pickup truck.
Currently,Mr. Randy Booker has chains up and a no trespassing sign's over our existing
easement and we or our tenants are able to access the public beach.
Please let me know if you can help us getting this matter resolved.
