Date of Adoptiofl AlJCUST 7, 2 8 SUPPORTING ASSEMBLY BILL A-2868 WHEREAS, Assembly Bill A-2868; released by the Assembly Law and Public Safety Committee, amending NJ.SAOA:14-147 and NJ.S.IIA:3-5, would make chief of police contractual municipal employees and will require peer review and performance evaluation. b;y the Attorney General or a designee for contract renewal after three years; mid \VHEREAS, -as such, under A-2868, chiefs of police can only be removed . from office for incapacity, misconduct, or disobedience according to the rules and iegulations of the police department and the hiring of chiefs of police would be for a period of three years in which the chief will be reappointed 'after serving three years unless the municipality decides the chief is deficient according to the performance evaluation committee. WHEREAS, Assembly Bill A-2868, would state that the perfOlmance ev.aluation would be based on the (I) managing of day io day routil)e operations of the municipal police department that is required by NJ.SAOA:14-118; (2) the implementation of the proper policies of the appropriate authority; (3) compliance with the nlles and regulations required for the police department and force; (4) whether the chief of police is followiug particular law enforcement; and (5) the size of the police department or force, the population of the municipality, and the crime rate. 'VHEREAS, A-2868, the performance evaluation will he provided to the chief in writing at least six months prior to expiration of the contract while the committee is also required to hold a public hearing in which citizens may testify regarding the performance of the chief and the fmal e'la1uation of performance shall be determined and supported by a majority ?fthe committee; and WHEMAS, the New Jersey ,Leagne of Municipalities strongly supports A-276 as released and has .requested that all of its members to go on record similarly supporting the same. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough ofCarteret, County of Middlesex, State ofN~w Jersey, as follows: 1. That the Borough of Carteret hereby supports Assembly Bill A-2868 ..... . released by the Assembly Law and Public Safety Committee. 2.
