S %- //= RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO LORETTO TOWING WHEREAS, Loretto Towing (Applicant) has applied for a conditional use permit to operate a towing and automotive repair business at 4775 Co. Rd. 19 on property legally described on Exhibit A attached hereto; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on June 30, 1987, and by the City Council on July 7, 1987; and WHEREAS, it has been determined that the existence of the proposed towing repair shop will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. By no later than August 1, 1988, the Applicant shall install on the building the fascia treatment shown on the plan submitted to and approved by the City, which treatment is of compatible building materials and meets the City's performance standards for existing buildings; 2. The City and the Applicant recognize the existence of the current radio antenna tower at its present height if it meets standards for tie downs and grounding but any new or rebuilt antenna must meet all codes in effect at the time of construction or repair; 3. The Applicant shall install landscaping by no later than January 1, 1988, which landscaping shall include 16 units of trees of a minimum 2" caliper; 4. The Applicant shall remove the above ground fuel storage tanks within 60 days of the date of adoption of this resolution; 5. Any alterations to the existing fencing must be approved by the City zoning administrator and shall be in compliance with City Codes; 6. Within 10 days of the date of the adoption of this resolution, any security animals maintained on site shall be kept inside the building at night and during the day in a kennel measuring at least 6 X 6 X 20 with a roof and concrete floor; 7. The Applicant shall move the trash container to the rear of the building and screen it to the satisfaction of the zoning admini- strator; 8. A11 supplies and materials shall be stored in the fenced area or within the building; 9. A11 vehicles shall be kept in the fenced area or within the building when the facility is not open for business; 10. The existing exterior lighting is hereby approved; 11. It is acknowledged by the City and the Applicant that the existing sign for the business is located on an adjacent parcel not owned by the Applicant and that any new sign will be constructed in compliance with ordinance requirements; 12. The Applicant shall maintain current licenses from the appropriate jurisdictions for the proper and lawful disposal of all waste materials generated or stored on site; 13. The Applicant shall maintain the exterior of the building in a good state of repair; 14. A11 parking (12 spaces are recognized) shall be on blacktopped areas and landscaped areas shall be maintained and not used for storage or parking; 15. Hours of operation shall be limited to 8:00 a.m. to 6:00 p.m., Monday through Friday; 8:00 a.m. to 2:00 p.m. on Saturday; and 1:00 p.m. to 2:00 p.m. on Sunday. Emergency towing may occur 24 hours per day, 7 days per week; 16. There shall be a maximum of six employees on site at any one time; 17. The Applicant shall convey a 40' easement for roadway purposes along Co. Rd. 19 unless the Applicant can demonstrate that such an ease- ment currently exists; and 18. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application. 2 Dated: , 1987.
