MINUTES
NOVEMBER 20, 1979
INITIATION:
1. CALL' TO ORDER:
Mayor Dennis called the regular meeting of the City Council to
order at 7:37 p.m. on Tuesd'ay,. November 20,:1979, in the Council
Chamber of the City Hall.
2. INVOCATION:
The invocation was given by Dr. Edwin Linberg, Temple City Christian
Church,•9723: Garibaldi Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Dennis.
4. ROLL CALL.:
Present: Councilmen-Atkins, Gillanders., Merritt, Tyrell, Dennis.
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin,, Assistant
City Manager Pucci, Planning Director Dragicevich,
Parks and Recreation Director Kobett., Orville McCollom,
Deputy City Engineer, Julie Estrada, Temple City Times
At this time, Mayor Dennis presented a Certificate of Recognition to
Jerry G.errits,, President, Temple City Host Lions. Club, in appreciation
for 25 years of community service by placing the American Flag along.
Las Tunas Drive and Temple City Boulevard on all national holidays.
5 . CONSENT" CALENDAR:
On motion by Councilman Tyrell, seconded,by Councilman. Atkins,

(1). ROWLAND AVENUE', EAST` SIDE, SOUTH OF LAS TUNAS DRIVE -
Rescinding of Commercial 'Loading Zone-
Approved rescinding of an existing commercial loading zone on
the east side of Rowland. Avenue from 26 ft. to 131 ft. south of
the south curb line of Las. Tunas. Drive, and the installation of
parking stalls on the east and west side of Rowland Avenue from
Las Tunas Drive to Workman.
(2) LA ROSA DRIVE AND ALESSANDRO, ADJACENT TO LA ROSA.S'CHOOL
Additional Traffic Controls
Approved posting No Parking 8.:30 a.m. to 300 p.m., School Days
Only, with directional arrows, on the north side of La Rosa Drive;.

(3) SANTA ANITA AVENUE AND FREER STREET - Signal Modification
Approved replacing the obsolete sonic detectors with inductive
loops on a shared cost basis with the County of Los Angeles at
the intersection of Santa Anita Avenue and Freer Street, and
adjusted the adopted budget accordingly.

(4) T)ELETION OF LIVE OAK AVENUE FROM RESTRICTED LIST - Overnight
Parking Permit Application Form
Approved deletion of Live Oak Avenue from Glickman Avenue easterly
from the back of the Overnight Parking Application form.
C. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of November 13
(1) AMENDMENT TO TEMPLE CITY ZONING CODE SECTION 9380 to permit
Heating and Air Conditioning Sales in the C -2 Zone
Set Public Hearing December 4, 1979 to consider subject amendment
to the Temple City Zoning Code.
(2) AMENDMENT TO TEMPLE CITY ZONING CODE SECTION 9371 to permit
a Newspaper Office in the C -1 Zone
Set Public Hearing December 4, 1979 to consider subject amendment
to the Temple City Zoning Code.
(3) PLANNING COMMISSION ACTION
Received and filed. memo relating to action taken by the Planning
Commission at their regular meeting held November 13.
D. ACCEPTANCE OF WORK: LIVE OAK PARK AND LONGDEN SCHOOL ATHLETIC
FIELD LIGHTS
Accepted the work completed by the Temple City American Little League
with the assistance of other local' athletic youth groups, authorized
filing Notice of Completion, and authorized filing for remaining
State funds.
E. TEMPLE CITY PARK DEVELOPMENT: PLAY APPARATUS AREA
Rejected the bids received for subject project on the basis the bids
were not reasonable and do not serve the interest of the City to •
accept, and directed staff to review the project and determine the
availability of additional State funds.
F. AWARD BID: 1 -TON PICK TIP TRUCK
Awarded bid to the low bidder, Fox's Five Acres, in the amount of
$7,118.17 and authorized staff to purchase the 1 -ton pick up truck.
G. APPROVE SPECIFICATIONS: SLURRY SEAL PROJECT - MAINTENANCE AREA NO. 4
Approved specifications for subject project and authorized staff to
advertise for and receive bids.
H. RESOLUTION NO. 79 -1850: EMPLOYMENT OF PERSONNEL

UNFINISHED BUSINESS:
6 PUBLIC HEARING: UNDERGROUND UTILITY DISTRICT N0. 4
City Manager Koski presented background information, stating that in
a continuing effort to aid the City in providing for the health,
safety, and welfare of the public, Southern California Edison Company
has recommended and staff concurs, the establishment of Underground
Utility District No. 4, in the area generally bounded along the east
side of Rosemead Boulevard, the southern half of right of way on Elm
between Rosemead Boulevard and Sultana Avenue; the area from Sultana

Avenue from Las Tunas Drive north to the alley and four properties
on the south side of Hermosa Avenue; and the area located at the
southeasterly corner of Rosemead Boulevard and Las Tunas Drive,
between Rosemead and Sultana, north of the alley and properties
located at 5705 and 5679 Sultana Avenue. Fifty-three properties
are involved and the estimated cost is $151,100 with Public Utilities
Commission Rule 20 allocations to the City to be used to fund the
project. The property owner is required to make the necessary
private property conversion to meet Edison's improvement which is
estimated to cost the property owner $500. The Underground instal-
lation by utility companies and property owners reconnections is
scheduled no later than December 1, 1980, removal of poles, overhead
wires and other associated overhead structures no later than
February 1, 1981. The project is categorically exempt from Environ-
mental Impact.
In answer to question from Mayor Dennis, City Manager Koski advised
that a part of the theater development would include removal 'of over-
head wires and connection to underground structure located on Sultana
Avenue, and that it is anticipated the alley running through the
middle of Mr. Edward's property will be vacated and overhead structures
removed.
Mayor Dennis declared the public hearing open.
City Council had the Engineer's report dated November 15, 1979, and
in answer to questions from Council, Deputy City Engineer McCollom
stated he has not made inspection of each property in the proposed
district, and some may require upgrading their own facilities. The
$500 estimate is Edison's, but only for conversion of existing service
on the properties and if the property owner wishes to convert to a
larger service it could be expensive.
City Manager Koski stated if the property owner wishes not to accept
Edison's estimate of $500, they could obtain an electrical contractor
who would give them an estimate. If Council wishes to pursue the
individual costs further, a structure by structure investigation can
be made.
Mayor Dennis stated that at the time former districts were initiated,
an estimate was provided on the same basis as District No. 4; that
the estimate is based on the same type of service which now exists.
Keith LeFever, representing Southern California Edison Company,
stated that Edison will not require existing customers to upgrade their
facilities and he doubts the County would require it; that from his
experience he would estimate the cost to be $500. Whenever possible,
Edison will run conduit along the property line which will minimize
the cost to individual property owners.
In answer to question from Mayor Dennis, Mr. LeFever stated that
Edison does not have engineer's work done prior to approval of a
district because of the expense; usually they do preliminary engineering
and minimum route system. Mr.LeFever also stated he has been in
the engineering and design service for Edison for seven years and
feels his estimate is an educated one, and that he would happy to
meet with any individual property owner to assist him in the work
to be done.
In answer to question. from Councilman Tyrell, Mr. LeFever stated that
conduit could he run above ground and if that is a property owner's
desire, he will work with him at the time the engineering and design
is being done.
John Conover, 5655 Sultana Avenue, stated he owns 9042 -48 Las Tunas
Drive, and he feels the public hearing, is in violation of Ordinance
No. 68 -265 which states the City Engineer shall prepare a report to
include estimates of the total cost prior to the hearing, in that
the estimate of $500 is being made by Edison and he does not feel it
is a reliable estimate. Mr. Conover stated he does not feel under-
grounding is necessary because the unsightly poles are in the rear of
the properties and he is opposed to the creation of Underground
District No. 4.

City Attorney Martin stated the estimate of $500 is based on seven
years experience by Mr. LeFever and inquired of the Deputy City
Engineer whether he felt the estimate is valid. Mr. McCollom
stated in his opinion Edison Company's estimate would be a valid
one. City Attorney Martin ruled that the Council was conducting a
legal hearing.
Councilman Tyrell moved to include letters of protest from Modern
Electric Company and F & A Realty, Inc. as a part of the record,
seconded by Councilman Gillanders and carried.
Stan Van Amburgh, 9133 Las Tunas, inquired why the City want to
create an underground district and was advised the monies have been
accumulating each year and establishing an underground district will
be a continuation of the revitalization of the downtown area, and
more importantly, the Edison System is more reliable underground
since the facilities are not subject to the elements, and underground
facilities are unquestionably safer.
John Rickey, 9125 Las Tunas Drive, inquired how long Edison would
take for trenching and backfill, stating he needs to get onto his
property daily. Mr. Rickey was advised that Edison would work with
him so that he would not be too inconvenienced.
Lawrence Robinson, 9165 -67 Las Tunas Drive, asked about the impact
5T undergrounding on a property's assessed valuation, and was advised
that unless a structure is enlarged no re- assessment is made. Mr.
Robinson stated he views the proposed district as improving Temple
City and an investment in the future.
John Conover inquired as to the costs for reconnecting telephone
service.

Carol Durbin, representing Pacific Telephone, state the telephone
company would absorb all costs to the property line and the property
owner would be responsible for the line from the property line to
his service.
In answer to question from City Attorney, Mr. LeFever stated that
once an underground district is approved, the design work will commence
and before the project begins he will be able to tell each property
owner exactly where the stub out will he located and they can have
their own contractor give them an estimate from that point to service
There being no one else come forward to speak, Councilman Gillanders
moved to close the public hearing, seconded by Councilman Atkins and
carried.
Councilman Tyrell stated he feel Council should obtain expert opini-on..
as to the related costs to hook. up to service before approving an
underground district.
Councilman Tyrell moved to terminate proceedings, seconded by Council-
man Gillanders. Motion failed on a roll call vote:

Councilman Atkins moved to certify the categorical exemption from
California Environmental Quality Act of 1970, as amended', --and -find -
the project involves no possibility of impact, seconded by Mayor
Dennis and carried on a roll call vote:

City Attorney Martin.introduced Resolution No. 79 -1852 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 4 by title only, noting the fact there was a
challenge to the public hearing pursuant to Ordinance No. 68 -265,
Section 2(b), and to the determination as to whether the public
health, safety, and welfare requires. Councilman Atkins moved to
adopt, seconded by Councilman Merritt. -'

Councilman Tyrell stated he feels the underground district is being
proposed only on the basis of aesthetics and that the estimate of
cost has not been sufficiently established for this particular project.
Councilman Gillanders stated he has mixed feelings about the project
and would like to give the property owners an opportunity to find out
exactly what their costs will be.
Councilman Merritt stated the City faced the same problem when the
underground district was initiated in the malls and in his opinion
the project will be more expensive if it is delayed.
Councilman Gillanders suggested the decision be delayed for 30 days
to give the property owners the opportunity to more fully explore
their costs.
Councilman Atkins stated that over the years it has been the City's
policy to require undergrounding at every opportunity; that is,
for new development, etc. and he feels the proposed project is
consistent with that policy.
Councilman Tyrell stated he sees no consistency here, in that
for new developments the developer passes the cost to the ultimate
buyer of the property.
Mayor Dennis stated he agrees with Mr. Robinson's conunents that this
particular area does need some help and improvement. The project
will provide additional value to the properties involved.
The motion to adopt Resolution No. 79 -1852 carried on a roll call
vote:

RECESS TO CRA:
City Council recessed at 9:07 p.m. to meet as the Community Redevelopment
Agency, all members being.present; approved the minutes of the regular
meeting held October 16, 1979, adopted resolution approving warrants and
demands, and authorized the restriping of the parking facilities. The
minutes are set forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:
9. ACTION ON REQUEST BY CRA:
There was no action to he taken.
10. MATTERS FROM CITY OFFICIALS:
A. Travel Bureau in Excess of 1000 sq. ft. in C -1 Zone
City Manager Koski advised the Planning Commission, at their regular
meeting held November 13, 1979, considered amendment to the Zoning
Code to permit travel bureaus in excess of 1,000 sq. ft. of gross
floor area in the C -1 Zone and favored retaining the provisions of
limiting travel bureaus to 1,000 sq. ft. as much of the business is
transacted by telephone.

Councilman Gillanders moved to retain the present provisions
regarding Travel Bureaus and "grandfather" in the existing travel
bureau that has relocated from one location to another in the C -1
zone, seconded by Councilman Atkins and carried.
B. Ordinance No. 79 -437 relating to Parking Commission
City Manager Koski introduced Ordinance No. 79 -487 AN ORDINANCE
OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 2641, 2650, 2660, and 2661
OF THE TEMPLE CITY MUNICIPAL CODE relating to the Parking Commission
for first reading by title only. Councilman Gillanders moved to
waive further reading, seconded by Councilman Tyrell and carried.
C. Councilman Atkins moved to deny Parking Commission recommendation
to extend part time parking enforcement program to full time from
December 1, 1979 to January 1,1980, seconded by Councilman Gillanders
and carried.
Councilman Atkins moved to concur with the Parking Commission to
retain the two hour restriction which now exists in public parking
lots 3, 2B, and 4, seconded by Councilman Gillanders and carried.
D. Real Estate Signs
Councilman Atkins moved to refer the Zoning Code section relating
to real estate signs to the Planning Commission for their review
and comment, seconded by Councilman Gillanders and carried.
E. Councilman Gillanders moved to instruct staff to advise the
School District the City has no interest in acquiring surplus property
which the district no longer needs for school purposes, seconded by
Councilman Atkins and carried.
F. Councilman Merritt moved to authorize staff to proceed negotiating
with interested property'owners regarding annexation of unincorporated
area in the vicinity of Rosemead Boulevard and Longden Avenue, seconded
by Councilman Gillanders and carried.
G. Ordinance No. 79 -488 relating to re- roofing
City Manager Koski introduced Ordinance No. 79 -488 AN ORDINANCE OF
THE CITY OF TEMPLE CITY ADDING SECTION 7131 TO THE TEMPLE CITY MUNICIPAL
CODE ADDING NEW SECTION 3200 To THE UNIFORM BUILDING CODE RELATING TO
ROOFS AND RE- ROOFING BY OWNERS for first reading by title only.
Councilman Tyrell moved to waive further reading, seconded by
Councilman Gillanders and carried, Councilman Atkins abstaining.
H. City Manager Koski presented communication from Clarke Directory
Publications, Inc. requesting to use the City's logo on the front
cover and solicit advertising from the business community for a local
telephone directory. Councilman Atkins moved to approve solicitation,
but not the request to use the City Logo, seconded by Councilman Merritt
and carried.
I. City Manager Koski presented a proposal from Martin and Chapman
for election services for the election to be held April 8, 1980.
Councilman Atkins moved to approve proposal dated November 19, 1979,
seconded by Councilman Gillanders and carried.
11. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Gillanders
meeting adjourned at 9:18 p.m. Next regular meeting of the City
Council wi_1.1 he held Tuesday, December 4, 1979, 7:30 p.m. in the
Council Chamber of the City Hall.
