RESOLUTION DENYING A
VARIANCE FOR ROGER AND CAROLE JOHNSON
WHEREAS, Roger and Carole Johnson (Applicants) have requested a variance
to declare buildable the lot legally described as Lot 2, Block 1, Hickory
Haven, which lot is one-half acre in size; and
WHEREAS, Section 825.13 of the City's zoning ordinance allows the use of
a lot as small as one acre in area if certain conditions are met, including
the requirement that the lot be in separate ownership from abutting property
since the effective date of the City's zoning ordinance; and
WHEREAS, the Applicants have owned the subject lot as well as the
adjacent lot (Lot 3, Block 1, Hickory Haven) continuously since the adoption
of Section 825.13 of the City's Code of Ordinances; and
WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat.
Section 462.357 require that variances from the strict interpretation of the
zoning ordinance be granted only when there is a demonstrated hardship because
of circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicants' request and
has recommended denial thereof; and
WHEREAS, the City Council has had an opportunity to review the matter and
to hear from the Applicants regarding the request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the Applicants' request for a variance be denied because there
has been no demonstration of hardship unique to the property as required by
city ordinance and state statute. The City Council further recommends that
the Applicants combine the two lots for tax purposes.
