HomeMy Public PortalAbout1987-118Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. 3 7_ / / g RESOLUTION GRANTING A VARIANCE FOR RICHARD AND MADELEINE LINCK WHEREAS, Richard and Madeleine Linck (Applicants) have requested a variance to rebuild an old existing barn 75 feet from the lot line on their property at 1762 Morgan Road; and WHEREAS, Section 826.25 of the City's zoning ordinance requires that barns maintain a setback of at least 150 feet from all property lines; and WHEREAS, removal of the existing non -conforming barn will eliminate any rights the Applicants have in maintaining the building and the reconstruction thereof in the same location requires a variance; and WHEREAS, Section 825.45 of the City's Code of ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the Planning Commission and City Council have considered the Applicants' request and have reviewed the matter thoroughly. NOW, THEREFORE, BE IT. RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance be granted because of the existence of poor soil conditions and drainage areas on the property, the location of the drainfield for the mound septic system and the fact that the new barn will replace an existing barn, subject to the following conditions: 1. The barn shall be constructed with a setback from the property line of 75' or as close thereto as possible with consideration given by the city staff to the location of the existing drainfield; 2. The new barn shall not in any manner exceed the footprint or exterior envelop of the existing barn; 3. The number of accessory buildings on the site, including the reconstructed barn, shall not exceed ordinance standards. 4. The maximum number of horses permitted on the property shall be five; 5. The Applicants shall ensure removal of manure in accordance with the standards of the Minnesota pollution control agency. Dated: L%d h L r' olU , 1987. homa : n• erso'.
