I 0 30 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CITY CODE, CHAPTER 4, TO AUTHORIZE THE LIQUOR BOARD TO EXTEND LIQUOR LICENSES TO OUTSIDE THE LICENSED PREMISES. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Code, Chapter 4 is hereby amended by adding one section to read as follows: Sec. 4-44. Liquor Licenses may be extended outdoors. A. The Director of Finance shall promulgate a form to extend a current liquor license from the licensed premises to an adiacent area outside the premises. B. A current liquor license may be extended to an adjacent outside premises upon the filing of a proper application to extend the premises by a current liquor license holder. A copy of the applicant's state liquor license which includes the extended area must be submitted with the applicant's city application. C. The Liquor Board may approve such application with the following limitations: 1. The Licensee shall clearly mark the boundaries of the extended area with a fence, rope,or other barrier approved by the Chief of Police and so erected in a manner approved by the Chief of Police,clearly indicating the limits of the licensed premises. 2. No person shall possess alcohol within the extended area except in a container issued by the licensee. D. The licensee shall be responsible for cleaning up trash from the extended area. L—If the property to be utilized as the extended permit area is not owned by the applicant,anv application for extension must be accompanied by the consent of the owner of the property. Excessive noise such that utilization of the extended area disturbs the peace of reasonable persons who own adjacent properties to the licensed area. b. Trash from the extended area leaves the extended area and goes onto the property of another person. G The City Administrator shall set an administrative application fee which shall be less than the fee for a new liquor license. f],_�license may not be extended to a city sidewalk through this section. Section 2. The City Code, Section 4-17, is hereby amended to read as follows. Sec. 4-17. Public consumption. It shall be unlawful for any person to consume intoxicating liquors upon any public street, sidewalk,alley, or public building, and it shall be unlawful for any person to consume intoxicating liquors on or in any establishment, business or parking lot generally open to the public unless a liquor license has been issued for that establishment, business or parking lot.
