PUBLIC HEARING: IMPROVEMENT NO. 79 -6: AGNES AVENUE SEWER IMPROVEMENT City Manager Koski presented background information, stating the City Council, at their regular meeting held October 16, 1979, based on the City Engineer's recommendation and report, adopted a resolution of intention to order•the acquisition of rights-of-way for the construction of sanitary sewers on Agnes Avenue, north of Longden Avenue, and set public hearing December 4, 1979. The total estimated cost of the improvement was $23,400, or $3,900 per property owner. Bids received for the construction of sewers exceeded the original amount by $4;600 which is an increase to property owners to $4,775, an increase of 22.4 %. Under. the provisions of the 1913 Improvement District Act, the original estimate must be modified by resolution and another hearing set to give the affected property owners an opportunity to express their —iew on the increased assessment. Three written protests have been received.. Festival. by circulating flyers outside the city although the number of flyers, will be 1%mted, because. the Committee would like to see participation from the people of Temple City, In answer to question. from. Council relating to liability, Mr. Alcantara advised the Chamber's insurance policy for $3,000,000 will cover this event, Councilman Gillanders stated he felt if Council supports this program, it might consider offering trophies to the. winners of the various events. Council Minutes, December. 4, 1979 - Page 4 Councilman Tyrell moved to approve the event, subject to City Attorney's approval of the Chamber certificate of insurance, and City Manager's approval of the route, seconded by Councilman Gillanders and carried. Councilman Gillander.s moved to participate in the purchase of trophies seconded by Councilman Atkins and carried, B, City Manager advised the City received an appeal to the Planning Commission denial of a zone variance in Zone Variance Case No. 79 -568 within the specified time limit. Councilman Tyrell moved to set public. hearing January 15, 1980, seconded by Councilman Atkins and carried, C. Kiwanis Club - Request to Conduct Line of Dimes, January 25, 1980 City Manager Koski presented .communication from Kiwanis Club of Temple City requesting permission to conduct its annual Line of Dimes.tumpaign at the intersection of Las Tunas Drive and Temple City Boulevard from 11:30 a.m. to 5:30 p.m. January 25, 1980, and Mother's March February 13, 1980 from 6 to 8:30 p.m. Councilman Gillanders moved to approve request as set forth in Kiwanis Club letter dated December 1; 19.79, subject to the required Certificate of Insurance naming. the City of Temple City additionally insured and pro- vided :. the automobile solicitation is conducted by adults 18 years of age or older, seconded by Councilman Atkins and carried. D. . County Fire Department re: Fire Hydrant Service Agreement On motion by Councilman Merritt, seconded by Councilman Gillanders, Council received and filed-- a- letter from- Chief Bragdon advising recent legislation prohibits wa.ter-purveyors_ from rharging a fee for water, services: for fire protection purposes, which means that effective January .1.,1980, there will be a shift of water service costs for fire, protection fr�rn fire protection agencies to water purveyors. 9 TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK. Koski advised. the_ City contract. far general._ law. enforce - ment with the_County of Los Angeles expires in April, 1980 and pursuant to the contract, notice of intention must be sent to the Board of Supervisors prior to December 31, '19.79. C o h n i l or a n • C ill i d e r s moved to. a t: Resalitrinn No 79 -1860 A RESOLUTION OF TI CITY .COUNCIL: OF THE" CITY OF TEMPLE CITY, CALIFORNIA., NOTIFYING THE BOARD OF SUPERVISORS OF CITY COUNCIL'S INTENTION TO RETAIN LOS ANGELES COUNTY _SHERIFF SERVICES, seconded by Councilman Atkins and carried Council Minutes, December 4, 1979 - Page 5 B, Councilman Merritt advised that the Kiwanis Club had voted to -allocate. $900 to purchase geodesic climber for the play area at Temple City Parka C. Councilman Tyrell stated he felt additional fencing along the north side of the. tennis courts at Live Oak Park should be considered in view of. the problem being experienced of skaters and others playing on the courts. Council instructed staff to prepare a memo to include cost for the additional fencing for Council review at their regular meeting to be held December 18, 1979. Councilman Tyrell directed. Council's attention to a letter he received from San. Gabriel Valley Humane Society stating the society is not required by law to conduct public meetings or that its records are public, and requested the City Attorney to review the matter and give his opinion to the City Council. Councilman Tyrell also requested copies of the - letter be forwarded to the members of the City. Council.. D, Councilman Gillanders directed Council's attention to the letter received from Californians for Consumers No- Fault, stating he plans to obtain a copy of the initiative measure patterned after AB 116 if possible. E, Mayor Dennis stated that the Council having taken action this evening to expand the members and responsibilities of the Parking Commission, he would nominate the reappointment of Ao W. Driver for a term expiring. June 30, 1981; confirm the appointments of Penny Graham and Al Millham, whose terms expire June 30, 1980; and appoint- ment of. Arthur McCoy, Eloise Ward, and Carl L. Clark, Sr, for a term to expire dune. 30, 1981, This will balance the structure of the Com- misslon with two representatives from the Community Redevelopment Project Area, three representatives from the downtown parking districts, and two members representing the community at large. There remains Ione vacancy on the commission representing the community at large.
