RESOLUTION NO. 2018-04-02
A RESOLUTION RECOMMENDING APPROVAL OF THE PRELIMINARY PLAT AND
DEVELOPMENT PERMIT FOR ELK CREEK FILING NO. 5
At a special meeting of the Fraser Planning Commission held on April 11, 2018,
Cornerstone Winter Park Holdings, LLC., requested a recommendation of approval for a
Preliminary Plat Elk Creek at Grand Park Filing No. 5 and a Development Permit Elk Creek at
Grand Park Filing No. 5; and
WHEREAS, Cornerstone Winter Park Holdings, LLC., is the current owner of the
property; and
WHEREAS, the applicant is requesting preliminary plat and development permit
approval which would create 7 residential lots, ranging in size from 2872 square feet (SF) to
5051 SF on .740 SF of land; and
NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted
to recommend approval of the Preliminary Plat and Development Permit for Elk Creek Filing No.
5 with the following conditions:
1. Setback language on the plat doesn't match the Development Permit. The setbacks
listed on the Development Permit conform to the Business Zone regulations. Revise plat
accordingly.
2. Development Permit note #7 indicates that Grand Park Development will own and
maintain the open space; however, the owner is listed as Cornerstone Winter Park
Holdings, LLC. Revise Development Permit accordingly.
3. Development Permit, sheet 2 of 5, and Plat, sheet 2 of 2, references Elk Creek Filing No.
2 as the adjacent subdivision. Revise to reference Filing No. 3.
4. Please note that the Plat should be a Preliminary Plat not a Final Plat.
5. Delete Plat Note 9 as this property is not part of the Grand Park PDD.
6. Add the following note to the Final Plat and the Development Permit: "This property is
subject to the terms of the May 26, 2005 Subdivision Improvement Agreement (SIA)
executed between the Town and Cornerstone Winter Park Holdings LLC and recorded
at Reception # 2005-005385. No building permit shall be issued until the mutual terms,
conditions and obligations as detailed in the SIA have been addressed to the satisfaction
of the Town of Fraser.
7. Execute an agreement with East Grand School District for school impact fees or money
in lieu of land prior to Town Board approval of this development application.
8. Address all engineering comments in the Bowman memo dated March 27, 2018.
9. Address all legal comments in the Rod McGowan memo dated March 30, 2018.
APPROVED AND ADOPTED THIS 11th DAY OF April, 2018.
