RESOLUTION NO.
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
JOHN DAY
WHEREAS, John Day (Applicant) has applied for a conditional use permit
for construction of an office -warehouse facility on property legally described
as Lots 1 and 2, Block 2, Medina Industrial Addition, Hennepin County,
Minnesota; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter was reviewed by the planning commission on October
13, 1987, and by the City Council on November 3, 1987; and
WHEREAS, it has been determined that the construction of the proposed
facility will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicant for the
stated purpose, subject to the following terms and conditions:
1. There shall be no outside storage permitted on the site, with the
exception of not more than two licensed and operable vehicles used
in connection with the business;
2. Exterior building materials shall be those shown on the plans
presented to the City or alternatives acceptable to city staff;
3. All signs on the site shall be in compliance with city ordinances;
4. The parking area located on the side of the building shall be
screened from view in the manner shown on the plans presented to the
City;
5. There shall be no exterior storage of trash containers on the site;
6. The Applicant shall install landscaping in accordance with the plans
presented to the City no later than October 1, 1988;
7. Parking shall be installed as shown on the

8. The hours of operation shall be limited to 7

11. Rooftop mechanical equipment shall be screened in accordance with
city ordinance requirements;
12. The maximum number of employees on the site shall be nine;
13. The two lots in this project shall be combined to the satisfaction
of city staff prior to issuance of a building permit;
14. It is acknowledged that the subject conditional use permit pertains
only to the building the Applicant proposes to construct immediately
hereafter and that any additional building constructed on the site
in the future will require another conditional use permit;
15. The Applicant shall execute a Development Contract and post a
completion bond which are satisfactory in form and amount to city
staff; and
16. The Applicant shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Medina that variances be granted to reduce the required front yard setback
from 50' to 30', the side yard setback from 30' to 15' and the rear yard
setback from 30' to 15' on the grounds that such variances are consistent with
the development standards of adjacent properties.
