I Z4- x s(r AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING THE FINAL SUBDIVISION PLAT OF HOLT SUBDIVISION, A SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI. WHEREAS, JDM Development, LLC, owner of the real estate hereinafter described, having submitted to the City Council a plat of said real estate, being located in Jefferson City, Cole County, Missouri, and being a tract of land located in the Southeast Quarter of Section 4, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri and being part of the tract described by the trustee's deed recorded in Book 552, Page 717 and part of Reserved Tract "A" of Monticello Acres, Section Four as described by the warranty deed recorded in Book 590, Page 480 of the records of Cole County, Missouri and also shown as Tract "B" of the parcel division survey recorded in Book B, Page 183 of the records of Cole County, Missouri and being more particularly described as follows: Beginning at the northwest corner of said parcel division survey; thence along the south right- of-way line of North Ten Mile Drive, N79°23'50"E, 157.04 feet; thence leaving said right-of-way line, S3°37'20"E, 175.67 feet; thence N85°01'40"E, 267.80 feet to the west right-of-way line of Constitution Drive; thence along said right-of-way line, S4°58'20"E, 136.50 feet; thence along a 340.05 foot radius curve to the right, 81.50 feet, said curve having a chord which bears S1°50'05"W, 81.30 feet; thence leaving said right-of-way line S79°39'15"W, 421.98 feet along the south line of the tracts described by the warranty deed recorded in Book 590, Page 480 and the trustee's deed recorded in Book 552, Page 717; thence along the west line of tract described by said trustee's deed, N3°37'20"W, 417.08 feet to the POINT OF BEGINNING and containing 2.91 acres. WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the owner of said subdivision, known and referred to as the Final Subdivision Plat of Holt Subdivision, that all taxes have been paid, that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said subdivision, and that in all respects the requirements of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. That the Final Subdivision Plat of Holt Subdivision, lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by the City Council of the City of Jefferson, Missouri. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of Jefferson. Ten Mile Drive & Constitution Drive; Final Subdivision Plat of Holt Subdivision. Application filed by Jay Gebhardt, authorized representative, JDM Development, LLC, property owner for a final plat of 2.91 acres on land zoned RA-2 High Density Residential. This proposed minor plat includes 2 lots. The property has street frontage on Constitution Drive and N. Ten Mile Drive. The property is described as part of the Southeast Quarter of Section 4, Township 44 North, Range 12 West, Jefferson City, Cole County, Missouri. (A Civil Group, Consultant) Mr. Barron described the proposal and explained that this property had been previously divided via an administrative parcel division. He stated that the owner would like to further divide this property but the only way to do so is through a subdivision plat. He stated that this is zoned RA-2, multi-family residential. Mr. Barron explained that two lots have been proposed with the size of the property being 2.91 acres. Mr. Kevin Murphy, 3401 Broadway Business Park, Columbia, Missouri, representing JDM Development, spoke on behalf of his client. Mr. Murphy asked for clarifications on the street lighting requirement and noted they will bring in conduit to place the lighting. He asked staff and commissioners if there is a process or any type of petition for his client to ask for the City to participate in a cost share for the lighting to be installed. Mr. Murphy also asked what date the sewer needed to be finalized to keep in the time frame proposed. In response, Mr. Murphy replied that there is nothing set at this time on a large scale, but possibly a group home. Mr. Jordan asked for staff to clarify the lighting stipulation between the subdivision code and the existing code. Ms. McMillan explained that the subdivision plat is what is going before the Council and with that In mind the developer would have to install all required infrastructure. She stated that the owner could petition the City for participation in the lighting installation but there would be no guarantees. Mr. Jordan explained that to move forward tonight with the subdivision plat they would need to accept the requirements. Mr. Murphy agreed to accept the conditions as stated. No one spoke in opposition to this request. Mr. Barron gave the Planning Division staff report. Mr. Wade gave the Engineering Division staff report. Mr. Nunn moved and Mr. Vaughan seconded to recommend approval of the final subdivision plat subject to any recommendations by staff with stipulations specified to finalize sewer for Lott and approved street lighting on Constitution be installed, to the City Council. Ten Mile Drive & Constitution Drive; Final Subdivision Plat of Holt Subdivision. Application filed by Jay Gebhardt, authorized representative, JDM Development, LLC, property owner for a final plat of 2.91 acres on land zoned RA-2 High Density Residential. This proposed minor plat includes 2 lots. The property has street frontage on Constitution Drive and N. Ten Mile Drive. The property is described as part of the Southeast Quarter of Section 4, Township 44 North, Range 12 West, Jefferson City, Cole County, Missouri. (A Civil Group, Consultant) Bael around This Minor Subdivision Plat is proposed in order to divide a single parcel into two lots. The property was formerly divided via an administrative parcel division that created the parcel on the corner of N. Ten Mile Drive and Constitution Drive and is not eligible for a further administrative parcel division. A short sewer line extension is required in order to serve one of the lots. Description of Proposed Plat Zoning: RA-2 High Density Residential Size of Property: 2.91 Acres Number of Lots: 2 lots Lot Width: Lott —220 feet Lot 2— 157 feet Lot Sizes: Lot 1 —2.31 acres Lot —0.60 acres Streets: No streets are proposed with this plat. Staff Analysis Both lots shown on the proposed final plat meet the dimensional requirements outlined within the zoning code and both lots have adequate street frontage and utility access. Several minor technical corrections and comments on the plat have been transmitted to the consultant, including a request to extend a sewer line easement across proposed lot 2 in order to provide future service for the property to the west. An updated plat with the comments and technical corrections addressed and finalization of the sewer improvement plan will be necessary prior to introduction of the final plat to the City Council. Compliance with the sidewalk requirements of the City Code will also be necessary. Staff Recommendation Staff recommends approval of the final subdivision plat subject to the following: 1. Compliance with the sidewalk requirements of the City Code. 2. Compliance with the comments and technical corrections of the Planning and Engineering Divisions. Submittal and approval of a sanitary seiner plan extension,prof le and easement to serve Proposed Lot 1. This u+ill be needed prior to Cio} Council consideration of this case. 2. Addition ofstreet lighting along the frontage of Constitution Drive per City Code requirements. 3. Sidewallrper City,Code requirements. Infrastructure Summary * Infrastructure exists in the vicinity. No sidewalk exists either North Ten Mile Drive or Constitution Drive. Storm water detention is not a specific requirement in this development, but may be needed only if downstream system capacities could be exceeded. Sanitary sewer exists to serve this property from the adjacent property and a sewer plan has been previously approved to serve Proposed Lot 2. Roadway, Storm Water/Erosion Control * No planned improvements are necessary for street and public storm sewer improvements. Storm water detention is not required, but may be needed only if downstream system capacities could be exceeded. Sanitary Sewer * A sewer plan has been previously approved to serve Proposed Lot 2. Sewer main extension is proposed to serve Proposed Lot 1. A preliminary plan layout for sanitary sewer main extension has been submitted and reviewed, but a final plan, profile and easement evil/need to be finalized prior to City Council consideration of this case. Sidewalk Sidewalk is required in accordance with City Standards. Sidewalk will be need to be planned during site development for lots in this subdivision. Street Access /Traffic Impact Constitution Drive and North Ten Mile Drive could be considered minor collector roadways serving not only adjacent residential property, but commercial/industrial property to the west and office property to the south. * Constitution Drive is a 33' wide curb and guttered commercial roadway with parldng allowed on one (1) side of the street. * North Ten Mile Drive is a 22'-24'foot wide un-curb and guttered roadway with no parking allowed. Fire Hvdrants /Street Lights * Some facilities are existing along North Ten Mile Drive and Constitution Drive. However it appears that addition of street lighting along the frontage of the property along Constitution Drive will be necessary.
